MINUTES of the 15th meeting of the Committee of Adjustment held in the Committee Room of
the Pickering Civic Complex on Wednesday, November 2, 1994.

Item 4, PICA 93194 - A. Tyukodi, on the November 2nd agenda was deferred to the meeting of
November 23, 1994 at the request of the applicant.
The Meeting convened at 7:00 p.m. in the Committee Room ofthe Civic Complex.
1. MATTERS ARISING FROM THE MINUTES
There were no matters arising from the minutes.
2. ADOPTION OF MINUTES
MOTION: Moved by Mr. Bhuta, seconded by Mr. Puterbough and carried unanimously-
That the minutes of the 14th meeting of the Committee of Adjustment held October 12, 1994, be
adopted.

3. PICA 92/94 - Satya Sanatan Dharma Cultural Sabha of Canada
Part of Lot 9, Plan 585
Also known as 2590 Brock Road
Town of Pickering
The applicant requests relief from the provisions of the following:
1. Section 5.15 of the By-law to permit the establishment of a minimum north side yard width
of 2.4 metres to be provided by the proposed building, whereas the by-law requires that a
building provide a minimum side yard width of 7.5 metres.
2. Section 2.48 of the By-law to permit the establishment of a parking space size of 13.7 square
metres (2.6 m. x 5.3 m.) for the parking spaces to be provided on the subject property,
whereas the by-law requires that a parking space be of a size of not less than 18 square
metres.
The applicant requests this variance application in order to construct a building (religious
institution) on the subject property. It is the intent of the applicant to demolish the existing
structure on the subject property.

Mr. K. Doolsingh, on behalf of the owner, was present to represent the application.
Mr. A. Binda, the agent, was also present to represent the application.
The Secretary-Treasurer outlined comments received from the Town of Pickering Planning
Department and the Region of Durham Health Department. The agent for the applicant was
provided with a copy of all comments received.

DECISION: Moved by Mr. Bhuta and seconded by Mr. Puterbough and carried that-
this application, PICA 92/94, by Satya Sanatan Dharma Cultural Sabha of Canada, as outlined
be, APPROVED on the grounds that the application is minor in nature, desirable for the
appropriate development of the land, and in keeping with the general intent and purpose of the
Durham Regional Official Plan, the Pickering District Plan, and Sections 5.15 and 2.48 of
Zoning By-law 3037, subject to the following condition:

1. That the owners obtain final site plan approval for the development as generally outlined on
the plans submitted with this application, paying particular attention to screening and
landscaping on the north property line, within twenty-four months of the date of this
decision, or the north side yard width variance approval will become null and void.
5. PICA 94/94 - OLCO Petroleum Group Inc.
Part of Lot 18, Concession 1

The applicant requests that the Committee permit the extension of the lawful non-conforming
uses on the subject property, including a propane gas tank proposed to be located at the rear of
the subject property; whereas the By-law permits a variety of industrial/commercial uses on the
subject property. The zoning by-law does not permit a gas bar or residential uses; however these
exist on the property as legal non-conforming uses..
The Secretary-Treasurer outlined comments received from the Town of Pickering Planning
Department.
Mr. M. Martin, of Provincial Propane Incorporated, was present to represent the application.
Mr. M. Teschner, 2097 Liverpool Road, was present in objection to the application.

Mr. Martin advised that the proposed propane tank and sales facility location at the northwest
comer of the property was acceptable to the provincial fuel safety branch and was the best
location on the property.
Mr. Teschner, owner of the westerly abutting property, stated his concerns that a propane
dispensing operation at this location could adversely affect a future restaurant use of his property
due to odours and traffic.
Mr. Martin advised that there would be little or no propane odours, and that the proposed
location of the tank at the rear of the property would be the best spot as it would likely be
adjacent to a future parking area on Mr. Teschner's property.
Mr. Cole advised that if and when Mr. Teschner's property is developed for a restaurant use,
landscaping and curbing would be installed to minimize impacts between the two properties.
DECISION: Moved by Mrs. Scorer and seconded by Mr. Puterbough and carried unanimously
that -
this application, PICA 94/94, by Oleo Petroleum Group Inc., as outlined, be APPROVED on the
grounds that the proposed use is similar to the purpose for which the property was used for on the
day the zoning by-law was passed, and therefore recommends approval subject to the following
condition:

1. That this variance apply only to existing buildings and uses, and a vertical propane storage
tank and sales facility as shown on the plans submitted with this application.

6. ADJOURNMENT
MOTION: Moved by Mr. Puterbough, seconded by Mr. Bhuta and carried unanimously-
That the 15th meeting of the Committee of Adjustment be adjourned at 7:30 p.m. and the next
regular meeting of the Committee of Adjustment be held on November 23, 1994.
