That the works and services required by the Subdivision Agreement within Blocks 142 and 143, Plan 40M-2437 and Part 2, 40R-26589, which are constructed, installed or located on lands dedicated to, or owned by the City, or on lands lying immediately adjacent thereto, including lands that are subject to easements transferred to the City, be accepted and assumed for maintenance; 2. That Mattamy (Brock Road) Limited be released from the provisions of the Subdivision Agreement and any amendments thereto relating to Blocks 142 and 143, Plan 40M-2437 and Part 2, 40R-26589; and 3. That the appropriate City of Pickering officials be authorized to take the necessary actions as indicated in this report. Executive Summary: The City entered into a Subdivision Agreement with the above -noted developer for the development of the lands within Plan 40M-2437. Plan 40M-2437 was partially assumed by the City on March 29, 2016, save and except for Blocks 142 and 143, Plan 40M-2437 and Part 2, 40R-26589. As all works and services within Blocks 142 and 143, Plan 40M-2437 and Part 2, 40R-26589 have now been completed to the satisfaction of City staff, it is appropriate to finalize the assumption of the plan of subdivision. Financial Implications: Not Applicable Discussion: The City entered into a Subdivision Agreement with the above -noted developer for the development of the lands within Plan 40M-2437. Plan 40M-2437 was partially assumed by the City on March 29, 2016, save and except for Blocks 142 and 143, Plan 40M-2437 and Part 2, 40R-26589. As the developer has now completed all of the works and services within these lands to the satisfaction of City staff, it is appropriate to: (a) assume the works and services within Blocks 142 and 143, Plan 40M-2437 and Part 2, 40R-26589; and (b) release Mattamy (Brock Road) Limited from the provisions of the Subdivision Agreement with the City and any amendments related thereto with respect to those lands.
