'" ........ ......... PRESENT: B. Taylor L. Taylor R Taylor - Town Clerk - Manager, Current Operations Division - Planning Technician (I) MINISTER'S ZONING ORDER AMENDMENT APPL. 18-Z0-0299504 T. DELLAPORTAS PART OF LOT 11, CONCESSION 5 (WEST OF WESTNEY ROAD. SOUTH OF SIXTH CONCESSION ROAD) 1. An explanation of the application, as outlined in Information Report #3/96, was given by Ron Taylor, Planning Technician. 2. Michael Minnet, representing the applicant, stated that the putpose of the application was to create one additional lot. He has hired an environmental consuhant to comment on water, septic systems and storm water runoff. He must prove to the Town and the Ontario Municipal Board that one extra lot can be created without adversely affecting the neighbours water supply, septic systems and property from storm water runoff. He must also prove that this newly created lot will be in character with the hamlet. He noted that this type of lot with only a driveway frontage on a public road is called a ''key lot" and is not unique in the hamlet of Greenwood. 3. Doug Morden, Concession 6 Road, stated that he abuts the subject lands and asked if only one family will be living in the house that will be built on the newly created lot. 4. Robert Cattle, 3595 Trimbles Lane, gave a history of previous land severance applications on the subject property and noted that one additional lot was created as a result of a compromise with the area residents. Although members of the same family will be living on the two present lots and on the newly created lot, what will happen when these are sold to non-family members and shared driveways may not be wanted. He felt that any other ''key lot" in the hamlet of Greenwood should not be used as a precedent because that lot would have been created in the 1800s. The subject lands cannot support a house with a septic system because storm water runoff will bring septic runoff onto his property. He asked if this application is refused by the Town but is appealed to the Ontario Municipal Board by the applicant, will the Town carry out its own studies. He stated that almost all homeowners in the hamlet are opposed to this application. 5. Raymond Binns, 3591 Trimbles Lane, stated that he agrees with the comments made by Robert Cattle. He noted that the Fire Department has objected to this application because it could not get a truck to turn in the driveway. This application could set a precedent for other severances in the hamlet. 6. lain McCully, 3594 Trimbles Lane, stated that the school boards are only circulated to determine the number of children that would likely be generated in a development. The grading of lots on Trimbles Lane has been designed for a 100 year storm. --2-- '-' 7. Jack Harman, 3597 Trimbles Lane, stated that he is concerned about the safety and security of his water supply. His water already dries up occasionally and he is concerned about bacteria in the water supply. He inquired into the history of the development standards that are set out in the Minister's Zoning Order. 8. Ron Taylor, Planning Technician, stated that the comments and petition from the residents will form part of the Planning Report and Council will make its comments to the Ministry of Municipal Affairs. 9. Michael Minnet, representing the applicant, stated that the comments he heard tonight are similar to the comments made on the original application. He explained that the application provides for frontage to consist of only driveways. He noted that consultants must look at the proposed property as well as the surrounding properties. The Ontario Municipal Board will consider the land severance and the Minister's Zoning Order at the same time and technical matters will also be considered at that time. "- (ll) ZONING BY-LAW AMENDMENT APPLICATION A 1/96 T.M. & J. FERRARI PART OF LOT 12, PLAN 819 (NORTHWEST CORNER OF FAIRPORT ROAD AND STROUDS LANE) 1. An explanation of the application, as outlined in Information Report #4/96, was given by Lynda Taylor, Manager, Current Operations Division. 2. Joe Montesano, representing the applicant, stated that the purpose of the application is the change the zoning from R3 to a zoning that would allow for the severance of the property into four separate residential lots. 3. Sylvia Spencer, 771 Sheppard Avenue, stated that no driveway in the newly created lots should go onto Fairport Road. The lot depth for the lot fronting onto Fairport Road should be deeper. She asked where a proposed road to create new lots to the north would go and side of Strouds Lane a sidewalk would be built on. She noted that other area residents also want to sever their properties. ......, 4. Joe Montesano, representing the applicant, stated that the road widenings being requested by the Town are an issue and will be addressed. (DI) ZONING BY-LAW AMENDMENT APPLICATION A 18/95 H. & Y. GRAY LOT 71, PLAN M-14 (NORTHEAST CORNER OF LWERPOOL ROAD AND TATRA DRWE 1. An explanation of the application, as outlined in Information Report #6/96, was given by Lynda Taylor, Manager, Current Operations Division. 2. Yvonne Gray, the applicant, stated that she has operated a hairdressing salon at 1105 Finch Avenue for the past eleven years and wants to locate at 925 Liverpool Road because it is a more efficient location. She provides hair case for the elderly and the disabled. ....., --3-- \w> 3. Gail Hart, 1325 Poprad Avenue, stated that there are already a number oflocations that would permit a hairdresser. This rezoning could set a precedent for other types of personal service businesses that are not compatible with the neighbourhood. 4. Bob Blair, 918 Naroch Boulevard, asked what types of business are included in the definition of "personal services". He would prefer that the use of this property be specified and that all uses under "personal services" be set out in the Zoning By- law. 5. Roy Robinson, 915 LiveIpool Road, stated that one of the commercial properties to the north of the subject lands is being used as a residence. The notices to neighbours should be specific and not vague. He asked why the draft Official Plan is being considered in this application when it has not yet been approved. He recommended that the use of the property be specified and asked if the Town received a letter of comment from the Pickering East Shore Community Association about the application. A small scale convenience store should not be permitted on this property and noted that parking is an issue. There are other hairdressing salons in the area and he is concerned about odours from these establishments. He spoke to a representative of Peace Lutheran Church who indicated that he is concerned their parking lot will be used by the patrons of this establishment. '- 6. Paul Crawford, 867 Antonio Street, stated that the commercial uses along LiveIpool Road are expanding and does not look aesthetically pleasing. This application could set a precedent for other similar commercial uses in the area. The parking lot on the subject lands is not pleasing to the eye and patrons park anywhere they can in the area. The Town should ensure that this and other commercial properties are properly landscaped. 7. Yvonne Gray, the applicant, stated that she needs more space than she currently has at the moment and noted that people will patronize a hairdresser that is convenient. She will provide ample parking and keep the property clean. \w> (IV) ZONING BY-LAW AMENDMENT APPLICATION A 2/96 JENNIFER DEGRAAUW PART OF LOT 5, REGISTERED PLAN 469 (SOUTH SIDE OF KINGSTON ROAD. EAST OF SOUTHVIEW DRIVE) 1. An explanation of the application, as outlined in Information Report #5/96, was given by Lynda Taylor, Manager, Current Operations Division. 2. Sylvia Spencer, 771 Sheppard Avenue, noted that if apartments are to be constructed across the street from the subject lands, it would create a dangerous situation for people trying to cross Kingston Road to reach the clinic. She inquired into the hours of operation and if drugs would be kept on site. The future building on the subject lands should be closer to the existing building. She inquired into the zoning of the lands on Notion Road and asked how a chiropractors office was started on this site. 3. Heather MacDonald, Kingston Road, stated that she owns the land to the west of the subject property. She is concerned that the parking lot may be raised and cause storm water runoff onto her property. She asked if a fence will be constructed to separate the properties. ~ ,-". Corky DeGraauw, representing the applicant, stated that a storm sewer outlet is located in the centre of the parking lot to catch storm water runoff and that the proposed building noted at the rear of the property would only be used temporarily.
