HomeMy WebLinkAboutBy-law 4966/97 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 4966/9'7 Being a by-law to establish the sale price of those parts of the Road Allowance between Lots 14 and 15, Concession 7, Pickering, designated as Parts 1, 2 and 3, Plan 4OR- 17428. WHEREAS, pursuant to sections 191(1), 297(1)(c), 297(1)(d) and 315 of the Municipal Act, R.S.O. 1990, chapter M.45, the Council of the Corporation of the Town of Pickering may pass by-laws to stop- up a highway or part thereof and to authorize its sale or the sale of a part thereof at a fixed price. AND WHEREAS, on February 3, 1997, Council enacted By-law 4918/97 for the purposes of stopping up, closing up and authorizing for sale to the abutting owners, those parts of the Road Allowance between Lots 14 and 15, Concession 7, Pickering, being Parts 1, 2 and 3, Plan 40R-17428; AND WHEREAS, Council wishes to establish the sale price of the lands to be sold to the abutting owners pursuant to section 315(2) of the Municipal Act, R.S.O. 1990, chapter M.45; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. That part of the Road Allowance between Lots 14 and 15, Concession 7, Pickering, designated as Parts 1, 2 and 3, Plan 40R-17428, shall be offered for sale to the abutting owner at a sale price of $2,000 per acre, subject to any utility easement or easements previously granted or granted pursuant to section 2 of By-law 4918/97. 2. That in the event that the owner(s) of the lands abutting Part 3, Plan 40R-17428 decline to accept the Town's offer to sell, then the lands designated as Part 3, Plan 40R-17428 shall be offered for sale to the owner of the lands abutting Part 2, Plan 40R-17428 at the sale price of $2,000 per acre.
