ADOPTION OF MINUTES MOTION: Moved by Bill Utton, seconded by Marie Billinger That the minutes of the 7th meeting of the Committee of Adjustment Wednesday, May 25, 2005, be adopted, as amended. CARRIED UNANIMOUSLY ADOPTION OF AGENDA MOTION: Moved by Marie Billinger, seconded by Bill Utton That the agenda for the Wednesday, June 15, 2005 meeting be adopted. CARRIED UNANIMOUSLY held 40 P/CA 28/05 - K. Kozovski 526 Rosebank Road (Part of Lot 88, Plan 350, Part 1,40R22695) City of Pickering The applicant requests relief from Zoning By-law 2511, to permit a minimum rear yard depth of 0.4 of a metre, and a minimum south side yard width of 0.4 of a metre, whereas the by-law requires a minimum rear yard depth of 7.5 metres, and a minimum side yard width of 1.5 metres. The applicant requests approval of these variances in order to obtain a building permit for a proposed garage addition attached to the existing dwelling. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Fire Prevention Officer, expressing no concerns. Additional comments were also received from Jim Brancato and Nino Picciolo of Maitland Drive in objection to the application. Kote Kozovski, owner, was present to represent the application. Peter Kozovski of 358 Rosebank Road was also present in favour of the application. Nino Picciolo of Maitland Drive was present in objection to the application. Kote Kozovski and Peter Kozovski explained the history of the property, that the proposed garage would bring character to the home and the surrounding neighbourhood, that they had spoken with the neighbour, to the south, who stated no concerns with the proposed garage, and indicated there is no other location for the proposed garage. Nino Picciolo expressed concerns with the rear yard setback and would like to see the proposed garage more inline with the house. The correspondence from Jim Brancato and Nino Picciolo indicated; concern with the reduction of the rear yard set back and noted that they would like to see the rear yard maintained similar to the rear yard of the existing house. In response to questions from Marie Billinger and Kote Kozovski, Ross Pym indicated the subject property had previously received approval from the Committee for reduced rear yard depth and continuance of insufficient flankage side yard width. MOTION: Moved by David Johnson, seconded by Chris Braney That application P/CA 28/05 by K. Kozovski be REFUSED on the grounds that the proposed minimum rear yard depth of 0.4 of a metre, and a minimum south side yard width of 0.4 of a metre to be provided by the proposed garage addition are major variances that are not desirable for the appropriate development of the land, and not in keeping with the general intent and purpose of the Zoning By-law. 41 5. ADJOURNMENT MOTION: Moved by Bill Utton, seconded by Chris Braney That the 8 th meeting of the Committee of Adjustment be adjourned at 7:21 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, July 6th, 2005.
