REZONING APPLICATION A36/89 SUBMITTED BY CANUCK GREEN HOLDINGS LTD. ON THE SOUTHEAST CORNER OF BAYLY STREET AND WEST SHORE BOULEVARD FILE NUMBER - B 2310 - A 36/89 ~ In an addendum to Planning Recommendation Report 6/90, da ted May 16, 1990, it is recommended tha t the rezoning application submitted by Canuck Green Holdings Ltd. to permit a condominium townhouse development on the southeast corner of Bayly Street and West Shore Boulevard be approved. Approved See Recommendation #1 Bruce Casselman, 900 Vistula Drive, asked about access from West Shore Boul evard and into the ravi ne. He also asked if the watermain that runs through his property would be moved and inquired about the ownership of the lands. ,-,. 4/90 8 1. Todd Wilson, 888 West Shore Boulevard, asked about access onto the property from West Shore Boulevard and from Bayly Street. He stated a crosswalk shoul d be installed and the speed limit reduced on Bayly Street wi th the cost borne by the appl i cant and stated there would be better access for the public to the ravine. He stated his objection to the proposal because the si te is too small for the number of houses, and to a commercial zoning and stated the lands should be parkland. '-'" Martin Mendelow, architect on behalf of the applicant, spoke in support of the Staff Recommended Pl an and stated rights-of-way will be available for access to the ravine. 2. ZONING APPLICATION SUBMITTED BY TRILEA HOLDINGS INC. ON THE SOUTHWEST CORNER OF WHITES ROAD AND HIGHVIEW ROAD FILE NUMBER - B 2310 - A 5/89 w In an addendum to Planning Report 49/89, dated May 15, 1990, it is recommended that the application submitted by Trilea Holdings Inc. to rezone lands on the southwest corner of Whi tes Road and Hi ghvi ew Road to permit the development of a condominium townhouse project be considered. Approved Option #3 See Recommendation #2 Di anne Sutter, Brama 1 ea L td., spoke in support of the Staff Recommended Plan. She stated there is no market to expand the plaza and that Bramalea would like to rezone it to permit a residential zoning on the lands. - Terry Hosford, 617 Chiron Crescent, spoke in support of refusal of the application. He stated that the area school is a1 ready overcrowded and he prefers the lands to remain commercial. John Oakley, 1538 Amber1ea Road, stated the proposal is not compatible in the area, that there should be a lower density and requested refusal of the application. 3. KINSALE CLUSTER BOUNDARY REVIEW FILE NUMBER - B 1000 In P1 anni ng Report 6/90, it is recommended that an appropriate official plan amendment to change the identification of Kinsale from a Cluster to a Hamlet be approved. Official Plan Lost Hamlet Review approved See Recommendation #3 '-'" Gwen t40wbray, 4014 Kinsale Road, stated she was not included in the questionnaire circulation and was not aware of the public meetings. She spoke in opposition to the hamlet proposal because future residents will demand municipal services and water. She a) so stated the proposal is premature because the Hlghway 407 route has not been establlshed. 4/90 9 3. John Ward who lives at the northwest corner of Highway 7 and Ki nsa 1 e Road spoke on behalf of Mr. Vernoy who lives at the northeast corner of Highway 7 and Kinsale Road, stated the proposal may jeopardi ze hi s pl ans to sell in the future and that the Hi ghway 407 route may affect the val ue of hi s property. He asked who woul d compensate Mr. Vernoy if he loses any land due to the 407 route. 'W' Cees Vander Vecht, 3965 Kinsale Road spoke in opposition to a hamlet plan and asked what benefits are there to landowners and developers. He stated residents are subjected to trees spraying, pesticides and that the wells are sensitive to pollution. REZONING APPLICATION A 36/89 SUBMITTED BY CANUCK GREEN HOLDINGS LTD. ON THE SOUTHEAST CORNER OF BAYLY STREET AND WEST SHORE BOULEVARD FILE NUMBER - B 2310 - A 36/89 That Zoning By-law Amendment Application A 36/89 submitted on beha If of Canuck Green Ho 1 di ngs Limi ted to change the zoning on lands being Blocks E and I, Plan M-17 and Part of Lot 26, Range 3, B.F.C., Town of Pickering, from IIC3-Highway Commercial and 1I01-Public Open Space to an appropriate residential zone to permit the establishment of a condominium townhouse development be APPROVED IN PRINCIPLE subject to the following conditions: 1. That prior to the forwarding of an implementing zoning by-law to Town Council, the owner 'W' (a) enter into an appropriate site/development agreement wi th and to the sati sfacti on of the Town of Pickering which shall include, but not necessarily be limited to the following requirements: (i) submission and approval of a site plan and elevation dra\oJings, such plan and drawi ngs to address the archi tectural coordi nati on of the requi red noi se attenuation patio barriers; (ii) the approved site plan and drawings are to be registered with the site plan agreement; "-" (iii) (in accordance with Council policy), the provision of full municipal improvements including curbs, sidewalks, landscaped boulevards, street lighting and storm drainage across the frontage of the subject property adjacent to Westshore Boulevard and the provision of sidewalk and lighting across the frontage of the subj ect property adj acent to Bayly Street, to the satisfaction of the Director of Public Works; (v) (iv) submit a noise impact analysis report, such report to be approved by the Regi on of Durham wi th respect to technical matters and approved by the Town of Pi ckeri ng wi th respect to architectural design and the impact of recommended noise abatement measures on the site and the abutting area; agree to implement the Supplementary Tree Planting in Parkland Plan prepared by Alexander Budrevics and Associates L imi ted (project 891-354-L-3-February 28/90) and approved by the Di rector of Community Services and Facilities March 13, 1 990; ...... 1. That the implementing zoning by-law establish: (a) a minimum parking space width and length of 2.6 metres x 5.3 metres; (b) a parking requirement as follows: 1.0 private garage and adjacent driveway of at least 6.0 metres in length per unit; plus 0.3 space per units for visitors; (c) a maximum number of units permitted on the site; and (d) a requirement for a 3.0 metre landscaped area adjacent to Bayly Street. 4. These conditions of approval apply to the development of 41 units on the subject lands as identified generally on the Site Plan dated June 30, 1989, Job No. 8560, latest revision April 11,1990. That the Community Central Area boundary and designation on Schedule V-A of the Highbush Community Pl an be amended to refl ect the boundary of the 1 and currently associ ated wi th the Amberl ea Shoppi ng Centre. 2. That Schedule V-A of the Highbush Community Plan be amended by adding a Residential Medium Density I designation on the lands subject of this application. 3. That prior to the forwarding of an implementing zoning by-law to Town Council, the owner a) enter into an appropri ate site/development agreement with and to the satisfaction of the Town of Pickering which shall include, but not necessarily be limited to the following requirements: ~ (i) submission and approval of a site plan and elevation drawings; (i i) the approved si te pl an and drawi ngs are to be registered with the site plan agreement; (iii) payment of appropriate levies; (iv) the requirement that the subject lands be developed by draft plan of condominium; (v) sati sfy the respecting facilities.
