That the City of Pickering amend the Discharge of Firearms By-law 247/75 by replacing the existing Schedule "A" map with the Schedule "A" map attached to this report. (Attachment No. 2) 2. That the Director, Corporate Services and City Solicitor and the Director of City Development be directed to review the Schedule "A" map on a bi-annual basis and to make recommendations regarding expansions of the prohibited area as are appropriate to adjust for ongoing residential development. 3. That the appropriate City of Pickering officials be authorized to take the necessary actions as indicated in this report. Executive Summary: Due to the impending development of the Seaton lands, and the expansion of populated areas within the City, the Discharge of Firearms By-law requires updating to ensure the safety of residents by prohibiting the use of firearms in all populated areas. Adoption of the Recommendations in this report will expand the area in which the discharge of firearms is prohibited so as to include new areas of residential development. Discussion: The purpose of the City of Pickering's Discharge of Firearms By-law is to prohibit the discharge of any gun, firearm, air gun or spring gun or any class or type thereof in populated areas to protect the safety of residents. Schedule "A" of the by-law outlines the areas where the discharge of Firearms is prohibited under all circumstances. As the current Schedule "A" was adopted on January 21, 1991, it does not reflect the increase in populated areas of the City which have expanded as a result of residential development. Attachment No. 1 shows the additional lands added to the prohibited area on Schedule "A". The amended Schedule "A" reflects the current and imminent development occurring on the Seaton Lands within the City of Pickering, and prohibits the discharge of firearms in this area. Council has also requested that as development continues in the City, the Discharge of Firearms By-law and the associated schedule be reviewed by staff on a regular basis to determine if further expansion of the Schedule "A" prohibited area is appropriate. Staff will be tasked with this review BYL 01-17 June 5, 2017 Subject: Discharge of Firearms By-law Schedule "A" Page 2 on a bi-annual basis, based on consultation with City Development regarding development applications. Should amendments to Schedule "A" be required, the Director, Corporate Services and City Solicitor shall make a recommendation and prepare a replacement Schedule "A" for approval by Council. The Corporation of the City of Pickering By-law No. xx/17 Being a By-law to amend Schedule A of By-law 247/75 regulating the discharge of firearms within the City of Pickering Whereas the purpose of the City of Pickering's Discharge of Firearms By-law is to prohibit the discharge of any gun, firearm, airgun or spring gun or any class or type thereof in populated areas; Whereas the City's populated areas are identified in Schedule "A" of the existing Discharge of Firearms By-law as of January 21, 1991; Whereas the populated areas of the City have expanded as a result of residential development that has occurred subsequent to the passage of the Discharge of Firearms By-law, as shown on the map attached to this motion; Whereas the City of Pickering wishes to ensure the safety of residents by prohibiting the use of firearms in all populated areas; and Whereas the Discharge of Firearms By-law should be updated accordingly, Now therefore the Council of The Corporation of the City of Pickering hereby enacts as follows: 1) Schedule A of By-law 247/75, as amended, is hereby deleted and replaced with Schedule A attached hereto as Attachment No. 2.
