HomeMy WebLinkAboutBy-law 4672/95 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 4672/95 Being a by-law to authorize the execution of a Licence Agreement between The Corporation of the Town of Pickering and the Regional Municipality of Durham. WHEREAS The Regional Municipality of Durham has requested The Corporation of the Town of Picketing to enter into a Licence Agreement in order for the Town of Picketing to complete work on Lands owned by the Region; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Licence Agreement, in the form attached hereto as Schedule A, between The Corporation of the Town of Pickering and the Regional Municipality of Durham respecting works to be done on Rosebank Road. W~yne~rthur~Mayor kruce aylor, er TOVVN OF=` PICKERtNG DURHAM LICENCE AGREEMENT REGION The Regional Municipality of Durham ("Region"), as the owner of certain lands which are part of Lot 30, Concession 1, in the Town of Picketing, Regional Municipality of Durham (the "Lands"), and the Town of Picketing ("Town") agree as follows: l. The Region grants the Town and its servants, agents contractors and consultants a licence, for a term of three (3) months from the date of this agreement mfless earlier terminated as provided herein, to enter onto that part of the Lands legally described as being Part Lot 30 Concession 1 now being shown in yellow on the attached sketch (the "Licence Lands") to construct a sidewalk and all actions and activities of the Town which are done or required to be done by or pursuant to this Agreement are collectively called the "Work". 2. The Town covenants and agrees to the following: (a) to do all Work and to fulfil all of its obligations hereunder, at its expense in a good and workmanlike mmmer, in accordance with good engineering and environmental practices; and in compliance with this Agreement, all applicable laws, by-laws, rules and regulations; (b) upon termination of this Agreement, to restore the Licence Lands to the condition which existed prior to the cormnencement of this Agreement, to do so promptly at its expense with the exception of where the sidewalk is located; (c) to fully indemnify and save the Region harmless from any losses, cost, expense, suit, claim or liability (any or all of which are herein called "Loss") which the Region may pay, suffer, incur, sustain or be exposed to as a result of or in connection with the Work, the condition of or any alteration to the Licence Lands as a result of the installation of the gas line on the Licence Lands, or m~y other action, activity or matter pursuant to or provided for in this Agreement; which indemity will survive the termination of this Agreement and continue in full force and effect thereafter. (d) the Region may terminate this Agreement forthwith if the Town breaches any of its covenants or obligations under this Agreement; IN WITNESS WHEREOF this Agreement has been executed by the Region and the Town as of ,1995.
