MINUTES of the 11 th meeting of the Committee of Adjustment held in the Committee Room of
the Pickering Civic Complex on Wednesday, August 10, 1994.

The Meeting convened at 7:05 p.m. in the Committee Room of the Civic Complex.
1. MATTERS ARISING FROM THE MINUTES
There were no matters arising from the minutes.
2. ADOPTION OF MINUTES
MOTION: Moved by Mrs. Scorer, seconded by Mr. Bhuta and carried unanimously-

That the minutes of the 9th and 10th meetings of the Committee of Adjustment held
July 20, 1994 and June 29, 1994,be adopted.
3. PICA 72/94 - M. & M. Watson
Lot 45, Plan 820
Also known as 1732 Spruce Hill Road)
The applicants request relief from the provisions of:
a) Section 9.2.1 of By-law 3036 to permit the continuance of a mInImUm frontage of
15.4 metres; whereas the By-law requires that a lot provide a minimum frontage of 18
metres.
b) Section 5.18(d) of By-law 3036 to permit the establishment of 1.5 metre side yard widths;
whereas the By-law requires that a dwelling with an attached garage provide minimum side
yards of 1.8 metres.
Approval of this variance application is required in order to bring the subject property into
compliance with the provisions of the By-law and to obtain a building permit for the construction
of a new dwelling (approximately 220 m2). The existing dwelling on the lot will be demolished.

Mr. Mike Watson was present to represent the application. The Secretary-Treasurer outlined
comments received from the Town of Pickering Planning Department, CN North America
Engineering and Environmental Services (CN) and Mr. A.C. Wong, Region of Durham Health
Department.
Mr. Watson indicated that he would co-operate with the CN to satisfy their concerns regarding
the variances.

DECISION: Moved by Mrs. Scorer and seconded by Mr. Bhuta and carried that-
this application, PICA 72/94, by M. and M. Watson, as outlined, be APPROVED on the grounds
that the variances are minor in nature, appropriate for the desirable development of the land, and
in keeping with the general intent and purpose of the Durham Regional Official Plan, the
Pickering District Plan and Sections 9.2.1 and 5.18(d) of Zoning By-law 3036, subject to the
following conditions:

1. That the variances apply only to the proposed dwelling as generally shown with this
application.
2. That the existing dwelling be demolished within twelve months of the date of this decision.
4. PICA 74/94 - The Regional Municipality of Durham
(Metro Toronto Police Credit Union Limited)
Part of Lot 26, Range 3, B.F.C. and Part of Road
Allowance between Concession 1 and Range 3, B.F .C.
(Parts 6 to 13, 40R-I090)
(Northeast corner of Kingston Road and Merritton Road)
The applicant requests relief from the provisions of Section 5.2.(a) of amending By-law 2498/87
to Zoning By-law 3036 to permit the establishment of a financial institution on the subject
property; whereas the By-law permits a business office or a professional office use.
The applicant requests this variance application in order to allow a financial institution (a credit
union) to carry on a business on the site of the former police station. As a financial institution is
... not a use which is expressly permitted by the zoning by-law, the applicant requests that the
definition of a business office or a professional office be interpreted to permit a financial
institution.
Mr. E.M. Barradas of Miller Thomson, Barristers and Solicitors, was present to represent the
application. Mr. Henry Schmidt, was also present in support of the application. No further
representation was present in favour of or in objection to the application.
The Secretary-Treasurer outlined comments received from the Town of Pickering Planning
Department, the Region of Durham Health Department and the Ministry of Transportation.
Mr. Barradas advised the Committee that the use of a credit union for the subject property is
similar to a business or professional office. He also advised that the proper name for the credit
union is now "The Police Credit Union Limited".
Mr. Bhuta inquired if the present structures on the lands are intended to be demolished.
Mr. Barradas indicated that the former police station is intended to be demolished and a
completely new structure is to be constructed.
DECISION: Moved by Mr. Bhuta and seconded by Mrs. Scorer and carried that -
... this application, PICA 74/94, by The Regional Municipality of Durham (Metro Toronto Police

APPROVED on the grounds that the variance is minor in nature, desirable for the appropriate
development of the land and in keeping with the general intent and purpose of the Durham

5. PICA 75/94 -C. Smith
Lot 28, Plan 270
Also known as 532 Marksbury Road
The applicant requests relief from the provisions of:
"...,
a) Section 1 0.2.3 of By-law 2511 to permit the continuance of a minimum front yard setback
of 5.5 metres; whereas the By-law requires that a lot provide a minimum front yard setback
of 7.5 metres.
b) Section I 0.2.4 of By-law 2511 to permit the continuance of a dwelling with a minimum
ground floor area of 81 m2; whereas the By-law requires that a one-storey dwelling provide
a minimum ground floor area of 95 m2.
c) Section 10.2.5 of By-law 2511 to permit the continuance of a one-storey dwelling with a
minimum floor area of 81 m2; whereas the By-law requires that a one-storey dwelling
provide a minimum floor area of95 m2.
The applicant has requested this variance application in order to bring the subject property into
compliance with the provisions of the By-law and to obtain a building permit for the construction
ofa 47.9 m2 garage.
The applicant, Mr. C. Smith, was present to represent the application. No further representation
was present in favour of or in objection to the application.
The Secretary-Treasurer outlined comments received from the Town of Pickering Planning
Department. The Secretary-Treasurer noted that the word "one-storey" is to be omitted from
paragraph "b" - first line.
DECISION: Moved by Mr. Bhuta and seconded by Mrs. Scorer and carried that-
this application, PICA 75/94, by C. Smith, as outlined, be APPROVED, on the grounds that the
.......... front yard depth (with uncovered steps projecting 1.5 metres into the front yard), ground floor
area and total floor area variances to be minor in nature, appropriate for the desirable
development of the land, and in keeping with the general intent and purpose of the Durham
Regional Official Plan, the Pickering District Plan and Sections 10.2.3, 10.2.4 and 10.2.5 of
Zoning By-law 2511 subject to the following condition:
1. That these variances apply only to the dwelling in existence on the date of this decision.
6. PICA 76/94 - R. and V. Trevurza
Part of Lot A, Concession 9
Also known as 3480 Regional Road No.5
(north side of Durham Regional Road No.5 near
Durham Regional Road No. 23)
The applicant requests relief from the following provisions, as varied by PICA 41/79 and PICA
66/87:
1. Section 6.2.1 of By-law 3037 to permit the establishment of a maximum lot coverage of
13.35% for all buildings on the subject lot; whereas the By-law requires a maximum lot
.... coverage of 10 percent for all buildings on the lot.
2. Section 5.18(a) of By-law 3037 to permit the establishment of an accessory structure
(proposed garage) to be located in the east side yard of the subject lot; whereas the By-law
requires that all accessory buildings which are not part of the main dwelling be erected in the
rear yard.
The applicants have requested this variance application in order to construct an addition to the
existing garage and to construct a second garage on the subject property.

Mr. G. Ash, of G.A. Consultants Ltd., was present to represent the application. The applicants
were also present to represent the application. No further representation was present in favour of
or in objection to the application.
The Secretary-Treasurer outlined comments received from the Town of Pickering Planning
Department, and Councillor R. Johnson, Regional Councillor, Ward 3, Town of Pickering.
Mr. Ash advised the Committee that Mr. Trevurza is a general building contractor and that the
structure(s) would be of high quality. He also advised that the proposed garage (and addition)
would be used for a hobby of restoring vintage cars.

DECISION: Moved by Mrs. Scorer and seconded by Mr. Bhuta and carried that-
this application, PICA 76/94, by R. and V. Trevurza , as outlined, be APPROVED on the
grounds that the variances are minor in nature, appropriate and desirable development of the
lands, and in keeping with the general intent and purpose of the Durham Regional Official Plan,
the Pickering District Plan, and Sections 6.2.1 and 5.18(a) of Zoning By-law 3037, subject to the
following condition:
1. That these variances apply only to the buildings with proposed lot coverage as generally
shown on the plans submitted with this application.
7. PICA 77/94 - W. and R. Balmbra
Lot 769, Plan M-19
Also known as 974 Mink Avenue
The applicants request relief from the following provisions, as varied by PICA 22/80:
....
1. Sections 6.5(c) and 7.2.3 of By-law 2520 to permit the establishment of a 5.7 metre
flankage side yard width (deemed front yard by Section 6.5(c)) abutting Breezy Drive to be
provided by the proposed garage addition; whereas the By-law requires that a main building
(dwelling) erected on a comer lot, with its main front entrance facing the flank of the lot, provide
a flankage side yard width of 7.5 metres. The main building is deemed to have two front yards.
2. Section 7.2.3 of By-law 2520 to permit the establishment of a 2.8 metre front yard depth
abutting Mink Avenue to be provided by a proposed garage addition; whereas the By-law
requires that a dwelling provide a minimum front yard depth of7.5 metres.
The applicants have requested this variance application in order to obtain a building permit to
construct a garage with a sun room on the subject property.
Mr. Balmbra was present to represent the application. Ms. Donna Pascoe was also present to
represent the applicant. No further representation was present in favour of or in objection to the
application.
The Secretary-Treasurer outlined comments received from the Town of Pickering Planning
Department, Siegfried Wall and William Hinan.
Ms. Pascoe advised the Committee that Mr.Balmbra understood why the variances were
__ suggested to be revised from the original application, and agreed with the comments regarding
the application from the Town of Pickering Planning Department.
DECISION: Moved by Mrs. Kerr and seconded by Mr. Bhuta and carried that-
this application, PICA 77/94, by W. and R. Balmbra, as outlined, be APPROVED AS REVISED
to permit a flankage yard width of 6.0 metres and a front yard depth of 4.5 metres as the
variances are minor in nature, desirable for the appropriate development of the land, and in
keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering
District Plan and Sections 6.5(c) and 7.2.3 of Zoning By-law 2520, subject to the following
condition:

1. That these variances apply only to the eXlstmg dwelling and proposed additions as
generally shown on the plans submitted with this application, with revisions only to the
extent necessary to provide a flankage yard width of 6.0 metres and a front yard depth of
4.5 metres.
8. ADJOURNMENT
MOTION: Moved by Mrs. Kerr, seconded by Mrs. Scorer and carried unanimously-
That the 11th meeting of the Committee of Adjustment be adjourned at 7:50 p.m. and the next
regular meeting ofthe Committee of Adjustment be held on Wednesday, August 31, 1994.
