HomeMy WebLinkAboutBy-law 4667/95 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 4 6 6 7/9 5 Being a By-law to adopt Amendment Number 88 to the District Plan for the Town of Picketing (OPA 94-005/P) WHEREAS pursuant to the Planning Act, R.S.O. 1990, chapter P. 13, Subsections 17(6) and 21(1), the Council of the Corporation of the Town of Picketing may by by-law adopt amendments to the District Plan for the Town of Picketing, being an official plan, and submit them to the Region of Durham for approval. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. Amendment Number 88 to the District Plan for the Town of Picketing, attached hereto as Exhibit "A" and including the Explanatory Text, is hereby adopted. 2. The Clerk of the Town of Picketing is hereby authorized and directed to submit Amendment Number 88 to the District Plan for the Town of Picketing to the Region of Durham for approval. 3. This By-law shall come into force and take effect on the day of the final passing hereofi READ A FIRST AND SECOND TIME THIS 18th DAY OF September ,1995. WAYN~ARTHURS MAYOR TOWN OF CLERK P1CKERING Exhibit "A" to By-law /95 AMENDMENT NO. 88 TO THE TOWN OF PICKERING DISTRICT PLAN AMENDMENT NO. 88 TO THE PICKERING DISTRICT PLAN PURPOSE: The purpose of this amendment is to permit the development of a cemetery and related uses in addition to the currently permitted rural agricultural uses. LOCATION: The subject lands are approximately 27 hectares in size, located on the north side of Highway 7, east of Westney Road in the Town of Pickering. The lands are generally described as those portions of Part 1, 40R-12094 not required for the development of proposed Highway 407, Westney Road By-pass, and interchange. BASIS: The amendment has been determined to be appropriate as it will provide for the establishment of an essential community facility within the Town of Pickering that is compatible with surrounding uses. ACTUAL The Town of Picketing District PIan is hereby amended by: AMENDMENT: 1. Adding a new subsection 2., to section 5G Rural, as follows: 5G2. Cemeteries In addition to agricultural and natural open space uses, a new cemetery and related uses including an office, chapel, crematorium, mausoleum, columbarium, and maintenance yard shall be permitted on Highway 7 east of Westney Road on lands identified as those portions of Part 1, 40R-12094 that are not required for the development of Highway 407, Westney Road By-pass and interchange. The new cemetery and related uses shall be subject to zoning, site plan control and performance standards in order to ensure compatibility with the adjacent rural land uses, and visual aesthetics. IMPLEMENTATION: The provisions set forth in the Town of Picketing District Plan, as amended, regarding the implementation of the Plan shall apply in regard to this Amendment. INTERPRETATION: The provisions set forth in the Town of Picketing District Plan, as amended, regarding the interpretation of the Plan shall apply in regard to this Amendment.
