Chief Administrative Officer Subject: Durham Catholic District School Board — Surplus Property - St. Marguerite Bourgeoys Catholic School Board i - File: A-1440-001 Recommendation: 1. That Report CAO 01-14, regarding a property of the Durham Catholic District School Board that has been declared surplus, be received; 2. That Pickering Council confirm it has no interest in acquiring the St. Marguerite Bourgeoys School site for municipal purposes; and 3. Further, that the City Clerk advise the Durham Catholic District School Board of Council's decision. Executive Summary: The Durham Catholic District School Board (DCDSB), at its September 30, 2013 Board meeting, passed a resolution declaring St. Marguerite Bourgeoys Catholic School in the City of Pickering surplus to the Board's needs. St. Marguerite Bourgeoys Catholic School is located on Meadowview Avenue, adjacent to Shadybrook Park (see Location Map, Attachment#1). The 1.2 hectare property is zoned "ES" — Elementary School and is designated "Low Density Residential" by the Pickering Official Plan. The process to dispose of surplus property is set out in the Education Act and its Regulations. A number of public sector bodies are given the first opportunity to acquire surplus property. Accordingly, on October 31, 2013, the DCDSB forwarded a letter to the City of Pickering, as well as the other prescribed public bodies, asking whether there was an interest in acquiring St. Marguerite Bourgeoys School site, for fair market value (see Offer Letter, Attachment#2). Senior staff of the City met to discuss the matter and concluded that there was no interest in acquiring the property. It is therefore recommended that Council confirm that there is no City interest and advise the DCDSB accordingly. If there is no offer from any of the priority public sector bodies before January 29, 2014, the DCDSB may sell or lease the property in an open market to any other body or person. 54 Report CAO 01-14 January 20, 2014 Subject: Durham Catholic District School Board - Surplus Property Page 2 Financial Implications: None Discussion: The Durham Catholic District School Board's Accommodation Review: During 2012 and 2013, the DCDSB undertook an Accommodation Review process to examine enrollment, programs and facilities for all eight Catholic elementary schools in Pickering. On September 1, 2013, at the conclusion of the Accommodation Review, the DCDSB approved a motion to close St. Marguerite Bourgeoys Catholic School (and two other schools), and made a number of changes to its schools, program locations and school zone boundaries. The St. Marguerite Bourgeoys Catholic School is within the Amberlea Neighbourhood and is situated at 1765 Meadowview Avenue (see Location Map, Attachment#1). The School site area is 1.2 hectares (2.97 acres) and was built in 1983.The City of Pickering owns and maintains the abutting Shadybrook Park. The School site is zoned "ES" — Elementary School and the Pickering Official Plan designates the land as "Low Density Residential". • The process and timeline on surplus property under the Education Act: The Education Act provides the DCDSB the authority to sell, lease or dispose of - property not required for the DCDSB'S purposes and Regulation 444/98 prescribes the process and timelines. The established process has 4 key steps: 1. The DCDSB adopts a resolution that the property or part of a property is not required for the purposes of the Board. 2. The DCDSB issues their proposal to sell or lease the property to a prescribed list of public sector bodies, with each being notified on the same day. 3. The DCDSB must wait 90 calendar days before accepting an offer from any of the public sector bodies. 4. The DCDSB may sell or lease the property in an open market to any other body or person, if there is no offer from a public sector body within the 90 day period. The City of Pickering is one of the specified agencies, boards and bodies that are given priority to acquire surplus lands. On October 31, 2013, a letter was received from the DCDSB (see Offer Letter and Information Package, Attachment#2) inviting the City to submit an offer to acquire the St. Marguerite Bourgeoys Catholic School Property. A response is requested by January 29, 2014. Staff review and recommendation: Senior staff met to review and assess the need to acquire the surplus school property for the City purposes. Staff concluded that there was no need to acquire the surplus school property from the DCDSB for any municipal purpose. It is therefore recommended that Council confirm the City has no interest and advise the DCDSB accordingly. 55 Report CAO 01-14 January 20, 2014 Subject: Durham Catholic District School Board - Surplus Property Page 3 Next Step: The DCDSB may sell or lease the property in an open market to any other body or person. If the purchaser intends to use the property for any purpose other than an- elementary school, a rezoning application would need to be submitted and reviewed under the City's normal planning process.
