Presentation of Certificates Gardens of Distinction Mayor Ryan provided an overview of the Pickering Blooms program which was launched in 2009. Councillor McLean acknowledged the dedicated volunteers and together they congratulated the recipients of the Gardens of Distinction awards. The following residents were recognized; John & Vicky Mitchell, Randy & Andrea Parsons, Michelle Dawe & Holly Naves, Candace Carter, Igbal Mirza, Robert Allpress, Donna Jones, Sigrid Squire, Cheryl Sliz, Penny Purdon, the Pickering Horticultural Society, Amberlea Gardeners, Highbush Public School and Vaughan Willard Public School. 2. Safe Community Service Partner Awards Mayor Ryan provided an overview of the Safe Community Service Partner Awards, noting that the City of Pickering was presented with the local award at the Health & Safety Ontario Conference on October 7, 2010. Mayor Ryan presented Tony Prevedel, Chief Administrative Officer and Marisa Carpino, Supervisor, Culture & Recreation with certificates in recognition of the National Ambassador for Safety Community Service Partner Award. (V) Delegations 1. Mark Holland, MP for Ajax-Pickering Update on North Pickering Federal Lands Mark Holland, MP for Ajax-Pickering appeared before Council to provide an update with respect to the Federal lands in northeast Pickering. He expressed his disappointment with the deterioration of heritage homes in the area and the proposed demolition of these homes by Transport Canada. He also noted there is no reason for this destruction and stated he would do everything he could to put a stop to this. He noted the need for clarity and a transparent process with respect to these heritage structures, stating that a majority of the public is unaware of what is happening. He noted there needs to be more public awareness, stressing the importance to continue the fight to preserve this heritage, particularly as the City celebrates its Bicentennial year. A question and answer period ensued. 2. Durham Multi-faith World Religion Day Donald Igbokwe appeared before Council on behalf of the Durham Multi-Faith organization in support of a proclamation for World Religion Day celebrated on January 16, 2011. He provided an overview of the purpose, noting that it was originally declared in 1949 and is now celebrated around the world. He explained the elements of creating unity among the diverse race of cultures and religions. He acknowledged and thanked members of the various multi-faith groups. 3. Removal of Sidewalk on Boyne Court Connie Brickles, 1504 Boyne Court, appeared before Council on behalf of the owners of 1502, 1504, 1506 & 1508 Boyne Court with respect to the removal of the sidewalk in front of their homes. She noted the sidewalk leads nowhere and serves no purpose. She informed Council that the residents were willing to pay for all costs associated with the removal and ensuing maintenance and indicated their willingness to work with staff to ensure the removal of the sidewalks meets all City requirements. She noted that as most of the residents have lived there for over 15 years, the number of family vehicles have increased, thereby requiring the need for additional parking. She also indicated they had canvassed all residents in the area and have acquired 100% support for removal of the sidewalk. A question and answer period ensued. (VI) Correspondence 1. Planning & Development, Report PD 02-11 Proposed Demolition of Listed Heritage Structures on Federal Lands Discussion ensued with respect to the demolition of heritage structures. Resolution # 10/11 Moved by Councillor Rodrigues Seconded by Councillor O'Connell 1. That Report PD 02-11 of the Director, Planning & Development respecting the proposed demolition by Transport Canada of nine structures listed on the Heritage Register, be received for information; 2. That the Federal Minister of Transportation be advised that the City of Pickering is gravely concerned about the destruction of our irreplaceable cultural heritage resources on the Pickering Lands Site; 3. That the Federal Minister of Transportation immediately order the cessation of demolishing seven listed structures of heritage value, and particularly the two structures at 635 Uxbridge Pickering Townline Road and 5245 Sideline 28 noted within this report as having an even higher level of cultural heritage significance, until a decision regarding future plans for the Pickering Lands Site has been made and the potential for preservation of these structures can be fully considered; 4. That the Federal Minister of Transportation fully reimburse the City for its costs to undertake detailed heritage assessments of the nine buildings which are the subject of this report, and to fund future assessments required for the additional (100) buildings identified on the City of Pickering Heritage Register that are located on the Pickering Lands Site, 5. That Transport Canada reconvene the Local Heritage Steering Committee to complete its mandate to develop a heritage strategy for buildings deemed locally significant; 6. Further that, should Transport Canada pursue the destruction of North Pickering and the demolitions of these heritage homes the City of Pickering not approve the Federal Government's demolition permit applications and commence a cease and desist order for any attempt to destroy heritage homes in the City of Pickering. The Chair ruled the motion Out of Order due to the fact that the City of Pickering does not have the legal authority to refuse the issuance of demolition permits or to commence cease and desist orders. That Report CS 07-11 of the Director, Corporate Services & Treasurer be i received; 2. That approval be given to the following 2011 Capital Budget projects: a) Urbanization of the Third Concession Road (BR-1), east of Brock Road including sidewalks, multi-use trails, street lights and lane widening at an estimated cost of $1,076,525; I b) Urbanization of Brock Road (DH-15) on both sides from the Third Concession Road to the CPR underpass including sidewalks, multi-use trails, streetlights and concrete poles at an estimated cost of $1,069,500; 3. That the Council authorize the Director, Corporate Services & Treasurer to finance the City's share for land acquisition associated with Stormwater Management Facility (SWM #4) and for works to be included in the Region r contract for SWM #4 and related storm sewer construction on lands north of Third Concession Road at a total estimated cost of $2,000,000 as follows: a) that the sum of $2,000,000 be financed by the issue of debentures by the Regional Municipality of Durham over a period not to exceed ten years with the sum of $800,000 to be recovered from non-participating landowners; 6. That the Council authorize the Director, Corporate Services & Treasurer to finance the City's share for works to be included in the Region contract for the urbanization of Third Concession Road (BR-1), east of Brock Road at an estimated cost of $1,076,525 as follows: a) that the sum of $806,000 be financed by the issue of debentures by the Regional Municipality of Durham over a period not to exceed fifteen years; b) that the sum of $269,131 be funded from the Development Charges Reserve Fund; c) that the sum of $1,394 be funded from current funds; 7. That the Council authorize the Director, Corporate Services & Treasurer to finance the City's share for works to be included in the Region contract for the urbanization of Brock Road (DH-15) on both sides from the Third Concession Road to the CPR underpass at an estimated cost of $1,069,500 as follows: 13 Cary Council Meeting Minutes Monday, January 17, 2011 PICK WNG 7:30 PM Council Chambers 4 a) that the sum of $534,000 be financed by the issue of debentures by the Regional Municipality of Durham over a period not to exceed fifteen years; b) that the sum of $534,750 be funded from the Development Charges Reserve Fund; c) that the sum of $750 be funded from current funds; 8. That a six-month repayment charge in the amount of approximately $196,000 be included in the annual Current Budget for the City of Pickering in 2011, and any financing cost be paid out of the Current Budget; 9. That the annual repayment charges in the amount of approximately $392,000 be included in the annual Current Budget for the City of Pickering commencing in 2012, continuing thereafter until the debentures are repaid, and any financing cost be paid out of the Current Budget; 10. That the draft by-laws attached to this report be enacted; 11. That the Director, Corporate Services & Treasurer has certified that this loan and the repayment thereof falls within the City's approved debt and financial obligations annual repayment limit for debt and other financial obligations for 2010 as approved by the Province for municipalities in Ontario and therefore, the Ontario Municipal Board approval is not required; 12. That the Clerk forward a copy of Report CS 07-11 to the Region of Durham and the Duffin Heights Landowners Group and the Trustee for information; and, 13. That the appropriate officials of the City of Pickering be authorized to take any necessary actions to give effect thereto. 10. Anneta Tomais, 5 Todd Road, Ajax, appeared before the Committee on behalf of Muppets Child Care Centre located at 986 Dunbarton Road. She noted her concern with respect to the proposed daycare centre, stating that four daycare centres already exist in the area. She informed the Committee that her daycare centre is not at capacity and was concerned that another daycare centre in the area would hamper their enrolment. Vern Bruce, 975 Merritton Road, Pickering appeared before the Committee, in opposition to the application and noted he lives adjacent to the property. He stated that he did not feel a daycare was an appropriate use for the site and stated his concern with additional noise, on street parking and the close proximity to the railway tracks. Mr. Bruce felt that if a daycare use was approved he would like to see it in the building that was furthest east of his property. He noted that Merritton Road was already congested with on street parking and felt these uses would increase the problem. He also noted his concern with the close proximity of the railway tracks and the safety of the children. Marion Barsoum appeared before the Committee on behalf of the church and stated that the daycare facility has not been determined as a definite use. We do what the Toronto Daily Bread Food Bank does, but we focus on Durham which directly benefits residents of Pickering. As the regional distribution hub, we source, warehouse and distribute food to 42 agencies and an estimated 50,000 people. Our objective is to alleviate hunger by providing food to agencies. Agencies are food banks, shelters, soup kitchens and breakfast feeding programs. As a regional hub and member of a Provincial Food Share System, we have increased purchasing power that agencies don't have. Pickering residents benefit from 18 out of the 42 agencies we provide food to, and on average, 148,000 pounds of food per month moves through Durham Region, with a dollar value of $370,000 per month. With the introduction of the Seaton community, the population in Pickering will increase by an additional 70,000 - 90,000 new residents (estimated, according to the Corporation of the City of Pickering webiste), putting additional demands on the agencies and therefore residents who seek food. Our agencies are currently beginning to track the use of their services by specific geographic locations, as our warehouse has been operational in our current capacity, since March 2010. We have received our registered charitable status, #81495021RR0001, in October 2009. Many of those who receive food assistance are children. While all age groups are represented, children comprise the largest category of food assistance recipients, at 35.9% of clients (Ontario Hunger Report 2009: Living With Hunger). Also, the face of hunger has changed. Due to the current and prolonged economic situation, a large portion of those who turn to food banks now are working or recently unemployed. According to the Ontario Hunger Report 2009: Living With Hunger, 32% of persons heading households using food banks in Ontario are employed part-time or full-time or were recently employed in the last six months. Funding from the Corporation of the City of Pickering is required and will be used towards our general operating costs, as the operation of Feed the Need in Durham is the program itself. Various operating expenses include: the cost of electricity to operate the industrial walk- in refrigerator and freezer, so we can provide nutritious perishable food such as fresh fruits and vegetables, dairy and protein; gas to transport food to agencies; gas to pick up food from grocery warehouse distribution centres; cost of running our forklift in order to lift food off the floor, to meet Public Health Department requirements and also those of the Ontario Association of Food Banks; cleaning supplies in order to meet proper food handling and sanitization guidelines; the purchase of nutritious food that agencies require and request from us, that have not been donated. Even though people receive assistance with their food supply, nutritional requirements are still not adequate. Most are not able to meet their daily nutritional requirements as per Canada's Food Guide and are forced to choose between paying housing costs and purchasing food. The average amount of food assistance a family or individual receives is just 3 - 5 days' worth of food per month. As a central distribution hub and member of the Provincial Food Share System, Feed the Need in Durham can purchase food in increased quantities for a fraction of the cost; other food banks and agencies who receive food from us cannot. For example, we can purchase $4 worth of powdered milk for just $1. With increased access to nutritional food, resulting outcomes for clients of the agencies we service include: access to additional food, access to food with higher nutritional value, increased health, the opportunity to address their root causes of hunger. Clients, who are also community residents, can then improve their potential in terms of health, mental health, education and economic productivity. Hi John What the News Ad. paid ad does not say, as you know, is that the Province when it established the GreenBelt left these lands as "white belt" outside of the GreenBelt. A consideration may have been that they found it less environmental sensitive and that the 407 extension would run through it. The Province also requires the Region to do long term planning and conformity with Places to Grow etc. Durham Region is doing these although the Province has not agreed with. some elements of the Region's proposed plan including NE Pickering. The issues may be more of timing of the inclusion of there area in the urban area than whether or not it should be in the GreenBelt. As with most OMB hearings an attempt at settlement will likely be made before a hearing. You are correct that many studies will be undertaken prior to any development and it is likley that large areas would remain undeveloped (in Seation this is about 50%), if development happens at all. The Regional Plan Amendment is led by the Region. Pickering was provided an opportunity to comment, but was not in a decision role. This came before public meeting(s) last year and Council supported, with comments, staffs report which supported the amendment. I don't know off hand the voting of our four Regional Councillors at the Region Council meeting on this matter, but it passed a t Regional Council along with direction to appeal the province's decision. Pickering did not appeal the Province's decision, the Region did. The Region, not the city, is a party to the OMB hearing.. As a planning matter, the Regional Plan would not come back to Pickering. What would come to Pickering for a decision would be any amendment to include this area in the urban area of Pickering's Offical Plan, although I would not expect this for awhile. So nothing in the planning process on NE Pickering is scheduled to come to Pickeing Council, unless of course a Councillor brings a notice of motion wishing to reverse the previous postion of City or Region Council. I have not seen a motion to date although Regional. Councillor McLean and the paid ad suggest such a motion may be coming forward on Feb 22. Hope this helps. With so much of this land owned by developers, one starts to question if there is a hidden or questionable agenda pushing this amendment forward. I know that the City of Pickering councillors are not influenced by developers and make these types of decisions based on sound urban planning principles. .I have spoken to Councillor Peter, Rodrigues and his position is very clear. He stands against this amendment and believes that the appeal to the OMB is a waste of public funds. I know that this is a Regional matter, but it does concern the City of Pickering. I am very interested in understanding your position and the facts on which your position is based on. I am just starting my research and I am sure that over the next couple of weeks I will have a better understanding of the factors that have convinced the unelected chair of Durham Region, Mr. Anderson, and the rest of the Regional Council to feel compelled to set out on a course to spend so much of the tax payers dollars to expand the urban boundary. Environmentally sensitive lands include: - Lake Iroquois Shoreline: a natural purification system for our water that has major recharge/discharge areas within the Greenwood area. These recharge/discharge areas are sensitive, requiring preservation. They are key environmental features critical to the protection of our source water and many small cold-water creeks in our area. Protection of this irreplaceable resource is paramount. - Greenwood and area are part of the Watershed Plan for Duffins and Carruthers Creeks. The Watershed Plan for Duffins Creek has identified the need for the protection of recharge and discharge areas, natural and human heritage features, terrestrial and aquatic habitat and species. The Greenwood area has all of these features contained within it. - The Greenwood Conservation Area runs across our southern border and contains environmentally significant species (e.g. regional species of concern). -Claremont Conservation area runs across our Northern Border. - We are part of the Duff ins Creek natural wildlife corridor which must be protected. Duffins Creek supports a cold-water fisheries population. Greenwood and area consists of many significant forested areas including some old forest growth areas. 1 63 Our region's agricultural land requires protection. One of the goals for the "Places to Grow" plan is to preserve viable, agricultural land. Durham Region, supported by Pickering Council, must recognize the critical importance of the agricultural sector's prosperity to the regional economy. These. lands are, indeed, a finite, non-renewable resource. I am concerned by the actions of elected Council Members promoting the erosion of the "Places to Grow" framework, pressured by developer interest. Appealing an amendment to the official plan serves only to further the developers' agenda at considerable expense to Pickering taxpayers. The integrity of our Official Plan is eroded with every costly review. I oppose the urbanization of North East Pickering, and request Pickering Council inform Durham Region to abandon their appeal to expand the urban boundary. It is an environmental refuge for animals and plants to take cover from the - once again - seemingly endless surburbanization of the GTA. Local residents cherish this land. They cherish the fact that the GTA is not (yet) an urban centre. If I could have an inkling of influence on this decision I would vote for stopping this development at all costs. Find somewhere else to build or, as many city planners are urging, build up. The GTA could be a model of progress if it used some common sense and more efficient environmental planning. Yet, somehow, I am quite sure that progress was never really progress. It is best symbolized by large bank accounts owned by the few who this development will never affect personally, except to feed their already overfed appetites. In addition, urban sprawl forces individuals to rely on vehicles further damaging the environment, negatively impacting family incomes and contributing to more infrastructure that requires maintenance, capital expenditures for maintenance vehicles, increased labour and benefit costs. In the summer months, we are forced to use our air conditioner at night because we cannot leave the windows open due to the noise. The traffic in and out of Pickering has steadily increased and will continue to do so with all the new home construction. The increased traffic volume is particularly noticeably on the 401 and Bayly. Increased traffic of course means increased noise. We also need to factor in the San Francisco development. When completed, the traffic will increase substantially and so will the noise level. I would also like to point out that the new engines on the Go Trains are louder than the old engines. Even with the windows closed, the arrival and departure of Go Trains from the Pickering station is clearly heard and felt (vibration) in the back part of our home. When family members visit, they often comment on the noise. Visits in the summer months are usually enjoyed indoors due to the noise in our back garden. Suffice to say the noise barrier is long over due. I strongly urge Pickering Council to move forward with supporting the funding for the noise attenuation wall. Over one year ago, I began a crusade to change the world and to transform the way people viewed their place in it. My message began with the belief that one person can change the world and like an avalanche that begins with one snowflake, my message resounded across our country and was heard. I write again of the Honey Bee. Some might not immediately realise how important the Honey Bee is to our way of life. However, it is a truth that Honey Bees are responsible for about a third of the food we eat. It is a truth that they are responsible for about 70 percent of our food crop pollination. It is a truth that they are a keystone species and as such, it is a truth that Honey Bees are the very cornerstone to the sustainability of our agriculture and stability of our environment. This issue is ever more severe because it is also a truth that honey reasons not only in Canada but in eve bees have been disappearing for unexplained y ry country and across every continent where they are raised. The World Organisation for Animal Health (OIE) has reported that there is no one single cause for such alarming worldwide disappearances. Numerous theories abound as to the cause of their disappearances, foremost among them being irresponsible pesticide use, monoculture food crops, parasites, and pathogens. Bernard Vallat, the OIE's director-general, warned, that "Bees contribute to global food security, and their extinction would represent a terrible biological disaster." According to the Canadian Honey Council, "The value of honey bees to pollination of crops is estimated at over $2 billion annually." The Canadian Association of Professional Apiarists (CAPA) suggests that Canada recently sustained a national honey bee overwintering mortality of 21 percent. This amount of loss is greater than what is considered sustainable. But the fact that Honey Bees have been disappearing at percentages considered unsustainable for over a decade is more than alarming. CAPA warns that although this percentage is lower than the 33.9 percent the previous year, "it is too early to determine whether this decline in mortality constitutes a sustained improvement in colony health." In other words, just because fewer hives died than in the previous years, does not mean we are in the clear. Primary of all known solutions is education, awareness and active participation in a resolution to this crisis. Without understanding that there is a problem, the general public might take for granted the severity of this global issue. It is for this reason that I r 95 began my campaign in 2009. While it proudly originated in Saskatoon SK. it did not end until it spread from coast to coast and found root on the shores of distant lands. I had a vision that if municipal governments across our Nation were to be unified by a collective proclamation in dedication to the Honey Bee, that more people, through media attention, would be made aware of their alarming decline. In seven provinces across Canada and with the support of over 70 municipal governments, May 29, 2010 was recognised as the first annual "Day of the Honey Bee". It was officially recognised in declaration by two provincial governments and recorded in the Legislative Assembly Hansard of a third. The Standing Committee on Agriculture and .Agri-Food Canada suggested, "That the Government (of Canada) follow in the footsteps of the Province of Saskatchewan...... by proclaiming May 29, 2010 as the National Day of the Honey Bee and that this be reported to the House." As a result of this amazing support, more people learned about the plight of Honey Bees. All across Canada and abroad, beekeepers, apiarists, beekeeping associations, farmer's markets, university groups and other individuals planned activities and events on May 29 to educate and inform the public. It is my hope that with my words, you may add to this continued success. And now therefore, I do humbly request: that your Worship and Council, on behalf of your citizenry, resolve to proclaim May 29 2011 as the second annual "Day of the Honey 'Bee," and that this proclamation be issued in perpetuity; that in the event that proclamations are not issued in perpetuity as a matter of policy, that it be understood and accepted, requests will be made annually for as long as I am able or when such time passes that a proclamation is no longer required to raise awareness of the plight of the Honey Bee; that in the event that proclamations are not issued as a matter of policy, that this letter be chronicled for posterity in your records as information; that in the event that there is a public ban on beekeeping within your jurisdiction, that in collaboration with your provincial apiarist and respecting your provincial regulations that this ban be lifted; effectively legalizing beekeeping for Hobbyists within your jurisdiction; that considering pesticide use is foremost among causes of worldwide Honey Bee decline, that a motion be passed to review the use of pesticides by municipal authorities, school boards and private residents; especially on flowering plant-life while in bloom within this government's jurisdiction; i - l 96 that Your Worship and Council resolve to, in collaboration with your provincial apiarist and respecting provincial regulations, consider initiating a Honey Bee hive on municipal grounds, in a show of support for the Honey Bee industry, Green initiatives, bio- sustainability and inlan attempt to recoup distressingly dwindling Honey Bee populations; and that in the event a proclamation and or response are issued, that it be sent to, for the.purpose of keeping accurate tally and record. Priest 673 Front Street (Part Lot 4, Block E, Plan 65) City of Pickering The applicant requests relief from Zoning By-law 2511, to permit an existing lot frontage of 9.1 metres and an existing lot area of 373 square metres and proposed side yard widths of 0.3 metre and 1.2 metres to the proposed new detached dwelling, whereas the by-law requires a minimum lot frontage of 15.0 metres, a minimum lot area of 460 square metres and minimum side yard widths of 1.5 metres. The applicant requests approval of these variances in order to obtain a building permit for a new detached dwelling. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department recommending approval subject to conditions and to a revised north side yard width of 0.6 metres. .Written comments were also received from the City's Development Control Manager indicating the request to permit a 0.3 metre side yard width should not be permitted as it would result in an encroachment onto the neighbouring property during construction, side yard fencing would restrict any access along the north side yard of the dwelling, potential for storm drainage issues and roof overhang would also be matters of contention. Helen Kok, James Priest, and John Reeves were present to represent the application. Barry Farquharson of 675 Front Road submitted a letter and was present in objection to the application. Helen Kok explained there are several existing properties in the surrounding area that have side yard widths of 0.3 metres or less, the proposed dwelling has been designed for adequate south side yard width and overhang concerns and will rebuild fences once construction is completed. William Churchill of 1962 Glendale Drives was present in favour of the application. Peter Lambrinos explained the application that the proposed increased height of the detached garage is required to accommodate a vehicle lift for the purposes of restoring vintage vehicles. The design will match the proposed one-storey dwelling, and does not agree that the property is over developed. In response to a question from a resident, Peter Lambrinos indicated that he will not be putting in a pit rather than a lift because of the extra expense. Peter Lambrinos indicated he can build the proposed garage wider and would look at the possibility of reducing the height and is willing to meet with the neighbours to hear their concerns. William Churchill advised he reviewed the application and feels it is not out of character to the surrounding neighbourhood and that it is far enough away from the property lines. Brad Suckling explained he lives directly behind the subject property and expressed several concerns with the application; the height of the proposed garage, visual appearance affecting the enjoyment of rear yard, noise from the air tools and vintage cars, the future use of the proposed detached garage being converted to an auto repair shop and light penetration from subject property's driveway. Richard Janusz expressed several concerns with the application; the height of the proposed garage, potential of the detached garage being used as a repair shop if the house is ever sold and noise from the air tools and vintage cars. Discussion period ensued with respect to the proposed budget which will be considered by Council in March. 5.0 New Business 1) Proposed Demolition of Barn on Sideline 16 1. James provided an overview of the barn located on Sideline 16 which dates back to the mid to late 19th century, which the Ontario Realty Corporation has advised the City of Pickering is proposed for demolition. She noted that in the past Heritage Pickering has not put a lot of emphasis on the preservation of barns, noting this is something the Committee could consider making a decision on. 1. James indicated that the information with respect to this proposed demolition was just received a few days ago, which I. James to action did not provide an opportunity to do any further research on the property. She noted that the property appears to be occupied and in good condition. She noted that the Ontario Realty Corporation did not provide any reason for the demolition, but that Ellen Kowalchuk, ORC was looking into this and she would follow up. M. Sawchuck, employed by Ontario Heritage Trust, provided a brief overview of the role and work of the Trust. 1. James informed the Committee that a study had been commissioned by the Planning & Development Department which resulted in the completion of a Heritage Policy Review in December 2010, which provides a good overview of what municipalities can achieve. She noted the study contains 27 recommendations and has two copies available if any members would like to come into the office and borrow a copy at any time to review. She noted the two areas that the Committee could consider working on are; • continuation of the work on the Heritage Register • preparation of a delegation by-law and report for Council's review and consideration A question and answer period ensued with respect to designations, what this means to property owners and the criteria for designating properties. 1. James suggested the possibility of a trip to Markham to view the heritage village that was created by moving heritage homes to one area. She noted they also have a number of conservation districts.
