Concession 1, Pickering designated as Parts 1 and 3, Plan 40R-20797 (Sheppard Avenue - File: RE0113 RECOMMENDATION: A by-law should be enacted to stop-up and close those parts of Lot 31. Concession 1. Pickering. designated as Parts 1 and 3, Plan 40R-20797 for the purpose of conveying the lands to the abutting owners for nominal consideration. ORIGIN: 1. Written request from the abutting owner. 2. Resolution 09/02. AUTHORITY: MUnicipal Act, R.S.O. 1990, chapter M.45, sections 191,297 and _315. FINANCIAL IMPLICATIONS: Advertising, Appraisal, Survey Costs and Legal Fees and Disbursements (Purchaser Costs) $2,000.00 EXECUTIVE SUMMARY: It has been determined that the lands described as those parts of Lot 31. Concession 1, Pickering, designated as Parts I and 3. Plan 40R-20797 (Sheppard Avenue) are no longer required by the Corporation and should be sold to the abutting owners. In this instance, because the portion of land is laid out as a highway, the process to stop-up, close and sell the property must be in accordance with the Municipal Act, which takes precedence over the City's Sale of Surplus I,and Policy. BACKGROUND: in 1966, the City acquired Parts 1 and 3, Plan 40R-20797 along Sheppard Avenue for future road widening purposes (as shown on mapping attached). When the ultimate design tbr Sheppard Avenue was established, it was determined that the road widenings were no longer required by the City and subsequently portions of road along Sheppard Avenue have been re-conveyed to the adjoining owners. On January 21, 2002, Council passed Resolution 09/02 authorizing the Solicitor for the City to commence the process of stopping-up and closing those parts of Lot 31, Concession 1. Pickering, designated as Parts 1 and 3, Plan 40R-20797 for the purpose of re-conveying the land back to the abutting owners for nominal consideration. BACKGROUND: Please find attached to this report a by-law for designation of the Woodruff-Mackenzie House. At its regular meeting of December 17, 2001, Council approved Resolution #170/01, Item #2, concerning the designation of the Woodruff-Mackenzie House at 2935 Brock Road. The process of designation required that Notice of Intent be advertised in the local newspaper for one week and notification then be served on the owner and the Ontario Heritage Foundation. No appeals have been received on this designation, therefore, Heritage Pickering (LACAC) are now requesting a by-law to designate be approved by Council. ATTACHMENTS: 1. The Day of Mourning was officially recognized by the Ontario Provincial Legislature in 1988. In 1991, An Act Respecting a Day of Mourning for Persons Killed or Injured in the Workplace passed through all stages of the House of Commons and the Senate. The Bill which now proclaims April 28t~ of each year as a National Day of Mourning received Royal Assent on February 1, 1991 and is now law. The Day of Mourning is also officially recognized in many countries throughout the world. We ask that your municipality join with us in paying our respects to those working people who have died at the workplace, or suffered injuries and diseases on the job by passing a resolution proclaiming Sunday, April 28, 2002 as "Day of Mourning". We also request that flags be lowered, where possible, on Municipal Buildings is honour of those killed at the workplace. While we mourn the dead, labour activists and all people must dedicate themselves to fight for the living and prevent this terrible and unnecessary toll by ensuring that all workplaces adhere to health and safety regulations and that all workers are regularly trained in all health and safety aspects of their workplace.
