MINUTES of the 12th meeting of the Committee of Adjustment held in the Committee Room of
the Pickering Civic Complex on Wednesday, August 31, 1994.

The Meeting convened at 7:00 p.m. in the Committee Room ofthe Civic Complex.
1. MATTERS ARISING FROM THE MINUTES
There were no matters arising from the minutes.
2. ADOPTION OF MINUTES
MOTION: Moved by Mr. Puterbough, seconded by Mrs. Kerr and carried unanimously-
~ That the minutes of the 11th meeting of the Committee of Adjustment held August 10 1994,be
adopted.
3. APPOINTMENT OF ACTING CHAIRPERSON
MOTION: Moved by Mr. Bhuta, seconded by Mr. Puterbough and carried unanimously-
That due to the absence of Ms. S. Archer, Chairperson of the Committee of Adjustment, that
Mrs. C. Scorer be appointed Acting Chairperson of the Committee of Adjustment for the 12th
meeting held August 31, 1994 only.
4 PICA 73/94 - M. S. Currie
Part of Lot 35, Plan 1051 (Part 1, 40R-7475)
Also known as 1755 Appleview Road)
The applicant requests relief from the provisions of Section 5.18(d) of By-law 3036 to permit the
continuance of a .77 metre north side yard; whereas the By-law requires that a dwelling with an
attached garage provide a minimum side yard width of 1.8 metres.
The applicant has requested this variance application in order to bring the subject property into
....... compliance with the provisions of the Zoning By-law.
The Acting Secretary-Treasurer outlined comments received from the Town of Pickering
Planning Department.
Mr. H. Storm was present to represent the application. No further representation was present in
favour of or in objection to the application.

DECISION: Moved by Mrs. Kerr and seconded by Mr. Puterbough and carried that-
this application, PICA 73/94, by M. S. Currie, as outlined, be APPROVED on the grounds that
the variance is minor in nature, appropriate for the desirable development of the land, and in
keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering
District Plan and Section 5.18( d) of Zoning By-law 3036, subject to the following condition:
1. That the variance apply only to the proposed dwelling in existence on the date of this
decision.

The applicant requests relief from Section 5.(2)(a) of amending By-law 2349/87 to By-law 3036
to permit the establishment of a driving instruction school on the subject property; whereas the
By-law permits a business office or a professional office use.
The applicant requests this variance application to allow a driving instruction school to carry on a
business on the site. A driving instruction school is not a use which is expressly permitted by the
zoning by-law; the applicant requests that the definition of a business office or a professional
office be interpreted to permit a driving instruction school.
The Acting Secretary-Treasurer outlined comments received from the Town of Pickering
Planning Department.

Mr.A. Brown was present to represent the application. No further representation was present in
favour of or in objection to the application.
Mrs. Scorer indicated that adding a definition is very difficult to weigh and that she has trouble
with this as it does not come under the jurisdiction of the Committee of Adjustment. She also
mentioned that she feels the definitions given by the Town are too restrictive, giving specific
names ~d uses. She also indicated that she felt that the proposed use is compatible with other
uses in the building.
DECISION: Moved by Mrs. Kerr, seconded by Mr. Puterbough and carried that-
this application, PICA 79194, by 833752 Ontario Inc., as outlined, be APPROVED on the
grounds that the variance is minor in nature, appropriate for the desirable development of the
land, and in keeping with the general intent and purpose of the Durham Regional Official Plan,
the Pickering District Plan and Section 5.(2)(a) of amending Zoning By-law 2349/87 to By-law
3036 subject to the following condition:
1. That this variance apply only to the proposed driving school which is the subject of this
application.

PICA 80/94 - K. and E. Weber

The applicants request relief from the provision of Section 7.2.3 of By-law 2520 to permit the
establishment of a front yard depth of 5.7 metres to be provided by a proposed sunroom; whereas
the By-law requires that a dwelling provide a minimum front yard depth of7.5 metres.
The applicants request this variance application in order to construct an addition (sunroom) to the
existing dwelling on the subject property.

The Acting Secretary-Treasurer outlined comments received from the Town of Pickering
Planning Department and from Mr. Bowen, 707 Annland Street, who indicated his objection to
the application.
Mr. C. Channon of Carroll Home Improvements was present to represent the application. The
applicant, Mr. K. Webber was also present to support the application. Mr. D. Matthews, 714
Annland Street was also present.
Mr. Channon indicated that Mr. & Mrs. Weber had hired his company to build a sunroom as they
'-' wished to have an enclosed area for removal of boots, etc.
Mr. Matthews indicated that he felt that the proposed sunroom was an attack on his privacy and
felt that the erection of an 8 foot fence between the two houses would alleviate this situation.
Mrs. Scorer advised Mr. Matthews that it was not possible to change an application and he
should speak with Municipal Law Enforcement regarding the permitted height of a fence.
Mr. Matthews indicated that he had already been in contact with Municipal Law Enforcement
and had been advised that the permitted height for a fence was 6 feet. Mr. Webber, the applicant,
indicated that he felt Mr. Matthews' idea for a fence between the two properties was a good idea.
DECISION: Moved by Mr. Puterbough, seconded by Mr. Bhuta and carried that-
this application, PICA 80194, by K. and E. Weber, as outlined, be APPROVED, on the grounds
that the variance is minor in nature, appropriate for the desirable development of the land, and in
keeping with the general intent and purpose of the Durham Regional Official Plan, the Pickering
District Plan and Section 7.2.3 of By-law 2520 subject to the following condition:
1. That the proposed variance apply only to the existing dwelling with an addition as
generally shown on this application.

The applicant requests relief from the provisions of Section 5.(2)(d)(i)A of amending By-law
4271/93 to By-law 3036 to permit the continuance of an interior side yard width of 1.11 metres;
whereas the By-law requires that a dwelling provide a minimum interior side yard width of 1.2
metres.
The applicant has requested this variance application in order to bring the subject property into
compliance with the provisions of the zoning by-law.
The Acting Secretary-Treasurer outlined comments received from the Town of Pickering
Planning Department.
Mr. G. Daniel was present to represent the application. No further representation was present in
favour of or in objection to the application.
DECISION: Moved by Mr. Bhuta, seconded by Mrs. Kerr and carried that-

Pickering District Plan, and Section 5(2)(d)(i)A of amending By-law 4271/93 to By-law 3036,
subject to the following condition:
1. That this variance apply only to the dwelling in existence on the date of this decision.

8. ADJOURNMENT
MOTION: Moved by Mr. Puterbough, seconded by Mrs. Scorer and carried unanimously-
That the 12th meeting of the Committee of Adjustment be adjourned at 7:25 p.m. and the next
regular meeting of the Committee of Adjustment be held on Wednesday, September 21, 1994.
