HomeMy WebLinkAboutBy-law 4960/97 THE CORPORATION OF THE TOWN OF PICKERING By-LAW NO, 4960/97 Being a by-law to amend By-law 3854/91, amended November 1, 1993 by By-law 4338/93, respecting the payment of Development Charges. WHEREAS By-law 3854/91 being a by-law to establish development charges for the Town of Pickering was passed by The Corporation of the Town of Picketing and came into fome and effect on October 7, 1991; AND WHEREAS By-law 3854/91 was amended by By-Law 4338/93; AND WHEREAS the Council of The Corporation of the Town of Picketing has given Notice in accordance with section 4 of the Development Charges Act, R.S.O. 1990, chapter D.9, of its intention to pass a by-law under section 7 thereof to amend By-law 3854/91 as amended by By-Law 4338/93, and has heard all persons who applied to be heard whether in objection thereto or in support thereof; AND WHEREAS, the Land Use Planning and Protection Act amends Section 7 of the Development Charges Act by adding the following subsections: "(1.1) An amendment to a development charge does not come into force until it is approved by the Minister of Municipal Affairs and Housing; (1.2) Despite subsection (1.1) the approval of the Minister of Municipal Affairs and Housing is not required for an amendment for the sole purpose of, b) reducing the amount of the charge." NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. Section 8(d) of By-law 3854/91 is hereby deleted and replaced with the following: "non-residential" means - designed, adapted or used for any purpose other than: (i) a dwelling or dwellings; and (ii) buildings or structures used, or designed or intended for use for the purpose of animal husbandry, agriculture, dairying, fallow, field crops, removal of sod, forestry, fruit farming, horticulture, market gardening, pasturage, poultry keeping and any other activities customarily carried on in the field or agriculture and having an electrical service of less than 30 amperes at a voltage not exceeding 240/120 volt. 2. This by-law shall be deemed to come into force on the 24th day of March, 1997. BY-LAW read a first, second and third time and finally passed this 24th day of March, 1997. r,, ~,.: .~ /,, .
