BY ~LAW NO. 6787/07
Being a By~law to amend Restricted Area Zoning By-law 3037,as
amended by By-laws 2623/87, 3450190. and 6696/06, to implement the
Official Plan of the City of Pickering, Region of Durham,. North Part of
Lot 2, Concession 5, City of Pickering. (A 17/05)
WHEREAS the Council of The Corporation of the City of Pickering deems it desirable to
enact a temporary useby~law fora.period of three years to permit the establishment of
a dog daycare and boarding facility with an ancillary retail store .on the lands, being
North Part of Lot 2, Concession 5, in the City of Pickering;
AND WHEREAS an amendment to By-law 3037, as amended by By~aws 2623/87,
3450/90 and 6696/06, is therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY. OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. TEXT AMENDMENT

Section 5.(1) of By..law 2623/87, as amended, is hereby further amended by
adding thereto new subsection (d) after subsection (c) as fOllOws:
(d) Exception ("CLR8-DD" Zone)
(i) Despite any provisions in this By-law to the contrary, inad(jition to
any other uses permitted under the "CLR8" zone, a dog daycar~and
boarding facility shalt .~ permitted until July 23, 2010 on the' lands
designated "CLR8-DD" (North Part of Lot. 2, Concession 5) on
Schedule "I" attached hereto in accordance with the following
provisions: .
A. The maximum number of dogs pennitted.within a dog daycare
and boarding facility at anyone time shall be 30;
B. A dog daycare and boarding facility shan be permitted to
operate within an accessory structure, ""itha maximum height
of 5.5 metres;
C. The ovemigl1tbbarding of ck>gs shall be provided ina non-
crating environment;

D.
An outdoor exercise area shall be provided in. the rear yard
and shall be set back a minimum of 10.0 metres from all
property lines;

E. A maximum of one retail store shall be permitted for the sale
of products anciUaryto a dogdaycare and boarding facility;
F. An ancillary retail store shan not be permitted within an
accessory structure and shall not exceed a maximum grC}ss
floor area 59 square metres;
G. In addition to the parking requirements for a detached
. dwelling, a minimum oi5 parking spaces shall be provided
and maintained on~site.
(ii) For the purpose Of this subsection the following. definition shat! apply:
"D090aYCare.and.Boarding Facility" - shall mean ,a facUity.in which
the daytime care of dogs.is provided and shall.mcludetheovernight
boarding of dogs, but shaH not inchJde the breeding or sale of dogs,
or a veterinary clinic.

SCHEDULE AMENDMENT
Schedule "I" toBy~law 262;3187, 8$ amended, is hereby further amended. by
changing the "CLR8" zone to a "CLR8.DD" zone designation on the lands being
North Part of Lot 2, Concession 5, in the Ctty of Pickering, as shown on Schedule 'T'
attached hereto. .'

BY.LAW 3037
8y~law 3037, as amended by By~laws 2623/87,3450/90 and 6696/06 is hereby
further amended only to the .extent necessary .to give effect to the provisions of
this By.law as set out in Section 1 above, and . as set out on Schedulel1l"attaqhed
hereto. Definitions and subject matter not speCifically dealt with in this By~law
shaUbegoverned by the relevant provisions ofBy~law 3037, as amended.
4. EFFECTIVE DATE

This By~law shall come into force in accordance with the provisioAsof the
Planning Act, and shaU remain in effect for three years from the date of pas~ing
hereof, unless repealed or extended in accordance with the above~mentioned
provisions. .
