(II) Other Business (III) Adjournment (';',1 Report to Planning & Development Committee PICKERING Report Number: PLN 22-14 Date: December 8, 2014 • From: Thomas Melymuk Director, City Development Subject: Proposed Telecommunication Tower Bell Mobility 2315—2345 Liverpool Road • (Manresa Jesuit Spiritual Retreat Centre) • Installation #48 Recommendation: 1. That Bell Mobility be advised that City Council does not object to the revised proposal for a 35.0 metre high telecommunication tower installation to be located at 2315 —2345 Liverpool Road, based on the design and other details submitted with the revised application. Executive Summary: Bell Mobility has submitted a revised proposal to construct a 35.0 metre high telecommunication tower disguised as a tree on the Manresa Spiritual Jesuit Retreat Centre lands located at 2315 —2345 Liverpool Road. Bell Mobility has completed their public consultation process in accordance with the City's Radiocommunication and Broadcasting Antenna System Protocol (Cell Tower Protocol). The notification radius was expanded beyond the required minimum radius to include additional properties along Abbey Road, Rigby Drive, Madonna Court and Halsey Lane. The applicant has advised that no formal public comments have been received and are requesting that City Council provide a statement of concurrence in support of the installation. City staff are supportive of the proposed installation. The proposed tower will have minimal visual impact on the community, minimizes disruption to natural features, is not located in proximity to incompatible or sensitive land uses, and is located with appropriate setbacks and screened from Liverpool Road. Staff recommends that Bell Mobility be advised that Council does not object to the proposed telecommunication tower to be located at 2315—2345 Liverpool Road, based on the design and other details submitted with the revised application. Financial Implications: No direct costs to the City are anticipated as a result of the proposed development. 1 Report PLN 22-14 December 8, 2014 Subject: Proposed Telecommunication Tower Installation Page 2 Background 1.1 Property Description The subject property is located at the north limit of Liverpool Road within the Liverpool Neighbourhood. The lands are owned by the Jesuit Fathers of Upper Canada and is currently used as a spiritual retreat facility. The proposed telecommunication tower will be located at the northeast portion of the property (see Location Map, Attachment#1). The subject property is designated as "Urban Residential — Low Density Areas" in the City's Official Plan, and zoned '1(R)' — Religious Retreat Facility by Zoning By-law 3036, as amended by By-law 3456/90. The installation of a telecommunication tower is permitted under the public utilities exemption in Zoning By-law 3036. 1.2 Applicant's Original Proposal In July 2012, Bell Mobility submitted an application to the City Development Department to construct a 45.0 metre high monopole telecommunication tower on the Manresa Jesuit Spiritual Retreat property. Staff, in consultation with the Ward 2 Councillors, requested that Bell Mobility expand the proposed notification area to ensure adequate notice was provided to the community. This request was not supported by the applicant, and the applicant circulated the proposal in accordance with Industry Canada's protocol. As a result, only two neighbouring properties (Hydro One and Toronto and Region Conservation Authority) received mail notification. A newspaper ad was also placed in the Pickering News Advertiser. • In response to this public notification process, the applicant received two verbal comments and two written letters from area residents indicating their objection to the proposed telecommunication tower. The objections were based on concerns with potential health effects and the visual impact of the proposed tower. At the completion of the public consultation, City staff and the Ward Councillors maintained their concern with the limited notification given for the original proposal, and repeated the request to expand the notification area. 1.3 Applicant's Revised Proposal Following discussions with City staff and the Ward Councillors in July 2014, Bell Mobility revised their proposal to reduce the height of the tower to 35.0 metres and amend the design to disguise the tower as a tree. The location of the proposed tower was not changed. The tower and ground cabinet will be located in a fenced compound area measuring approximately 6.0 metres by 10.0 metres. Access to the compound is proposed by extending the existing internal gravel driveway at the north limit of the site (see Submitted Plan, Submitted Elevation and Compound Plan, and Photographic Simulation, Attachments #2, #3 and #4). 2 Report PLN 22-14 December 8, 2014 Subject: Proposed Telecommunication Tower Installation Page 3 2. Comments Received 2.1 Expanded Public Notification of the revised proposal has been completed In support of the revised proposal, Bell Mobility expanded the public notification at the City's request, beyond Industry Canada's minimum required radius, to include residents along Abbey Road, Rigby Drive, Madonna Court and Halsey Lane. A total of 117 property owners and agencies were notified by mail. The applicant has confirmed that no public comments were received as a result of the notification for the revised proposal (see Applicant's Public Consultation Summary Report, Attachment#5). The applicant has confirmed that the public consultation process has been completed in accordance with the City's Radiocommunication and Broadcasting Antenna Systems Protocol (Cell Tower Protocol). 2.2 City Departments &Agency Comments Engineering & Public Works • no objections to the proposed tower Toronto and Region • no objections to the proposal Conservation Authority V 3. Planning Analysis 3.1. The proposed telecommunication tower may accommodate co-location of an additional carrier The applicant has confirmed that there are no existing cell towers in the immediate area that would be potential candidates for co-location.with Bell Mobility. Hydro One no longer permits the location of cell tower equipment on their towers due to liability concerns about site installation and maintenance. The proposed tower is designed as a co-location site that may accommodate an additional carrier, subject to structural review as the tree design is subject to wind shear and ice loading from the branches. However, the applicant has advised that co-location on this tower may detract from the disguise of this tower. 3.2 The proposed tower location and design is acceptable The proposed 35.0 metre high tower has been designed to look like a tree. The antennas are hidden behind the branches to blend in with the existing natural vegetation as much as possible, to minimize the visual appearance of the tower. 3 Report PLN 22-14 December 8, 2014 Subject: Proposed Telecommunication Tower Installation Page 4 • The site where the tower and compound area is to be located is within an open area surrounded by existing trees and does not require the removal of any mature trees. The proposed equipment shelter is a metal clad building surrounded by a security fence and screened by existing trees surrounding the compound. The proposed tower will not affect the current use of the property and will have minimal impact on the surrounding community. The proposal has been circulated and reviewed in accordance with the City's Cell Tower Protocol, and is now before Council for consideration. Staff recommend that City Council approve the recommendation in this report as the proposed installation has minimal visual impacts, minimizes disruption to natural features, is not located in proximity to incompatible or sensitive land uses, and is located with appropriate setbacks and screening from the surrounding neighbourhood. . Liverpool Road has concluded. Throughout the commenting period starting July 29, 2014 and ending August 18,2014,zero comments from the public were received. We believe that Bell Mobility has demonstrated that the proposed wireless telecommunication facility meets the language and intent of Industry Canada's guideline document CPC 2-0-03. In terms of our circulation to the City,we feel that all technical concerns and requirements received through and after the circulation have been addressed and no outstanding issues remain. We feel that our proposal does not impede on the use and enjoyment of surrounding land uses. Introduction • 10 • ATTACHMENT# 5 TO REPORT#' P2/4122- The following report is a summary of the most recent public circulation undertaken by Bell Mobility Inc. regarding a proposed 35.0-metre Monopine(tree-style)telecommunication tower at 2325 Liverpool Road. Since this time,a public circulation and consultation has been undertaken in accordance with the City of Pickering's established telecommunication tower facility policy document. Public Notification The public was notified of the proposed tower in accordance with the City's Consultation Process and Industry Canada's CPC 2-0-03.Accordingly,residents and property owners within an expanded radius were sent an information brochure via regular mail(Appendix A)that arrived on or before July 29,2014. A total of 117 property owners/agencies were contacted(Appendix B). Conclusion As the public comment period has expired and that the public has not voiced objection to this installation,Bell Mobility is formally requesting that the City of Pickering formally acknowledge this report as the conclusion of consultation procedures for this telecommunication tower and issue a letter of concurrence. Executive Summary: The subject property is located on the east side of Woodview Avenue, south of Finch Avenue (see Location Map, Attachment#1).. Based on comments received by area residents following the Statutory Public Information meeting, the applicants have revised their initial proposal from 3 lots for detached dwellings to 2 lots with a minimum lot frontage of 18.0 metres (see Applicants' Revised Submitted Plan, Attachment#3). The remaining undevelopable lands will be conveyed to the Toronto and Region Conservation Authority (TRCA). The creation of the parcels will be through the Region of Durham Land Division Committee. • The recommended Zoning By-law Amendment will replace the current agricultural zone on the subject property with appropriate residential and open space zone categories. The by-law will include specific performance standards to ensure the proposed lotting pattern, building setbacks, and the architectural design of the dwellings will be in keeping with the established pattern of development on the east side of Woodview Avenue. Background 1.1 Property Description The subject property is located on the east side of Woodview Avenue, south of Finch Avenue within the Rouge Park Neighbourhood (see Location Map, Attachment#1). The property has a total land area of approximately one hectare, with approximately 85 metres of frontage along Woodview Avenue. The property supports a single-storey detached dwelling, which will be demolished to facilitate the proposed,development. On the east side of Woodview Avenue immediately north of the subject lands are newer single detached dwellings, whereas on the west side of Woodview Avenue are older dwellings on large lots. An environmentally significant wetland, known as the Townline Provincially Significant Wetland Complex, exists to the east, south and on portions of the subject property (see Applicants' Original Plan, Attachment#2). 1.2 Applicants' Proposal The applicants initially requested to rezone the northwestern quadrant of the subject property to an appropriate residential zone category to facilitate the creation of three lots for detached dwellings with a minimum lot frontage of 12.0 metres and a minimum lot area of 300 square metres (see Applicants' Original Plan, Attachment#2). Based on comments received by area residents, the applicants revised the proposal to create two lots with a minimum lot frontage of 18.0 metres and a minimum lot area of 530 square metres (see Applicants' Revised Submitted Plan, Attachment#3). The undevelopable lands associated with the wetland complex on the property and its buffer areas will be conveyed to the Toronto and Region Conservation Authority (TRCA). Should Council approve this application, the applicants intend to create the parcels through the Region of Durham Land Division Committee. 2. Comments Received • 2.1 At the April 7, 2014 Public Information Meeting and in written submission At the April 7, 2014 Public Information Meeting, one area resident raised a concern that the density may be too much for the neighbourhood and questioned whether the proposed dwelling elevations would be in keeping with the neighbourhood character. On July 17, 2014, the City Development Department received a petition signed by 20 area residents. The petition highlighted concerns with the total number of lots with minimum lot frontages of 12.0 metres, and their compatibility with other residential properties along Woodview Avenue. 32 Report PLN 23-14 December 8, 2014 Subject: G. Planning Analysis 3.1 The revised proposal conforms to the Pickering Official Plan and the Rouge Park Neighbourhood The Pickering Official Plan designates the majority of the subject property as "Open Space System - Natural Areas," whereas the northwest portion of the property is designated as "Urban Residential - Low Density Areas" within the Rouge Park Neighbourhood. Lands designated as "Low Density Areas" are intended to be used for housing purposes permitting residential densities up to and including 30 units per net hectare. The Official Plan also states that City Council shall encourage infill development of vacant or underutilized blocks of land and the provision of • compact housing form, having regard to housing type, architectural design and cost-effective development standards. The proposal will result in a net residential density of approximately 18 units per net hectare, which falls within the permitted density range. Existing lots consisting of detached dwellings along the east side of Woodview Avenue north of the subject lands have a variety of lot frontages ranging from 15.0 metres to 20.0 metres-with a maximum building height of 9.0 metres (see Existing Frontage Map, Attachment#4). The applicants' revised proposal for two lots for detached dwellings with minimum lot frontages of 18.0 metres is consistent with the existing lotting pattern along the east side of Woodview Avenue. Based on conceptual building elevations, the applicants are proposing a maximum building height of 9.0 metres, which will be reflected in the implementing by-law (see Proposed Conceptual Siting Plan and Proposed Conceptual Front Elevations, Attachments #5 and #6). The applicants' revised concept will result in an appropriate lotting pattern and built form, which is compatible with the adjacent properties immediately to the north and the surrounding area. 3.2 The proposed open space lands to be conveyed to TRCA The Rouge Park Neighbourhood Environmental Master Servicing Plan (EMSP) is a companion document to the Rouge Park Neighbourhood Development Guidelines which has been endorsed by City Council. The EMSP requires the preparation of an environmental report to support development proposals within its boundaries. The applicants,have submitted a Scoped Environmental Impact Statement (EIS), prepared by Azimuth Environmental Consulting Inc. to support this application. The EIS concluded that the proposed developable area is located outside of the Townline Provincially Significant Wetland Complex and that no impacts are expected to occur to the existing ecological features or functions associated with the complex. TRCA has reviewed the EIS and is generally satisfied with its findings provided that the wetland complex lands are conveyed into their ownership to ensure their future protection. 34 Report PLN 23-14 December 8, 2014 Subject: G. Barbieri (A 2/14) Page 5 The conveyance of the environmentally sensitive lands to TRCA is consistent with the policies of the Pickering Official Plan policies for the Rouge Park Neighbourhood. 3.3 Sustainability Implications The proposed development will allow for the transfer of environmentally sensitive lands to TRCA for future protection and will utilize existing services along Woodview Avenue. However, staff's review of the application against the City's Draft Sustainable Development Guidelines resulted in a score below the Level 1 standard. Given the small scope of the proposal, there is limited opportunity to achieve Level 1. Future opportunities exist for the application to implement additional sustainable options through the building permit processes. 3.4 Development matters related to the City will be addressed through conditions of Land Division If Council approves this rezoning application to facilitate the future creation of two residential lots, the City will have the opportunity to provide comments and recommend conditions of severance to the Region of Durham Land Division Committee to address development/technical matters such as, but not limited to: • providing the Region of Durham with a clearance letter from the Ministry of Tourism, Culture and Sport to the Region of Durham in support of the applicants' submitted Stage 1-2 Archaeological Assessment prior to the creation of any lots • preparing a tree inventory and protection/removal plan, which includes an appropriate compensation plan for the removal of significant vegetation • preparing an architectural design statement to ensure the proposed housing design is in keeping with the character of the established neighbourhood • removing the existing dwelling • preparing a preliminary lot grading and drainage plans • conveying the environmentally sensitive lands to the TRCA • paying the cash-in-lieu of parkland fee • cost sharing for the preparation of the Rouge Park Neighbourhood Environmental Master Servicing Plan • entering into a Development Agreement with the City to address any offsite works such as, but not limited to: road restoration; service connections; boulevard restoration; boulevard tree planting; driveway locations and entrances; and construction management and erosion and sediment control. • 35 . Financial Implications: Update to Schedule B - Part B, Fees Payable for Building Permits to reflect approved amendments to the Fees By-law. • Discussion: Council currently has in place By-law 7362/14, which is required to provide for the administration and enforcement of the Building Code Act within the City. This By-law includes a schedule of persons appointed pursuant to that Act. The recent resignation of Curtis Greenham (effective September 12, 2014) and retirement of Taylor Young . (effective September 30, 2014) as inspectors and the recent hiring of Andy Westcott as an inspector effective November 24, 2014) requires that the respective names be removed and added to Schedule A. This By-law also includes a schedule of fees payable for Building Permits within the City, pursuant to the Act. Recent updates to Schedule B— Part B, Fees Payable for Building Permits in June 2014 did not include one particular fee type, entitled Revision to Permit (All Other Building Types). As such, the Filipino-Canadian Heritage and Resource of Durham is seeking to host a Flag Raising and Cultural Festival on June 13, 2015 in Esplanade Park. Staff have confirmed that Esplanade Park is only available to be permitted for this event on June 27, 2015. The event will feature a flag raising ceremony to commemorate the Philippine Declaration of Independence which was proclaimed on June 12, 1898. The event will also include a Santacruzan. The Santacruzan is a popular religious festival held in many towns and cities throughout the Philippines and by Filipinos around The world to highlight the month-long celebration of Flores de Mayo during the month of May. It is usually celebrated with a parade of decorated floats, flowers and the portrayal of the Blessed Virgin Mary and other biblical and historical figures. The Filipino-Canadian Heritage and Resource of Durham event organizers propose a number of activities as part of the Flag Raising and Cultural Festival in Esplanade Park which includes food vendors and outdoor cooking demonstrations. The event is planned to operate from 12 pm to 6 pm on Saturday, June 27, 2015 and will require a rolling road closure for a brief parade along the following route: Diefenbaker Court, Esplanade South, Glenanna Road to Esplanade North. Report ENG 20-14 December 8, 2014 Subject: Various Updates to the Traffic and Parking By-law 6604/05 Page 2 Road, residents are experiencing increased congestion and vehicle conflicts in this section of roadway. Recently, to accommodate the growth of traffic on Glenanna Road, an eastbound right turn lane at the intersection of Glenanna Road and Liverpool Road was installed. However, this right turn lane is routinely being blocked by resident and construction vehicles that are parked on the roadway. To assist with traffic flow and to reduce vehicle conflicts, Engineering & Public Works staff reviewed parking on Glenanna Road between Liverpool Road and Glendale Drive and recommend the following measures: • parking restrictions on the south side of Glenanna Road from Liverpool Road to Glendale Drive • parking restrictions on the north side of Glenanna Road from Liverpool Road to 80 metres west thereof. Glenanna Road widens after 80 metres for westbound travelling vehicles to allow for on-street parking and through traffic The proposed parking restrictions on Glenanna Road are shown graphically in Attachment 1. Parking restrictions on Sandstone Manor are proposed By-law Services were contacted by Purdue Pharma, which is located on the southwest corner of the intersection of Granite Court and Sandstone Manor, regarding large delivery trucks having difficulty accessing Sandstone Manor because of vehicles parking on Sandstone Manor near the intersection with Granite Court on the west side of the roadway. To alleviate these concerns, Purdue Pharma asked City staff to review parking on Sandstone Manor and provide recommendations restricting parking on the west side of the roadway near Granite Court. Currently, parking restrictions are present on the entire east side of Sandstone Manor and portions of the west side. Engineering & Public Works staff reviewed the west side of Sandstone Manor at Granite Court for parking restrictions. Based on the review, parking restrictions are recommended on the west side of Sandstone Manor from Granite Court to 15 metres south thereof. The proposed parking restrictions on Sandstone Manor are shown graphically in Attachment 2. Engineering & Public works staff investigated this concern and found that sightline issues are present at this location when there are large events at the park. During these events, vehicles park along the north side of Pickering Parkway right up to the Village East Park and Diana Princess of Wales Park parking lot driveway. As this can present a safety concern, staff propose that parking restrictions be implemented on the north side of Pickering Parkway 10 metres east and 10 metres west of the existing driveway entrance of the Village East Park and Diana Princess of Wales Park parking lot on Pickering Parkway. The proposed parking restrictions on Pickering Parkway are shown graphically in Attachment 3. Existing Parking restrictions on Fernam Street are to be included into the Traffic and Parking By-law 6604/05 , There is currently a sign indicating a parking restriction on the west side of Fernam Street from Strouds Lane to approximately 35 metres north thereof. This restriction is currently not listed in the Traffic and Parking By-law 6604/05. Parents often use Fernam Street to pick-up and drop-off students to and from Highbush Public School. The parking restriction prevents motorists from parking too close to the intersection on the west side of the street, which could otherwise be a safety concern. Currently, staff have not heard any concerns regarding the parking in the area. As the sign restricting parking on the west side of Fernam Street works well, and the two affected homeowners on the northwest corner of Strouds Lane and Fernam Street have indicated to staff that the "no parking" sign should remain, Engineering & Public Works staff has recommended that this parking restriction be included into the Traffic and Parking By-law 6604/05. The parking restrictions on Fernam Street are shown graphically in Attachment 4. Existing Stop signs on Seventh Concession Road at Sideline 28 are to be included into the Traffic and Parking By-law 6604/05 • There are currently stop signs on Seventh Concession Road for east-west traffic at -Sideline 28, which is not reflected in the current Traffic and Parking By-law 6604/05. This stop location has been existing for many years. Three different options for replacement lighting were offered, and the Musco Light- Structure Green System, which will provide the greatest cost savings in energy use and reduced maintenance is the option being recommended by the Engineering & Public Works Department. Financial Implications: Adoption of the interim current operating appropriations does not constitute approval of a formal budget but rather is required to provide funding authorization at the transitional stage. At the conclusion of the Budget process, all interim current operating appropriations are nullified and replaced with the appropriations as approved by Council. Discussion: Each year, pending approval by City Council of the annual Operating Budget, it is necessary to provide expenditure authority respecting the payment of accounts for the interim period from January 1 until the Budget is adopted by Council. Such authority is in the form of interim current operating appropriations to meet estimated expense requirements of the individual departments, agencies and boards. Staff are seeking approval to provide for interim spending authority for up to the first six months of 2015 or when Council approves the 2015 Budget, whichever occurs first. The Roads cost centre has been adjusted to reflect greater than six months of the annual budget due to the seasonal nature of this cost centre, and past spending patterns. This has been reflected on Attachment 1. 97 • Report FIN 21-14 December 8, 2014 Subject: 2015 Interim Spending Authority Page 2 With the requirements of the Public Sector Accounting Board (PSAB) regarding tangible capital assets being effective since January 1, 2009, small capital items previously included under the Capital Budget have been gradually transferred to the Current Budget in the last four years. The 50% interim provision is sufficient to cover this change. Under the same PSAB requirements regarding tangible capital assets, library materials have been deemed capital and included in the Capital Budget starting from-2010. In the library business, the publishing cycle demands that materials be purchased while they are "in print". As a result, certain materials must be purchased in a timely manner, and it is essential for the Library to continue purchasing materials throughout the year. On this basis, greater than 50% of last's year library capital materials has been included in the interim appropriations and reflected in Attachment 1. A minor provision has been included for small capital expenditures from current funds. Approval is always sought at the end of the City's fiscal (calendar) year in order to be prepared, in the event that loans are necessary, as we proceed into the New Year. The passing of this report and corresponding By-law will provide the City financial flexibility to deal with unanticipated negative events. Put another way, this report provides the City with a financial safety net. 100 Report FIN 22-14 December 8, 2014 Subject: 2015 Temporary Borrowing By-law Page 2 Financial Implications: At this time, it is difficult to estimate the interest costs as it is uncertain how much temporary financing may be required and for how long. With internal borrowings being limited, the City must undertake external borrowing from the • Regional Municipality of Durham (the "Region") in 2015 for approved capital expenditures. For current purposes, the $39 million limit for January 1 to September 30, 2014 has been increased to $41 million for January 1 to September 30, 2015 and the $19 million limit for October 1 to December 31, 2014 has been increased to $20 million for October 1 to December 31, 2015. The limit for capital purposes for 2015 has been established at $25 million based on the first draft dated November 3, 2014 of the draft 2015 Capital Budget. This may have to be adjusted once the 2015 Capital Budget has been approved by Council. Discussion: The borrowing of funds for current and capital purposes may become necessary in the normal course of operations during 2015. Under Section 407 of the Municipal Act, 2001, as amended (the "Act"), Council may pass a by-law to provide for the temporary borrowing of funds to meet current operating expenditures pending receipt of taxes and other revenues of the City. Under the Act, the Corporation may also undertake temporary borrowings under individual project approvals, and for capital projects, pending permanent financing. Current Budget Financing The amount of such temporary borrowing outstanding at any one time is limited by the Act, unless otherwise approved by the Ontario Municipal Board, to 50% of the estimated annual revenues from January 1 to September 30•and to 25% thereafter. Until the current year's estimates are adopted, the limitation may be calculated upon the revenues set forth in the estimates adopted for the preceding year. Based upon the 2014 estimates of the Corporation, the allowable level of temporary borrowing outstanding under the Act is estimated at$41 million from January 1 to September 30 • and $20 million thereafter. The requested $41 million should be sufficient to meet the current expenditures of the City until the levies for 2015 are received. It is hoped that this amount will provide a sufficient level of temporary borrowings taking into account the potential effects of taxation legislation and its impact on cash flows. Capital Budget Financing Borrowing for capital purposes under the Act can only be undertaken on projects approved by Council and will only be undertaken in the event that sufficient funds are not available at the time they are required. Executive Summary: Not Applicable Financial.Implications: If approved, the write-off of taxes as referred to in Attachment 1 of this report represents a gross cost of$81,676.37 with a net cost to the City of approximately $17,260.36, the balance being charged back to the Region of Durham and the School Boards. Pickering's share of the costs will be charged to the 2014 Current Budget allocation under General Government— Provision for Uncollectable Taxes. Discussion: The Municipal Act provides the Treasurer with various tax tools regarding the administration and collection of property taxes. Under the provisions of Section 357 of the Municipal Act, reduction of taxes due to fire, demolition, exemption, • assessment change or error is allowed. Change in realty tax class can translate into lower property taxes if the property is moved from industrial to commercial tax class or commercial to residential tax class. Demolitions and other physical changes to a property, such as filling in a swimming pool, or damage caused by fire or flooding, result in a reduction in assessment and a corresponding reduction in property taxes. Six of the applications in Attachment 1 reflect the comment"razed by fire, demolition." Six applications were to remove older structures, and five of the applications were for properties that qualified for a tax reduction. 105 Report FIN 23-14 December 8, 2014 Subject: Section 354/357/358 of the Municipal Act—Adjustment to Taxes Page 2 Four of the applications reflect the comment"ceases to be liable for tax rate at rate it was taxed". Two of the applications were for properties that had their assessment class revised to a class with a lower tax rate. Two of the applications were to exempt properties from taxation as they are owned by the City. Section 358 of the Municipal Act allows taxpayers to have their assessments revised by MPAC where they believe that they have been overcharged due to a gross or manifest clerical error on the part of MPAC. On this basis, taxpayers are allowed to seek reduction of their assessments for the current year as well as the two prior years. This section of the Act allows for the reduction of taxes due to such errors, once confirmed by the Regional Assessment Office of MPAC. Six of the applications in Attachment 1 reflect the comment "gross or manifest error". These properties had no reduction as they were determined by MPAC to be appropriately assessed. The purpose of Sections 357/358 is to allow the municipality and MPAC to quickly rectify assessment classification changes, and prior years' errors quickly without the property owner having to go through the formal assessment review process. Section 354 of the Municipal Act allows the council of the local municipality to write off taxes as uncollectible on the recommendation of the Treasurer. The taxes associated with the applications in Attachment 1 reflecting the comment"Treasurer's Write Off", have been deemed by the Treasurer as uncollectible. The applications for"Treasurer's Write Off" all relate to one property. That property is a very small residual parcel created by Plan 40M-1442 in 2000, with a residential assessment value of$10,000. In 2008, the parcel was subject to a consolidation and land division, and the roll number was deleted by MPAC. Considering that the roll no longer exists and the arrears were outstanding prior to the consolidation, it would be difficult to pursue collection of the arrears. Financial Implications: The insurance premium will be provided for in the City's 2015 current budget to be approved by Council. The premium increase is 2.36% when compared to last year's premium and coverage. • Discussion: The City provides a wide variety of public services and programs to its residents including but not limited to fire, roads and sidewalks maintenance, parks, recreation and cultural services, storm water management, planning services, building services and animal services. The City's capital assets have an insured value of$203 million. The City is exposed to many potential risks and claims through the provision of services to the public and by allowing public access to its facilities and infrastructure. As these claims may be significant, the City maintains financial stability with a combination of risk management practices and insurance coverage. The City's current insurance provider was secured through a competitive Request for Proposal process in 2013. A total of four proposals were received and the successful proponent was Jardine Lloyd Thompson (JLT), which was the highest ranked and lowest priced proponent Council approved the award of the City's insurance program to JLT for a period of one year (January 1, 2014 to December 31, 2014) with an option in favour of the City to extend coverage on the same terms and conditions for four consecutive one year renewal terms, each subject to Council approval. Executive Summary: Section 110(6) of the Municipal Act, 2001 allows a municipal council to pass a By-law to exempt from taxation for municipal and school board purposes, land on which municipal capital facilities are located. The passage of the attached By-law will exempt the Pickering Indoor Soccer Dome (located at 1975 Clements Road) from property taxes. This is necessary for the operation of the Indoor Soccer Dome by the Pickering Soccer Club (the "PSC") to be financially sustainable. The operation of the Indoor Soccer Dome by the PSD is a service of great value to the City's residents. Financial Implications: The indoor soccer dome owned by the City is licensed to the Pickering Soccer Club for one dollar and is not currently assessed as taxable by the Municipal Property Assessment Corporation ("MPAC"): MPAC may return this property as taxable in the future. By declaring it as a Municipal Capital Facility and passing the corresponding By-law, the property will be exempt from future property taxes. The total estimated annual property taxes for this property (on a full year basis) would be approximately $239,000, of which $47,000 would have been the City share. 130 Report FIN 25-14 December 8, 2014 Subject: Municipal Capital Facilities Property Tax Exemption Under, Page 2 Subsection 110(6) Municipal Act, Pickering Indoor Soccer Dome Discussion: Properties owned and occupied by a municipality are exempt from . taxation pursuant to Section 3 of the Assessment Act. However, when a municipality leases property, the property tax exemption is lost. Commercial businesses located at the Pickering Recreation Complex have attracted property tax liability. It is staffs understanding that the City of Oshawa (GM Centre) and Town of Whitby (Soccer Dome) have employed the same property tax tool to make their facilities exempt from property taxes. This property tax tool has been used for several municipal projects in Ontario, and is an appropriate element of municipal projects which provide benefit to the community. This property (1975 Clements Road) is licensed to PSC for the benefit of the community. The resulting exemption will allow the organization to provide a value added service to the community at a reduced operating cost.
