HomeMy WebLinkAboutBy-law 3660/91THE CORPORATION OF THE TOWN OF PICKERLNG BY-LAW NO. 3660/91 Being a by-law to authorize tile execution of a Release and Discharge of tile Subdivision Agreement respecting Plan 40M-1257, Picketing. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.l, s.50, or a predecessor thereof, The Corporation of the Town of Picketing and Nu-West Group Limited entered into an Agreement dated October 5, 1981, Notice of which was registered on February 9, 1983 as Instrument No. LT164331, respecting the subdivision and development of Plan 40M-1257, Picketing; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENAC'rS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A, of the Agreement dated October 5, 1981, Notice of which was registered February 9, 1983 as Instrument No. LT164331, between Nu-West Group Limited and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan 40M-1257, Pickering~ 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 18th day of February, 1991. Wayn~ Anh~rs, i3TOW N CF ICKIER'lNG I ^P ROV O lAS TO FORM Schedule A RELEASE AND DISCHARGE WHEREAS the Agreement dated October 5, 1981, Notice of which was registered February 9, 1983, in the Land Registry Office for the Land Titles Division of Durhan~ (No. 40) as Instrument No. LT164331, between, hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWN OF PICKERLNG hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may becgme subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1-86, inclusive, Blocks 87-93, inclusive, Abbey Road, Cedarwood Court, Halsey Lane, Madonna Court and Rigby Drive, Plan 40M-1257, Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this 18th day of February, 1991.
