The following persons addressed the Committee in support of Waste Reduction Week to be held on November 4 - 10, 1996: a) Lorraine Roulston, a representative of the Waste Reduction Committee, outlined the events which will take place during Waste Reduction Week. b) Martin Olenroot, representing the Town of Ajax presented a challenge to Pickering to see which municipality could have the least waste per capita for the month of November. -- c) Joe Dickson, a representative of the Waste Reduction Committee, acknowledged the efforts of Council in the past number of years and advised that a challenge had been presented to the Region of Durham for all municipalities within the Region. 77 am MA TIERS FOR CONSIDERATION 1. DRAFT PLAN OF CONDOMINIUM 18CDM-95004 PICKDRED INVESTMENTS LIMITED (SOUTHVIEW GARDENS) LOT 3, AND PART OF LOTS 4 & 5, REGISTERED PLAN 469, PART OF LOT 17, CONCESSION 1 (SOUTH SIDE OF KINGSTON ROAD, EAST SIDE OF SOUTHVIEW DRIVE) FILE NUMBER - B 4100 - 18CDM-95004 '-' In Planning Recommendation Report 26/96, it is recommended that Council recommend to Regional Council that Draft Plan of Condominium 18CDM-95004, submitted by Pickdred Investments Limited, on lands being Lot 3, and Part of Lots 4 and 5, Registered Plan 469, Part of Lot 17, Concession 1, be APPROVED Aooroved See Recommendation #1 2. ZONING BY-LAW AMENDMENT APPLICATION A 1/96 T., M. AND 1. FERRARI PART OF LOT 12, PLAN 819 (NORTHWEST CORNER OF FAIRPORT ROAD AND STROUDS LANE) FILE NUMBER - B 2310 - A 1/96 '-' In Planning Recommendation Report 25/96, it is recommended that Zoning By- law Amendment Application A 1/96, submitted by T., M. and 1. Ferrari, on the subject property, known as Part of Lot 12 Plan 819, be APPROVED AS REVISED to rezone lands to permit the development of three lots for detached residential dwellings with performance standards consistent with the Dunbarton Neighbourhood Development and Design Guidelines. Aooroved as amended See Recommendation #2 Sylvia Spencer, 771 Sheppard Avenue advised the Committee that she was pleased to see that this application was reduced from four lots to three and that these lots would not front onto Fairport Road. She was also please to see that lights were to be installed. 3. LAND SEVERANCE APPLICATIONS LD 173/96 AND 174/96 ZAKI AMMOURY P ART OF LOT 5, PLAN 282 (EAST SIDE OF PINE GROVE AVENUE) FILE NUMBER - B 2310 - LD 173/96 AND LD 174/96 In Planning Report 25/96, it is recommended that Council be informed of the recent approval of the Land Severance Applications LD 173/96 and LD 174/96 by the Durham Land Division Committee, contrary to the recommendations of the Planning Department. -- Approved See Recommendation #3 78 4. LICENCE AGREEMENT - PICKERING RECREATION COMPLEX PICKERING HOCKEY FILE NUMBER - D-331 0 .... In Legal Services Report L 121/96, it is recommended that a draft by-law to authorize the execution of a Renewal Concession Licence Agreement between Pickering Hockey Association Incorporated and the Town respecting the operation by that organization of the snack bar concessions at the Pickering Recreation Complex from September 1, 1996 to August 31, 1999, be forwarded to Council for enactment. By-law forwarded to Council 5. EXEMPTION OF BLOCKS 51 AND 52, PLAN 40M-1507 CASTLELOCH DEVELOPMENTS INC. FROM PART LOT CONTROL FILE NUMBER - D 2310 In Legal Services Report L 122/96, it is recommended that a draft by-law to exempt Blocks 51 and 52, Plan 40M-1507 from part lot control, be forwarded to Council for enactment. ROAD DEDICATION BLOCK 222, PLAN 40M-1499 MARSHCOURT DRIVE FILE NUMBER - E 4000 ~ In Legal Services Report L 120/96, it is recommended that a draft by-law to Block 222, Plan 40M-1499 (Marsh court Drive) as public highway, be forwarded to Council for enactment. ROAD DEDICATION PART OF LOTS 4 AND 5, PLAN 469 PART 1, PLAN 40R-16855) MARSHCOURT DRIVE FILE NUMBER - E 4000 In Legal Services Report L 119/96, it is recommended that a draft by-law to dedicate part of Lots 4 and 5, Plan 469, designated as Part 1, Plan 40R-16855 (Marshcourt Drive) as public highway, be forwarded to Council for enactment. DISPOSAL OF TOWN LANDS PART OF ROAD ALLOWANCE BETWEEN LOTS 34 AND 35, CONCESSION 1, BEING PARTS 4-34, PLAN 40R-I6978 PINE GROVE AVENUE FILE NUMBER - D 3360 '-' In Legal Services Report L 113/96, it is recommended that a draft by-law to authorize the sale of surplus municipal lands described as part of Lot 35, Concession 1 and part of road Allowance between Lots 34 and 35, Concession 1, designated as Parts 4-34, Plan 40R-I6978 (pine Grove Avenue), be forwarded to Council for enactment. STORM SEWER INSTALLATION AND ROAD RESTORATION ON FRANKLIN STREET FILE NUMBER - E 4000 That the storm sewer installation and road restoration on Franklin Street in the amount of $35,000 be authorized as set out in the memorandum of the Director of Public Works (Acting) dated October 28, 1996. Ratified bv Council immediatelv followin2 this meetin2 10. PICKERING MUSEUM VILLAGE ADVISORY COMMITTEE TO RAISE FUNDS FOR RESTORATION OF THE PUTERBAUGH HOUSE FILE NUMBER - D 3400.07 -. That the Town acquire the Puterbaugh House and that the Pickering Museum Village Advisory Committee be responsible for raising funds for its restoration as an early log school house. Apuroved See Recommendation #6 -. (IV) OTHER BUSINESS 1. The Executive Director of Operations advised that vandalism occurred over the weekend at the Greenwood Public Library. 2. The Executive Director of Operations advised that a report would be forthcoming concerning the water supply problem which occurred last Thursday evening. 80 (IV) OTHER BUSINESS 3. The Executive Director of Operations informed the Committee that the Days of Action Protest which took place last Friday affected only the Brock West Landfill Site and no difficulties occurred. 4. The Executive Director of Operations advised that the first meeting of the Youth Council will be taking place in the Council Chambers on Tuesday, October 29th. .... 5. Councillor Senis requested a status report concerning the home based business by- law. 6. Councillor Senis advised that the South Pickering Seniors' Club are holding a bazaar on November 2nd at the Seniors' Activity Centre on Liverpool Road from 9 am to 3 pm. 7. Councillor Senis advised the Executive Director of Operations that she would like to be advised of a location within the Town offices where seniors could take a written driving test. This project would be a partnership between the Ministry of Transportation and the Town of Pickering. 8. Councillor Senis advised that the Frenchman's Bay clean-up was a great success with over 100 participants. 9. Mayor Arthurs provided an update to Councillor Senis concerning the home based business by-law. 10. The following matters were discussed prior to the regular meeting: a) Councillor Dickerson advised that Councillor Senis and himself visited the waterfront at Liverpool Road and are very displeased with the bridge construction, advising that it does not appear that it is being constructed to the agreed upon specifications. -- b) Mayor Arthurs discussed the feasibility of a meeting on Friday with Council. c) Councillor Johnson distributed information concerning the Franklin Street Storm Sewer Installation project. TOWN OF PICKERING That the Executive Committee of the Town of Pickering having met on October 28, 1996, presents its fourteenth report to Council and recommends: 1. DRAFT PLAN OF CONDOMINIUM 18CDM-95004 PICKDRED INVESTMENTS LIMITED (SOUTHVIEW GARDENS) LOT 3, AND PART OF LOTS 4 & 5, REGISTERED PLAN 469, PART OF LOT 17, CONCESSION 1 (SOUTH SIDE OF KINGSTON ROAD, EAST SIDE OF SOUTHVIEW DRIVE) FILE NUMBER - B 4100 - 18CDM-95004 '-' That Draft Plan of Condominium 18CDM-95004, submitted by Pickdred Investments Limited, on lands being Lot 3, & Part of Lots 4 & 5, Registered Plan 469, Part of Lot 17, Concession 1, Town of Pickering, be APPROVED subject to the following conditions: 1. That this recommendation apply to the condominium plan prepared by Schaeffer & Reinthaler Limited, Ontario Land Surveyors, dated October 8, 1996, containing 51 two and three-storey townhouse units, bearing the Town Recommendation stamp; and 2. That prior to final registration of this plan: a) the applicant shall submit a Draft Durham Condominium Plan to be approved by the Town's Planning Department in order to ensure consistency between the condominium plan and the approved site plan; -- b) the Town must be satisfied that the site is in full conformity with the Site Plan Agreement dated June 27, 1996, and registered as Instrument Number D 474702 on July 18, 1996, and that all of the general on-site works, including landscaping, fencing, lighting, and surface treatments have been or will be completed to the satisfaction of the Town's Planning and Public Works Departments; c) the applicant shall enter into an appropriate condominium agreement with and to the satisfaction of the Town, which shall include, but not necessarily be limited to, the following requirements: (i) assurance of the continued compliance of the subject property with the Town-approved site plan; (ii) the ensured cooperation of the condominium corporation with the Town regarding such matters as snow storage, refuse collection, and driveway entrance maintenance; and d) the applicant shall satisfy the Town with regard to a payment in lieu of parkland contribution that would have otherwise been required for the proposed development. -- 2 2. That Zoning By-law Amendment Application A 1/96, submitted by T., M. and 1. Ferrari, on the subject property, known as Part of Lot 12 Plan 819, be APPROVED AS REVISED to rezone lands to permit the development of three lots for detached residential dwellings with performance standards consistent with the Dunbarton Neighbourhood Development and Design Guidelines. subject to the following conditions: 1.0 That prior to the forwarding of an implementing zoning by-law to Town Council: (a) land severance applications to divide the subject property into three residential lots with minimum frontages of approximately 20.0 metres on Strouds Lane be approved by the Durham Land Division Committee and become final and binding; and (b) the owners of the subject property enter into a development agreement with and to the satisfaction of the Town to address, but not necessarily be limited to the following: i) payment of costs associated with the installation of storm sewer connections to the three lots; ii) submission and approval of grading, drainage and entrance plans, and the restoration of roads, boulevards, sidewalks and utilities; -. iii) conveyance to the Town of a 3.5 metre strip of land, plus Part 1, Plan RD-147 across the Strouds Lane frontage of the property, and a 3.05 metre strip of land across the Fairport Road frontage of the property for road widening purposes; iv) required parkland dedication arrangements, financial or otherwise; v) submission and approval of a tree preservation plan; and vi) contributions to cost of the installation of traffic lights at the intersection of Fairport Road and Strouds Lane. 2.0 That the implementing zoning by-law shall include, but not necessarily be limited to the following: (a) .'W' (b) (c) (d) (e) provide for detached dwellings on lots with minimum lot frontages of 15.0 metres and minimum areas of 460 square metres; provide for minimum side yard widths of 1.5 metres; provide for a minimum flankage side yard width of 4.5 metres; provide for a minimum front yard depth of 4.5 metres; provide for a maximum dwelling height of 9.0 metres; 3 (f) provide for provisions to minimize garage projection. (g) provide for a double width driveway apron. 3. LAND SEVERANCE APPLICATIONS LD 173/96 AND 174/96 ZAKI AMMOURY PART OF LOT 5, PLAN 282 (EAST SIDE OF PINE GROVE AVENUE) FILE NUMBER - B 2310 - LD 173/96 AND LD 174/96 -- That Council appeal to the Ontario Municipal Board, the decisions of the Durham Land Division Committee respecting Land Severance Applications LD 173/96 and 174/96. 4.
