PRESENT: C. W. Laycox. in the Chair Mrs. J. L. McPherson Harvey Spang W. G. Newman Donald Waring John Campbell Hubert Wank L. T. Johnston. Clerk The following CORRESPONDENCE was considered. l. Twenty-nine Ratepayers of the Hamlet of Green Rive~ petition Council for street lights. See Resolution No. 28676~. 2. As it has been difficult to get a man to replace bulbs in the Whitevale Street Lights. Clerk asked if H.E.P.C. would do work. They agree for $35.50 per year to keep 13 lights in order. See Resolution No. 287/64. 3. Engineer asks Council's direction about paving Old Orchard Road. See Resolution No. 270/6~. ~. Boy Scouts ask permission to sell applies on Boy Scout Apple Ðay. See Resolution No. 288/6~. 5. Pickerin& Township Game Committee recommends to Council that "No Discharge of F~re Arms" area be extended east to 100 yards east of Sandy Beach Road (Lot 20-21) and running from the lake north to the ~Ol Highway and that a~l this area be signed. Also that maps of entire prohibited area be printed. See Resolution No. 271/64. 6. One Tender for a culvert on sideline between Lots 20-21, Concession è. (Engineer asked that work be re-tendered). 7. Kenneth Pascoe submitted an estimated cost of weatherproofing John Faulkner's office of $173.75. See Resolution No. 269/64. The following PERSONS. on MO~ION, were heard: 1. Mr.strong, of Craig, Zeidler and S~ng. thanked Council for his firm being appointed Architects for the new Municipal Building. and offered full co-operation. 2. A delegation from McIntosh Plan in West Rouge: (a) Mr. Jessop objected to length of time small children were away from home to attend school by bus. Reeve Laycox reported a new schedule would start this week when children would be picked up at 8:50 a.m. and returned at 3:40 p. m. (b) Messrs. Hart and Delaney objected to roads in this subdivision and the fact that after three years they are amost impassable when the subdivision agreement called for paved roads. Reeve Laycox assured them that he expected such roads to be completed this year under the new agreement. 3. J. W. Cairns, a representative of the Bay Ridges Ratepayers' Association objected to the Township selling three walkways and asked for parking on one side of all streets in Bay Ridges except near schools and parks. It was agreed that Road Committee meet with members of the Association September 29th. 8 p. m.. at School. 4. Wm. Beddall spoke for the three Township resident Architects Messrs. Rankin. Saccoccio and himself. stating that they were - 2 - 4. prepared to join together and act as Architects for the Municipal Building. Reeve Laycox stated that another firm had been given the appointment and Council was not prepared to make a change. Mr. Beddall presented to the Reeve his resignation from the Industrial Committee which was turned over to the Industrial Committee, 5, Mr. Hollier. Solicitor for Mr. Barnes, owner of Open Gate Nursing Home. stated he had appealed the decision of the Committee of Adjustment re change of zoning to permit a hospital at corner of Island Road and East Avenue to the Ontario Municipal Board, so asked Council not to pass on the application to the Ontario Municipal Board. Council passed the Resolution (No. 280/64) with amendment. /: 6. Mr. Milton Mowbra~ stated a group had purchased the Kinsale School to be used as a Community Centre for the sum of $1500.00. They have raised $1125.00. and asked Council to advance them $375.00, being the expected government grant and to pass a By-Law under the Community Centres Act so they could get yearly government grants. See Resolution No. 284/64 and By-Law No. 29l7. 7. Donald Gibson again asked for a portion of the Centennial grants for the Township of Pickering Museum. See Resolution No. 29l/64. 8. James McKean a.ked tHà~ Township contact proper authorities to have the gap at Frenchman's Bay deepened. See Resolution No. 285/64. RESOLUTION NUMBER 269/6~ MOVED by Mr. Wank. seconded by Mr. Spang, that this Council approve the estimate of K. C. Pascoe to repair Mr. J. H. Faulkner's office at the price of $173.75. CARRIED RESOLUTION NUMBER 270/64 MOVED by Mr. Newman. seconded by Mr. Waring, that Old Orchard Road be paved by the Road Department in accordance with approved road programme. CARRIED RESOLUTION NUMBER 271/64 MOVED by Mr. Wank. seconded by Mrs. McPherson, that the recommendation of the Game Committee that there be "No discharge of fire arms" in lots, west 300' of 20 and all 21 south of Highway 401, be approved and a By-Law of confirmation be prepared along with maps of the Township setting out the restricted area. CARRIED RESOLUTION NUMBER 272/64 MOVED by Mr. Wank, seconded by Mr. Spang. that this Council does hereby endorse the recommendation of the Planning Board on September lO, 1964 and directs that By-law Number 2790 be amended by adding thereto Sections 7.4 and 8.4 as follows: VEHICLE PARKING No person shall, in any Residential Zone, use any lot, building or structure for the parking or storage of any trailer which exceeds eighteen (18) feet in length, any commercial vehicle or more than three (3) privately owned motor vehicles except that: a) the owner or occupant of such lot, building or structure may personally use any enclosed building or structure which is accessory to the main building or structure erected on such lot for the housing or storage of one commercial vehicle or trailer; (for the purpose of this Section, a station wagon or one-half (1/2) ton truck shall not be deemed to be a commercial vehicle); b) the temporary parking of such commercial vehicle for the purpose of delivering to or servicing the premises. - 3 - c) no person shall use any part or any yard required by this by-law, except a rear yard for the temporary parking or storage of vehicles, or trailers. No person shall use any such permitted parked trailer for residential purposes while so parked, notwith- standing that such trailer is jacked up or that it's running gear is removed. And also directs that By-law 2790 be amended by adding thereto in Section 2. new Section 2.60.l as follows: 2.60.1 TRAILER Trailer shall mean any vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry. another motor vehicle or any device or apparatus not designed to transport persons or property. temporarily drawn. propelled, or moved upon such highway, and except a side car attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn. and that such restriction be applicable under this resolution until incorporated in a general amending by-law. CARRIED RESOLUTION NUMBER 273/64 MOVEDby Mr. Waring. seconded by Mr. Wank, that this Council does hereby endorse the recommendation of the Planning Board on September 10, 1964 and directs that By-Law No. 2520 be amended by deleting thererorm Section 6.6 and adding thereto new Section 6.6 as follows: VEHICLE PARKING No person shall, in any Residential Zone, use any lot. building or structure for the parking or storage or any trailer which exceeds eighteen (lS) feet in length, any commercial vehicle or more than three (3) privately owned motor vehicles except that: a) the owner or occupant of such lot. building or structure may personally use any enclosed building or structure which is accessory to the main building or structure erected on such lot for the housing or storage of one commercial vehicle or trailer; (for the purpose of this Section. a station wagon or one-half (1/2) ton truck shall not be deemed to be a commercial vehicle); b) the temporary parking of such commercial vehicle for the purpose of delivering to or servicing the premises; c) no person shall use any part of any yard required by this by-law, except a rear yard for the temporary parking or storage of vehicles or trailers. CARRIED RESOLUTION NUMBER 27~/64 MOVED by Mr. Campbell, seconded by Mr. Waring. that this Council does hereby endorse the recommendation of the Planning Board on September 10, 1964 and directs that By-law Number 1978 be amended , by adding thereto Section 6.1.13 a~ follows: VEHICLE PARKING No person shall. in any Residential Zone, use any lot, building or structure for the parking or storage of any trailer which exceeds eighteen (l8) feet in length, any commercial vehicle or more than three (3) privately owned motor vehicles except that: a) the owner or occupant of such lot, building or structure may personally use any enclosed building or structure which is accessory to the main building or structure erected on such lot for the housing or storage of one commercial vehicle or trailer; (for the purpose of this Section. a station wagon or one-half (1/2) ton truck shall not be deemed to be a commercial vehicle): b) the temporary parking of such commercial vehicle for the purpose of delivering to or servicing the premises; c) no person shall use any part of any yard required by this by-law, except a rear yard for the temporary parking or storage of vehicles or trailers. No person shall use any such permitted parked trailer for residential purposes while so parked, notwithstanding that such trailer is jacked up or that its running gear is removed. And also directs that By-law Number 1978 be amended by adding thereto in Section 5, new Section 5.31.1 as follows: TRAILER. Trailer shall mean any vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily drawn, propelled or moved upon such highway, and except a side car attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn. and that Council does hereby direct that an amending by-law be prepared incorporating the above restrictions, but that such restrictions be applicable under this resolution until incorporated in said by-law. CARRIED RESOLUTION NUMBER 276/6~ MOVED by Mr. Wank, seconded by Mrs. McPherson, that tbis Council does hereby endorse the recommendation of the Planning Board on September 10. 1964, and directs that By-law Number 2511 be amended by deleting therefrom Section 6.7 and adding thereto new Section 6.7 as follows: VEHICLE PARKING No person shall. in any Residential Zone, use any lot, ~uilding Qr structure for the parking or storage of any trailer which exceeds eighteen (18) feet in length, any commercial vehicle or more than three (3) privately owned motor vehicles except that: a) the owner or occupant of such lot, building or structure may personally USe any enclosed building or structure which is accessory to the main building or structure erected on such lot for the housing or storage of one commercial vehicle or trailer; (for the purpose of this Section. a station wagon or one-half (l/2) ton truck shall not be deemed to be a commercial vehicle); b) the temporary parking of such commercial vehicle for the purpose of delivering to or servicing the premises; c) no person shall use any part of any yard required by this by-law, except a rear yard for the temporary parking or storage of vehicles. No person shall use any such permitted parked trailer for residential purposes while so parked, notwithstanding that such trailer is jacked up or that its running gear is removed. And also directs that By-law Number 25ll be amended by adding thereto in Section 2, new Section 2.75.l as follows: TRAILER. CAR~,IED - 6 - RESOLUTION NUMBER 277/64 MOVED by Mr. Newman, seconded by Mr. Campbell. that this Council make application to the Ontario Municipal Board for approval of consent, as recoMmended by the Township of Pickering Planning Board on September lO, 1964, for John Gordon Dunbar to convey to Elmer Annis. John Denney, Dave Lennox, Harold Mitchell. Frank White as trustees for Dunbarton United Church. 0.295 acres from a 3.11 acre hOlding on the north side of Highway # 2 for church purposes and being part of Lot 25. Concession 1. CARRIED RESOLUTION NUMBER 278/64 MOVED by Mr. Waring. seconded by Mr. Campbell, that this Cøuncil does hereby endorse the recommendation of the Township of Pickering Planning Board of September 10. 1964, and hereby authorizés the iss- uance of a Letter of Tolerance that no action will be taken by the Township of Pickering for reasons of variance from Zoning By-Law No, 2572. on property known as Lot 98, Plan 377. to permit Whitehall Plumbing and Heating to construct an addition to the north-west corner of the existing building and to provide a front yard setback of approximately 19.73 feet being in line with the existing building; whereas Section ll.2.2 requires a minimum front yard setback of 40 feet. subject to: l) that the subject addition be located no nearer the street line than the existing building; 2) the provision of adequate access to the rear of thé property; 3) the compliance with all other Township requirement~. CARRIED RESOLUTION NUMBER 279/64 MCVED by Mr. Spang, seconded by Mr. Newman. that this Council does her~by endorse the recommendation of the Planning Board on Thursday September 10, 1964, and directs that By-law No. 2511 be amended in Section 7 by specific exemption to permit the operation of a Public Hospital as defined by Section 2.62 and that the necessary amending by-law be prepared accordingly. CARRIED RESOLUTION NUMBER 280/64 MOVED by Mr. Wank. seconded by Mr. Campbell, that this Council make application to the Ontario Municipal Board for approval of consent, as recommended by the Township of Pickering Planning Board on September 10, 196~, for: Four-O-One Motor Hotel Limited to convey to Quasar Limited an 'L' shaped parcel of approximately 3 1/2 acres and having 212 foot frontage from a total frontage of 737 feet, being part of Lot 35, Range 3, subject to the approval of Committee of Adjustment recommendation by Ontario Municipal Board. ABSENT: Mr. Newman RESOLUTION NUMBER 282/64 MOVED by Mr. Wank, seconded by Mr. Campbell, that the Clerk write the appropriate individuals concerning the status of following data: (a) Agreement concerning Dunbarton High School Water Extension. - 7 - (b) By-law covering Forced Local Improvement on Chesterhill Road, Industrial Area. (c) Termination of Chesterhill and Rouge Highland Subdivision agreements and advise our Solicitors that item (b) and (c) are very old matters. RESOLUTION NUMBER 284/64 MOVED by Mr. Newman. seconded by Mrs. McPherson. that the Council of the Corporation of the Township of Pickering pass a By-Law desig- nating the Kinsale School as a Community Centre, to be called North- East Community Centre, under the Community Centres Act. and that the Council advance the grant money as soon as by-law approved. subject to provincial approval of grant. CARRIED RESOLUTION NUMBER 2B5/6~ MOVED by Mr. Campbell, seconded by Mr. Waring. that the Council of the Township of Pickering request the Federal Department of Public Works to dredge out the gap at Frenchman's Bay. and that a copy of this resolution be sent to the appropriate authority. CARRIED RESOLUTION NUMBER 288/64 MOVED by Mr. Newman, seconded by Mr. Waring. that this Council grant permission to the Boy Scouts to sell apples in Shopping Plazas on Friday, October 23. 1964, and canvass the Township on Saturday, October 24, 196~. CARRIED RESOLUTION NUMBER 2B9/6~ MOVED by Mr. Wank, seconded by Mr. Newman, that the Clerk advise the developer of Rougedale Acres that the Township will not issue any additional building permits until such time as the roads ~~e brougQt up to Township standard. CARRIED RESOLUTION NUMBER 290/6~ MOVED by Mr. Wank. seconded by Mrs. McPherson, that the sole tender by Mel-Ron Construction for a cement culvert at $~.908.25 be accepted conditional on the report of the Township Engineer and Department of Highways approval. CARRIED RESOLUTION NUMBER 29l/6~ MOVED by Mr. Newman. seconded by Mr. Spang, that the Centennial Grant of $44,000.00 which is given to commemorate Confederation and which is to be used for that purpose and since the Pickering Township Museum Board has presented plans to extend the present facilities to commemorate Confederation. BE IT THEREFORE RESOLVED that a sum of $20.000.00 be given to the Pickering Township Museum Board to carry out their project since this project will not cost the municipality of Pickering any cash outlay and if the Municipality does not use the rest of the grant, that the additional monies be turned over to the Pickering Township Museum Board in order that the proposed project may be completed. CARRIED MOVED by Mr. Campbell, seconded by Mr. Newman, that the Council recommend tQ the Architect retained for the Municipal Building. that it is Council's wish that the five acres owned by the Township at Liverpool Road and No. 2 Highway be used for the Township Municipal Building. Mr. Newman seconded by Mrs. McPherson. moves that By-Law No. 2917 to establish a Community Centre at Kinsale. be now read a second time. and that Council go into Committee of the Whole thereon.
