Mayor Arthurs read out a statement concerning the 1996 budget process and the audit process which was undertaken by the external Auditors. lID DELEGATIONS 1. Donna Bovolaneas, representing the Big Sisters Association of Ajax-Pickering, addressed the Committee with respect to Big Sisters Day which is to be held on June 1, 1996. This organization has served the Ajax/Pickering area since 1984. She outlined the upcoming activities; a trunk sale to be held on June 2nd, 9 a.m. to 3 .m. and a 20th Annual Golf Tournament taking place at the Four Seasons Golf Club in Claremont. She requested that June 1st be declared Big Sisters Day. ~ 41 (m DELEGATIONS 2. Victoria Caballero, representing the Frenchman's Bay Festival '96 Committee, addressed the Committee with respect to the Frenchman's Bay Festival Weekend to be held on June 8th and 9th. She thanked Council for their continued support and outlined the events to take place. 3. Marty Martel, 1580 Kingston Road, Unit #67, addressed the Committee with respect to access to various facilities for the physically challenged. Mr. Martel advised that many spots in various locations are not properly marked. He questioned why the by-law is not properly enforced, why vehicles can not be towed, and asked if vehicles are tagged at night as well as during the day. He recommended that signs be permanently placed in the ground in order that they cannot be moved and he suggested that permits have photo identification. '-' 4. Commodore Tony Buckley, representing PARU, addressed the Committee with respect to the purchase of a search and rescue vessel. He requested continued support of P ARU with respect to the purchase of a rescue vehicle. He stated that PARU is made up of volunteers who have assisted over 2,000 individuals and work closely with the Coast Guard, the Fire Department and the Police Department. They are proposing to purchase a 34' aluminum work boat. 5. Jim Dyke, representing the users of Lake Ontario and those benefiting from PARU outlined the circumstances which occur that creates the need for a rescue unit. He thanked Committee for their ongoing support and requested continued support. mn MATTERS FOR CONSIDERATION 1. DRAFT PLAN OF SUBDIVISION 18T-94014 REZONING BY-LAW AMENDMENT APPLICATION A 18/94 MONICA COOK ESTATE PART OF LOT 23, RANGE 3, B.F.C. FILE NUMBER - B 2310 - A 1/94 '-' In an Addendum to Planning Recommendation Report 4/96, it is recommended that modifications to Draft Plan of Subdivision 18T -94014 and Zoning By-law Amendment Application A 18/94, submitted by the Monica Cook Estate, on lands being Part of Lot 23, Range 3, B.F.C. be APPROVED Aooroved as amended See Recommendation #1. 2 & 3 Councillor Dickerson declared an interest as his orooertv backs onto the subiect lands Mr. Greenbaum, Urban Land Management, representing the applicant advised that they generally endorse all consensus items discussed with the residents at their meeting of April 30th. The building height was also agreed upon by the residents; 2 storeys not to exceed 9 metres. He requested that consideration be given to not limiting the number of double car garages. ~ 2. 42 DRAFT PLAN OF SUBDIVISION 18T-94023 ZONING BY-LAW AMENDMENT APPLICATION A 4/94 KELECK INVESTMENTS INCORPORATED PART OF LOT 20, PLAN 819, AND PART OF LOTS 61 & 62, PLAN 1041 (WEST SIDE OF FAIRPORT ROAD, SOUTH SIDE OF STROUD'S LANE) FILE NUMBER -B 4100 - B 2310 A 4/94 '-" In Recommendation Report 14/96, it is recommended that Council recommend to Regional Council that Draft Plan of Subdivision 18T-94023, submitted by Keleck Investments Incorporated on lands being Part of Lot 20, Plan 819, and Part of Lots 61 and 62, Plan 1041, be APPROVED AS REVISED. Aooroved as amended See Recommendation #4 & #5 David Brand, Principle of Keleck Investments, advised that the services and hydro utilities are already in place for Strouds Lane. He requested that staff be instructed to observe their lot lines and that the road and knuckle remain in its location. He questioned why staff are recommending a 5.0 metre flankage sideyard on Fairport Road when the guidelines call for only 4.5 metre. He requested that the minimum 4.5 metre flankage be approved. He also requested that a temporary turning circle be provided within the road allowance. Maria Javor, 872 Strouds Lane questioned why the applicant has submitted an application which is not within the guidelines. 3. DRAFT PLAN OF SUBDIVISION 18T-95039 ERIKA BEHRENDS PART OF LOT 128, PLAN 350 (NORTH SIDE OF TOYNEV ALE ROAD, EAST OF ROUGEMOUNT DRIVE) FILE NUMBER - B 4100 - 18T-95039 -- In Recommendation Report 15/96, it is recommended that Council recommend to Regional Council that Draft Plan of Subdivision 18T-95039, submitted by Ericka Behrends on lands being Part of Lot 128, Plan 350, be APPROVED AS REVISED. Deferred to Mav 27th. 1996 4. AMENDMENT NUMBER 89 TO PICKERING DISTRICT PLAN (OFFICIAL PLAN AMENDMENT APPLICATION 94-013/P) (ZONING BY-LAW AMENDMENT APPLICATION A 13/94) WALNUT GROVE PLAZA INC. P ART OF LOT 24, CONCESSION 1 (SOUTH SIDE OF KINGSTON ROAD OPPOSITE WALNUT LANE) FILE NUMBER - B 2310 ~ In Planning Report 13/96, it is recommended that in order to facilitate the Region of Durham's final approval of Amendment Number 89 (OPA 94-013/P) to the Pickering District Plan, Council concur with maintaining the option for a full public road opposite Walnut Lane through an appropriate development agreement. Aooroved See Recommendation #6 43 Richard Cornblum, owner of Walnut Grove Plaza Inc. advised that the Region of Durham has requested the option for a roadway or walkway be open. If the Town approves this option they will agree to installing lights at Hwy. 2 and Walnut Lane. He also advised that his company have agreed to paying half the cost of this installation. .... Larry Brien, President of the Liverpool West Community Association thanked Mr. Cornblum and Peter Bozak in their corresponding with the L WCA and also for assisting in beginning the petition. He stated that the L WCA strongly endorses lights at this intersection and that they are concerned with the Region's condition for a full public road. He requested that traffic traveling northbound on this road be prohibited from continuing north on Walnut Lane. 5. OFFICIAL PLAN AMENDMENT APPLICATION 95-00l/P DRAFT PLAN OF SUBDIVISION l8T-950l2 ZONING BY-LAW AMENDMENT APPLICATION A 5/95 SHRONE VIEW HOLDINGS INC. PART OF LOT 19, CONCESSION 2 (SOUTHWEST CORNER OF BROCK ROAD AND THIRD CONCESSION ROAD) FILE NUMBER - B 2310 - A 5/95; l8T-950l2; OPA 95-00l/P In Recommendation Report 16/96, it is recommended that Council recommend to Regional Council that Official Plan Amendment Application 95-00l/P, Draft Plan of Subdivision 18T-95012 and Zoning By-law Amendment Application A 5/95, submitted by Shrone View Holdings Inc. on lands being Part of Lot 19, Concession 2, be APPROVED, and that the draft by-law to adopt Amendment No. 91 to the Pickering District Plan be forwarded to Council for enactment. PICKERING DOWNTOWN CORE: A LAND USE AND URBAN DESIGN STUDY STATUS REPORT AND REQUEST TO INVESTIGATE THE MANDATE AND COMPOSITION OF A "DOWNTOWN COMMITTEE" FILE NUMBER - B 2310 - A 16/94 It is recommended that IDT Report #3/96 be received and that the Pickering Downtown Core Interdepartmental Study Team be requested to report on the possible mandate and composition of a "Downtown Committee". AGREEMENT WITH COCA COLA BOTTLING LTD FILE NUMBER - D 3310 .'-' In Parks and Facilities Report PF 004/96, it is recommended that the Town enter into an agreement with Coca Cola Bottling Ltd. for exclusive right to supply soft drink beverages and vending services in various Town facilities in exchange for which the Company will make certain contributions to the Town. U Search and Rescue Vessel be authorized. Councillor Johnson advised that the Whitevale Spring Festival is being held on May 25th from 12-5 p.m 2. Councillor Johnson advised that the Osteoporosis Walk, which took place on May 11th, was a great success. 3. Councillor Dickerson advised that Big Sisters will be holding a trunk sale at Cleamet on June 2nd. 4. Councillor Brenner advised that a Notice of Motion would be coming forward concerning signage at Whites Road and Hwy. 2. 5. The following items were discussed prior to the regular meeting: "-' a) The Town Manager advised of structural problems at the Greenwood Library and stated that the Library would be working out of the Greenwood Community Centre for a period of time. b) The Town Manager introduced Mr. Irwin of the I.B.I. Group who gave a brief outline of the process his firm would proceed with in respect to the proposed Seaton Community. DRAFT PLAN OF SUBDIVISION 18T-94014 REZONING BY-LAW AMENDMENT APPLICATION A 18/94 MONICA COOK ESTATE PART OF LOT 23, RANGE 3, B.F.C. FILE NUMBER - B 2310 - A 1/94 '-" That Town Council recommend to Regional Council, that Draft Plan of Subdivision 18T -94014 submitted by the Monica Cook Estate, on lands being Part of Lot 23, Range 3, B.F.C., Town of Pickering, be APPROVED subject to the following conditions: 1.0 GENERAL CONDITIONS 1.1 That this recommendation apply to the plan identified as the Town Recommended Plan, and bearing the Town's recommendation stamp dated May 21, 1996; 1.2 That the owner submit a draft 40M plan to the satisfaction of the Town. 2.0 PRIOR TO THE REGISTRATION OF THE PLAN 2.1 That the owner enters into a subdivision agreement with and to the satisfaction of the Town that shall include, but not necessarily be limited to the following: - 2.1.1 Storm Drainage (a) satisfaction of the Director of Public Works respecting a stormwater drainage and management system to service all the lands in the subdivision, and any provisions regarding easements; (b) that the owner satisfy the director of Public Works respecting the consulting engineers' comments regarding stormwater management measures and to undertake and guarantee the construction of any work necessary as determined by the Director of Public Works to provide the appropriate permanent storm sewer connections; 2.1.2 Grading Control and Soils (a) satisfaction of the Director of Public Works respecting submission and approval of a grading and control plan, with special emphasis on coordinating grades with the adjacent residential lands and minimizing impacts on perimeter tree stands; (b) satisfaction of the Director of Public Works respecting submission and approval of a geotechnical soils analysis; '-' 2.1.3 Road Allowances (a) satisfaction of the Director of Public Works respecting restoration of existing roads, curbs and boulevards on Liverpool Road, including cleaning, installation of utilities or reinstallation of existing utilities, installation and paving of driveway aprons, tree planting, grading and sodding; 2 (b) satisfaction of the Director of Public Works respecting construction of internal roads with curbs, storm sewers, sidewalks and boulevard designs with an 18.5 metre right-of-way, to maximize front yard space without impeding services or the safe operation of the streets; 2.1.4 ConstructionlInstallation of Town Works & Services (a) satisfaction of the Town respecting arrangements for the provision of all services required by the Town; ~ (b) satisfaction of the appropriate authorities respecting arrangements for the provision of underground wiring, street lighting, cable television, natural gas and other similar services; 2.1.5 Dedications/Transfers/Conveyances (a) the dedication of all road allowances with proper corner roundings and sight triangles to the Town; (b) that the owner convey to the Town: (i) Blocks 28 & 29 for 0.3 metre reserves; (ii) any other easements as required; 2.1.6 Tree PreservationIPlanting the submission of a tree preservation and street tree planting program to the satisfaction of the Town; 2.1.7 Design Planning '-" (a) the satisfaction of the Director of Planning respecting a report outlining siting and architectural design objectives for the development to be completed and approved prior to the execution of the Subdivision Agreement; (b) the submission of architectural drawings identifying how each unit meets the objectives of the report, prior to the issuance of any building permit for the construction of a residential unit on the lands; ( c) the report outlining siting and architectural design objectives for the development must address, but is not limited to the items listed in Section 3.0 of the Recommended Conditions of Approval for Siting and Architectural Design Statement for Draft Plan of Subdivision I8t-940I4; 2.1.8 Parkland Dedication the satisfaction of the Town regarding cash-in-lieu arrangements for required parkland dedication; W' 2.1.9 Existing Buildings (a) satisfactory arrangements must be made with the Town regarding the removal and/or demolition of all structures on the subject property; 3 (b) prior to issuance of a Demolition Permit, the owner will grant a minimum of 48 hours site access for Heritage Pickering or an approved alternate, to inspect and remove any objects it deems as possessing merit of historic or architectural significance. The two parties will select a mutually agreeable time period; (c) satisfy the Town regarding the erection of a plaque describing these lands as the previous place of residence of Monica Cook, and outlines the significance and contributions of Monica Cook to the Pickering community; -- 2.1.10 Development Charges satisfaction of the Town financially with respect to the Development Charges Act; 2.1.11 Street Naming that the street within the draft plan be named to the satisfaction of the Town and Region and be dedicated as public highway under the jurisdiction of the Town upon registration of the plan; 2.1.12 Construction Traffic that construction traffic be restricted wherever possible to ensure that construction traffic serving the development of this plan does not use roads in the southerly, northerly and westerly adjacent lands having occupied residential units fronting thereon; -- 2.1.13 Fencing that the owner construct at his own expense, to the satisfaction of the Town, a 1.8 metre high wood screen privacy fence along the rear lot line of lots 1 to 27 inclusive, to be designed and constructed such that the fence does not interfere with recommendations of a Tree Preservation Plan; 2.1.14 Cultural Heritage Assessment to the satisfaction of the Ministry of Culture, Tourism and Recreation the undertaking of a Cultural Heritage Resource Assessment. 2.1.15 Deed Restrictions that the owner, at his own expense, place restrictions on deeds of created lots which address continued tree preservation and the prohibition of rear yard second storey decks. ~ 4 DRAFT PLAN OF SUBDIVISION 18T -94014 REZONING BY-LAW AMENDMENT APPLICATION A 18/94 MONICA COOK ESTATE PART OF LOT 23, RANGE 3, B.F.C. FILE NUMBER - B 2310 - A 1/94 2. That Zoning By-law Amendment Application A 18/94 submitted by the Monica Cook Estate, on lands being Part of Lot 23, Range 3, B.F.C., Town of Pickering, be APPROVED to implement development as proposed by Draft Plan of Subdivision 18T-94014, subject to the following conditions: ~ 1.0 That prior to the forwarding of an implementing zoning by-law to Town Council, Draft Plan of Subdivision 18T -94014 receive draft approval by the Region of Durham, and a Draft 40M plan be submitted to the satisfaction of the Town Planning Department. 2.0 That the implementing zoning by-law shall include, but not necessarily be limited to the following: (a) (b) (c) (d) (e) (f) (g) '-" (h) the maximum projection of the garage front entrance from the main front wall is not to exceed 2.2 metres in length; the maximum height of any dwelling is not to exceed 9.0 metres; the minimum front yard setback of the dwelling to the main front wall is 4.5 metres and 6.0 metres to the garage front entrance; the minimum rear yard setback for lots 20 to 27 inclusive is 10.0 metres; the minimum rear yard setback for lots 1 to 19 inclusive is 7.5 metres; the minimum side yard setbacks are 0.6 metres and 1.2 metres; the maximum permitted coverage for any lot is not to exceed 40%; and rear yard decks on the second storey of any dwelling are not permitted. DRAFT PLAN OF SUBDIVISION 18T -94014 REZONING BY-LAW AMENDMENT APPLICATION A 18/94 MONICA COOK ESTATE PART OF LOT 23, RANGE 3, B.F.C. FILE NUMBER - B 2310 - A 1/94 3. 1.0 That prior to the execution of the Subdivision Agreement for Draft Plan of Subdivision 18T-94014, the Director of Planning will review and approve a Siting and Architectural Design Statement as established by Section 3.0. 2.0 That the submission of architectural drawings will identify how each unit meets the objectives of the Design Statement, prior to the issuance of any building permit for the construction of a residential unit on the lands. 3.0 That the Siting and Architectural Design Statement shall include, but not necessarily be limited to the following: '-" (a) streetscape concerns on lots 11 to 18 inclusive are to be mitigated through staggered setbacks; (b) comer lots 1 and 27 will receive special attention to frontage and flankage details addressing both frontages; the main front entrance and face of the dwellings will be oriented towards Liverpool Road with access from Street ' A'; consideration will be given to providing habitable space over the garages; 5 (c) in addition, the Design Statement will consider and address: the utilization of twin driveways where possible; the use of habitable space over the garages of some units; the requirement of a minimum 40% landscaping for the front yard; the use of front porches; the design of living space drawn as far forward as possible; and, the use of design elements that enhance the appearance of front entrance and landings and presents a common theme or image throughout the streetscape. ,.., 4.
