STATUTORY PUBLIC INFORMATION MEETING MINUTES

Linda Taylor, Manager, Current Operations Division, acted as the facilitator for this
meeting and gave an overview to the public of what is involved with a Statutory Public
Information Meeting.

(I) ZONING BY-LAW AMENDMENT APPLICATION A 29/93

LOTS 30 AND 31. PLAN 331
1. An explanation of the application, as outlined in Information Report No 21/94,
was given by Jeff Cole, Planner II.
2. Fitzroy Johnson, the applicant, stated that what is being requested in this
application is not significantly different than what is on the property at the present
time. He hopes to make the property look better and stated that no previously
owner has brought this property up to the standard that he has. The commercial
uses being requested will not be significant because only a laundromat use will be
added.

Cyril Beasley, 669 Marksbury Road, stated that the applicant was planning to
propose a much more intensive application but he could only accept an application
that provided for three commercial units and three apartments. He is concerned
about the noise barrier between his property and that of the applicant and what will
happen to any old gas tanks that are buried on the property. He did acknowledged
that the applicant keeps the property clean and hoped that there is something the
Town could do about people loitering at the store.

4. Cassim Ebrahim, 689 Marksbury Road, stated that he is concerned that an
expansion to the present use will increase the traffic from vehicles, pedestrians and
animals. There is a school in the vacinity and children visiting the store during
breaks at school leave debris on his property.
5. Dieter Maier, 728 Marksbury Road, stated that traffic on Marksbury Road will
increase from increased uses at the store.
6. Nick Bigioni, representing the Fairport Beach Ratepayers Association,
recommended the approval of this application because the applicant has improved
the property so much. No resident wants a store at this location, however, it is a
legal non-conforming use at present and it is there to stay.

Fitzroy Johnson, the applicant, stated that he was glad to hear the comments from
the residents and he feels that he has earned the right to continue to operate at the
present location.

(ll) ZONING BY-LAW AMENDMENT APPLICATION A 23/93

1. An explanation of the application, as outlined in Information Report No. 23/94,
was given by Valerie Rodrigues, Senior Planner.
2. Jeff Solley, representing the applicant, stated that he was present to answer
questions.
3. Richard Ward, Box 5142, Claremont, stated that he is concerned about present
uses on the subject lands that do not conform to the Zoning By-law. He is
concerned about the impact some of the present and proposed uses will have on
the main central area. He asked how a pinball game can be considered in the
definition of a "sports practice facility".

Paul Storeno, representing National Sports, stated that the terminology of "sports
practice facility" includes such games as baseball and basketball and that pinball is
not the main focus of the sports practice facility. A practice facility has been
located on the premises for the past two years but it has only been an issue for the
past sic months.

5. Valerie Rodrigues, Senior Planner, summarized by stating that the impact of the
proposed uses on the main central area is being investigated and that a sports
practice facility in the National Sports building complies with the Official Plan

1. An explanation of the application, as outlined in Information Report No. 22/94,
was given by Jeff Cole, Planner I.

Victor Lynde, representing the applicant, stated that he was present to answer any
questions.
3. Richard Ward, Box 5142, Claremont, asked if the existing uses on the property are
in conformity with the Zoning By-law and asked if the applicant would clearly
identify what is involved in the "place of amusement".
4. Jeff Cole, Planner I, stated that all existing uses on the subject property comply
with the Official Plan and indicated that there is a specific definition for a "place of
amusement" in the Zoning By-law.
5. Victor Lynde, representing the applicant, stated that the definition of a "place of
amusement" is in the Zoning By-law. He noted that gambling is strictly controlled
by the senior levels of government. He has no specific "place of amusement" use
proposed; this zoning will only allow the applicant to seek a broader range of
tenants.

(IV) ZONING BY-LAW AMENDMENT APPLICATION A 5/94

1. An explanation of the application, as outlined in Information Report No. 20/94,
was given by Colin Ramdial, Planning Technician I.
2. An unidentified man asked where the park will be located. He also asked if the
balance of Garthwood's lands have been approved and if the houses are in
character with the existing houses.
