(II) MATTERS FOR CONSIDERATION 1. ZONING BY-LAW AMENDMENT APPLICATION A 18/92 TOWN INITIATED - (STEEPLE HILL) PART OF BLOCK 56, PLAN 40M-1480 FILE NUMBER B 2310 - A 18/92 In Planning Recommendation Report 15/92, it is recommended that the application to amend the Zoning By-law Amendment Application, Town Initiated, at the northwest corner of Kingston Road and Steeple Hill BE APPROVED. Approved See Recommendation #1 Lorelei Jones, representing the owner of the subject lands, stated that she is in support of the Planning Report and the recommendations contained in it. '-" ...... 2. ~ ..... ,....,. 2/92 4 DRAFT PLAN OF SUBDIVISION 18T-91019 ZONING BY-LAW AMENDMENT APPLICATION A 2/92 BRAMALEA LIMITED PART OF LOT 35, CONCESSION 1 FILE NUMBER - B 2310 - A 2/92 - 18T-91019 In Planning Recommendation Report 16/92, it is recommended that the applications to amend the Zoning By-law Amendment Application A 2/92 and Draft Plan of Subdivision 18T-91019, submitted by Bramalea Limited, on lands being Part of Lot 35, Concession 1, BE APPROVED. Approved as amended as follows: See Recommendations #2,#3 & #4 a) Lots 1 to 6 are to be reduced to 5 lots with 15 metre frontages. Lots 79-82 were deleted from the plan. Lots 196-203 were reduced from semi-detached lots to single family dwelling lots. That the O.M. B. be satisfied there is not a methane problem. b) c) d) 1. John Whitehead, representing Bramalea Limited, stated that a plan was draft approved in 1983. He has assembled a broad interdisciplinary team who have prepared a new draft plan that makes the most efficient use of the land and protects the environment. With respect to transportation, representatives of the Ministry of Transportation, the Region and the Town have acknowledged that traffic movement in this area is poor at present but will improve over the years after such projects as the widening of Altona Road and Highway #401 and the Taunton-Steeles interconnection have been completed. If this development is approved, it will help to finance those road improvements needed in the area through the payment of development charges. He also noted that the Hogarth Street connection to this development will alleviate traffic on Pinegrove Road. Bramalea Limited has severed lands in the Altona Forest for a separate school, however, if this severance is not approved, they have made provision for a separate school site in this plan. He does not agree with the Ministry of Natural Resources that a 30 metre buffer strip is required at the west end of the plan. 2. Dr. Cameron Kitchen, representing Bramalea Limited, reviewed the environmental features of the plan. 3. Linda Taylor, Manager, Current Operations Division, stated that staff have relied on the Ministry of Natural Resources to define the boundaries of the Area of Natural Scientific Interest (ANSI). The staff are recommending that a 30 metre strip be preserved and that no lots back on to it. The park at the northeast corner of the plan will be a tot lot and the balance will be a passive park. She noted that the lots on the east side of the plan are 45 metres deep and include a ten foot tree preservation strip. '-" ~ '-' (III) '-" Dated 2/92 5 4. Dieter Daues, 1842-1844 Pinegrove Avenue, stated that he was speaking on behalf of some residents on Pinegrove Avenue and Woodview Drive. He does not support this plan because of the possibility of methane gas pockets on the subject lands from the Beare Road landfill site. He inquired into what was meant by the term "accessability to the community" in the Planning Report and asked if the owners of the 45 metre deep lots in the draft plan would have the right to remove trees on the proposed preservation strip. 5. John Sovonia, 1785 Pinegrove Avenue, stated that the Pinegrove Forest is the main artery for water filtration to the Rouge River and the development of the subject lands would destroy this. The Rouge River must be protected in order that clean water runs into Lake Ontario. 6. Konrad Wanner, 1812 Pinegrove Avenue, stated that he does not support the draft plan because it will create traffic movement problems in the area. Emergency vehicles may not be able to access this development because of heavy traffic and parking in the area. He stated that the Pinegrove Forest must be preserved. 7. Adrian Ammoury, 1819 Pinegrove Avenue, stated that construction traffic to the draft plan will be required to travel on Pinegrove Avenue. Before this draft plan is approved, Pinegrove Avenue should be widened and have sidewalks installed. 8. Pavel Krejcik, 1753 Woodview Avenue, stated that he is concerned about excess traffic from this draft plan. He will be affected if Hogarth Avenue is opened. Other developers in the area have cut down trees and make no effort to preserve them and he was concerned this would happen in the draft plan. He noted that methane gas was found between Pinegrove Avenue and Woodview Avenue. This draft plan should not be approved until the traffic problems are solved. 9. Jill Smith, 1822 Pinegrove Avenue, stated that there were about 50 to 60 people at the meeting with Bramalea Limited on September 1, 1992 and most of those residents did not agree with this draft plan. Residents have been evacuated from their houses because of pockets of methane gas. She noted that the poss~ble school site would be on a methane gas pocket. 10. Crystal Garrick, 1851 Pinegrove Avenue, asked if Council was aware of the concerns of the residents as stated at the meeting with Bramalea Limited on September 1, 1992. She felt that the density of the plan was too high and that it is not a good site for houses because of the environment. That the Planning Committee of the Town of Pickering having met on September 17, 1992, presents its second report to Council and recommends: 1. ZONING BY-LAW AMENDMENT APPLICATION A 18/92 TOWN INITIATED - (STEEPLE HILL) PART OF BLOCK 56, PLAN 40M-1480 FILE NUMBER B 2310 - A 18/92 That Town Initiated Zoning By-law Amendment Application A 18/92 be APPROVED to permit the development of an approximate 1300 square metre neighbourhood plaza, on lands being Part of Block 56, Plan 40M-1480, Town of pickering, as set out in the zoning by-law contained in Appendix No. I to Recommendation Report No. 15/92. . 2. DRAFT PLAN OF SUBDIVISION 18T-91019 ZONING BY-LAW AMENDMENT APPLICATION A 2/92 BRAMALEA LIMITED PART OF LOT 35, CONCESSION 1 FILE NUMBER - B 2310 - A 2/92 - 18T-91019 'W' That Town Council recommend for APPROVAL Draft Plan of Subdivision 18T-91019, submitted by Bramalea Limited, on lands being Part of Lot 35, Concession 1, Town of Pickering, subject to the following conditions: 1. That this recommendation apply to the plan identified as the Town Recommended Plan and bearing the Town's recommendation stamp. 2. That the owner make satisfactory Town regarding the required including the conveyance of purposes. arrangements with the parkland dedication, Block 269 for park 3. That the owner enter into a subdivision agreement with and to the satisfaction of the Town. 4. That the subdivision agreement contain a requirement that Blocks 230 to 267 in the Town Recommended Plan be held for use as an elementary school site and public road, and that in the event that an elementary school site is not developed on those Blocks they be developed as public roads and residential lots. Should these Blocks be used for an elementary school, Block 268 may be used as a residential lot. ~ 5. That the owner make satisfactory respecting the provision of all services the Town. arrangements required by 6. That the owner convey Blocks 270, 271 and 272 to the Metropolitan Toronto and Region Conservation Authority. 9. That the owner make satisfactory arrangements with the appropriate authorities regarding the provision of underground wiring, street lighting, cable television and other similar services. 10. That the streets within the plan be named to the satisfaction of the Town. '-'" 11. That the owner submit for approval by the Town, site plans and streetscape elevations showing the location and relationship of all buildings, with details specifically addressing the treatment of flankage dwelling facades and flankage yard landscaping/fence treatment, prior to issuance of any building permits. 12. That prior to the registration of the plan, the owner: a) satisfy the Town respecting storm management measures, and revisions to the water management pond design necessary to the Hogarth street connection; water storm allow b) satisfy the Town that the Ministry of Natural Resources and the Metropolitan Toronto and Region Conservation Authority are satisfied with all grading and storm water management measures, including the stormwater management pond design incorporating the revisions requested by the Town; c) satisfy the Town respecting any changes to the Town Recommended Plan resulting from any redesign of the stormwater management pond; "-" d) submit a detailed tree preservation programme prepared in conjunction with the proposed grading plan and engineering design plans for the subject Plan, to the satisfaction of the Town, which includes a ten metre undisturbed preservation zone at the rear of Lots 6 to 14 and Lots 199 to 229; and shall not remove any trees until such time as this programme has been approved by the Town, except as authorized by the Director of Community Services and Facilities; e) satisfy the Director of Public Works respecting the submission and approval of a detailed soils analysis report; f) satisfy the Town respecting an appropriate contribution to the cost of installing automatic traffic control gates at the Woodview Drive level crossing of the Canadian National Railway right-of-way; '-' 2/92 3 2. g) submit a draft 40M-Plan for approval by the Town Planning Department. '-' 13. That the owner make satisfactory arrangements with the Town regarding the removal, demolition, and/or retention of all structures on the subject property. 14. That the owner satisfy the Town respecting the construction of Taylor street, West Street and Hogarth Street. 15. That the Ministry of the Environment be satisfied that there is no methane gas problem on the subject lands. 3. That Blocks 230 to 267 in Town Recommended of Subdivision 18T-91019 be appropriately to permit either residential lots, or an school. Draft Plan dual-zoned elementary 2. That the rear ten metres of Lots 6 to 14 and Lots 199 to 229 be zoned appropriately to recognize that area as a tree preservation zone. 3.
