HomeMy WebLinkAboutBy-law 7314/13 The Corporation of the City of Pickering By-law No.7314/13 Being a by-law to exempt those parts of Block Y, Plan M-16, Pickering, designated as Parts 2, 6, 7, 8, 40R-27608 and Parts 111, 115, 116, 117, 132, 133, 134, 138, 139, 143, 144 and 145, 40R-25699 from the part lot control provisions of the Planning Act. Whereas SR & R Bay Ridges (Two) Ltd., the owner of those parts of Block Y, Plan M-16, designated as Parts 2, 6, 7 and 8, Plan 40R-27608, Parts 111, 115, 116, 117, 132, 133, 134, 138, 139, 143, 144 and 145, Plan 40R-25699, has registered a common elements condominium plan (the "Lands"); And Whereas it is intended that the owner or owners of each of the 4 dwelling units being constructed on the Lands will own the parcel of tied land ("POTL") on which his, her or their dwelling is located in fee simple, and will also be a member or members of the common elements condominium corporation; And Whereas it is intended that each POTL on which the 4 dwellings are to be constructed will be subdivided by means of an exemption from the part lot control provisions of the Planning Act, R.S.O. 1990, chapter P.13; And Whereas the Lands are subject to restrictions registered on title pursuant to Section 118 of the Land Titles Act, R.S.O. 1990, chapter L5, which requires the consent of the Solicitor for The Corporation of the City of Pickering to be given prior to the registration in the Land Registry Office for the Land Titles Division of Durham (No. 40) of any transfer or charge. Now therefore the Council of The Corporation of the City of Pickering hereby enacts as follows: 1. Section 50(5) of the'Planning Act, R.S.O. 1990, chapter P.13, shall cease to apply to those parts of Block Y, Plan M-16, Pickering, designated as Parts 2, 6, 7, 8, Plan 40R-27608 and Parts 111, 115, 116, 117, 132, 133, 134, 138, 139, 143, 144, 145, Plan 40R-25699 upon registration of this By-law. 2. This By-law shall remain in force and effect from the date of the passing of this By-law and shall expire on November 18, 2014. By-law passed this 18th day of November, 2013.
