HomeMy WebLinkAboutBy-law 4659/95 THE CORPORATION OF THE TOWN OF PICKERINO BY-LAW NO. 4659/95 Being a by-law to authorize the sale of surplus municipal lands being part of Lot 19, Range 3, Broken Front Concession, Pickering, designated as Part 1, Plan 40R- 15930, in accordance with By-Law 4592/95 and to authorize the acquisition of a sewer easement over such lands. WHEREAS, The Town of Picketing on April 3, 1995 passed By-Law 4592/95 to establish procedures to regulate the sale of Municipal Real Property pursuant to section 193(2) of the Municipal Act, R.S.O. 1990 c.M.45, as amended; AND WHEREAS by By-Law 4641/95, the Council of The Corporation of the Town of Picketing declared the lands being part of Lot 19, Range 3, Broken Front Concession, Pickering, designated as Parts 1, 2, 3, 4, and 5, Plan 40R-15930 as surplus to the needs of the Municipality; AND WHEREAS The Corporation of the Town of Pickering desires to sell part of the surplus lands to the owner of the abutting lands; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. Those lands lying and being in the Town of Pickering, in the Regional Municipality of Durham legally described as part of Lot 19, Range 3, Broken Front Concession, Pickering, and being more particularly set out as Part 1, Plan 40R-15930 shall be sold to the owner of the abutting lands legally described as part of Lot 19, Range 3, Broken Front Concession, Pickering, designated as Part 1, Plan 40R~507 for the sum of $27,000.00 in accordance with By-Law 4592/95. 2. The sale of the lands described as part of Lot 19, Range 3, Broken Front Concession, Pickering, designated as Part 1, Plan 40R-15930 shall be conditional upon the Purchaser agreeing to immediately convey to the Town an easement for sewer purposes to The Corporation of the Town of Picketing in a form acceptable to the Town Solicitor. The easement shall be conveyed immediately following the closing of the sale transaction and prior to the registration of any encumbrances on the lands.
