ADOPTION OF MINUTES MOTION: Moved by Bill Utton, seconded by Marie Billinger That the minutes of the 4th meeting of the Committee of Adjustment held Wednesday, March 23, 2005, be adopted as amended. CARRIED UNANIMOUSLY ADOPTION OF AGENDA MOTION' Moved by Marie Billinger seconded by Bill Utton That the agenda for the Wednesday, April 13, 2005 meeting be adopted. CARRIED UNANIMOUSLY 21 (Tabled at the March 2, 2005 meeting) P/CA 8/05 - Paulo Gomes 879 Voyager Avenue (Lot 13, Plan 40M 1987) City of Pickering MOTION: Moved by Bill Utton, seconded by Marie Billinger That P/CA 8/05, by Paulo Gomes be lifted from the table. CARRIED UNANIMOULSY The applicant requests relief from the following provisions of Zoning By-law 3036, as amended by By-law 5575/99: To permit a minimum rear yard depth of 6.8 metres and a maximum lot coverage of 45 percent, whereas the by-law requires a minimum rear yard depth of 7.5 metres and a maximum lot coverage of 38 percent. The applicant requests approval of these variances in order to obtain a building permit for an existing addition attached to the rear of the dwelling. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and the City's Fire Prevention Officer, both expressing no concerns. Additional comments were also received from three area residents in objection to the application. Paulo Gomes, owner, was present to represent the application. No further representation was present in favour of or in objection to the application. Paulo Gomes indicated that he has applied for a building permit and submitted drawings of the existing addition. MOTION: Moved by Bill Utton, seconded by Chris Braney That application P/CA 08/05 by Paulo Gomes, be APPROVED on the grounds that the proposed minimum 6.8 metre rear yard depth and the proposed maximum lot coverage of 45 percent are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: That these variances apply only to the existing addition attached to the rear of the dwelling, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtains a building permit within six months of the date of this decision, or this decision shall become null and void. Voorhees 1834 Bainbridge Drive (Part of Block 7, 40M1602, Part 25, 40R12715) City of Pickering MOTION: Moved by Bill Utton, seconded by Marie Billinger That P/CA 10/05, by J. McKay & D. Voorhees be lifted from the table. CARRIED UNANIMOULSY The applicants request relief from the following provisions of Zoning By-law 3036, as amended by By-law 1894/84: To permit a minimum rear yard depth of 4.0 metres for the proposed addition, a minimum rear yard depth of 2.0 metres for the existing deck, a minimum south side yard width of 0.5 metres and a maximum lot coverage of 49 percent, whereas the by-law requires a minimum rear yard depth of 7.5 metres, a minimum side yard width of 1.2 metres and a maximum lot coverage of 40 percent. The applicants request approval of these variances in order to obtain a building permit for a proposed addition attached to the rear of the dwelling. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Matthew Thomas, agent from Patio Enclosures Inc. was present to represent the application. Jan McKay and Don Voorhees were present in favour of the application. Written comments were also received from Vera Miller of 1832 Bainbridge Drive and Oscar & Sonia Zuniga of 1836 Bainbridge Drive in favour of the application. Matthew Thomas provided each Committee member with an information package, which included pictures of the applicant's rear yard and existing deck. The package also included different design styles and examples of a gable style roof and a single sloped roof. He outlined and explained the reason for the size, purpose, the impact on the neigbourhood and the reason for the gable style roof but was willing to change to a single slope roof if necessary for approval. MOTION: Moved by Bill Utton, seconded by Marie Billinger That the Committee adjourn for an In-camera session. CARRIED UNANIMOUSLY The Committee adjourned at 7:43 p.m. The Committee reconvened at 7:50 p.m. 23 MOTION: Moved by Bill Utton, seconded by Marie Billinger That application P/CA 10/05 by J. McKay & D. Voorhees be APPROVED on the grounds that the proposed minimum 4.0 metre rear yard depth, a minimum south side yard width of 0.5 metres and a maximum lot coverage of 49 percent to be provided by the proposed sunroom addition and the existing 2.0 metre rear yard depth provided by the existing deck are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: That these variances apply only to the proposed addition attached to the rear of the dwelling with the existing deck, as generally sited and outlined on the applicant's submitted plans with this application. That the applicants obtain a building permit and construct the proposed addition within two years of the date of this decision, or this decision shall become null and void. CARRIED UNANIMOUSLY P/CA 12/05 - Daniel Mruck 714 Front Road (Part of Lot 30, Plan M90) City of Pickering The applicant requests relief from the following provisions of Zoning By-law 2511: To permit a lot frontage of 13.6 metres, a lot area of 400 square metres, a rear yard depth of a 4.1 metre, a maximum lot coverage of 34 percent, a flanking side yard width of 3.2 metre to the proposed two-storey dwelling and a flanking side yard width of 1.5 metre to the proposed porch, whereas the by-law requires a minimum lot frontage of 15.0 metres, a minimum lot area of 460 square metres, a minimum rear yard depth of 7.5 metres, a maximum lot coverage of 33 percent and a minimum flankage side yard width of 4.5 metres. The applicant requests approval of these variances in order to obtain a building permit for a proposed two-storey detached dwelling. Daniel Mruck, owner, was present in favour of the application. 24 MOTION: Moved by Chris Braney, seconded by Marie Billinger That application P/CA 12/05 by Daniel Mruck, be APPROVED on the grounds that the existing lot frontage of 13.6 metres, the existing lot area of 400 square metres, the proposed minimum 4.1 metre rear yard depth, the proposed maximum lot coverage of 34 percent, the proposed minimum flanking side yard width of 3.2 metres to the dwelling and the proposed minimum 1.5 metre flanking side yard width to the porch to be minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, and therefore recommends approval of the proposed variances, subject to the following conditions: That these variances apply only to the proposed two-storey detached dwelling, as generally sited and outlined on the applicant's submitted plans with this application. That the applicant obtain a building permit and construct the proposed two-storey detached dwelling within two years of the date of this decision, or this decision shall become null and void. It was noted, by City Staff, that Exhibit 2 of the Notice of Public Hearing indicated that the applicant proposes to establish a minimum 4.5 metre front yard depth provided by the proposed dwellings, whereas the requested front yard depth is 4.2 metres, as stated in the text of the Notice of Hearing. The Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and the City's Fire Prevention Officer, both expressing no concerns. Written comments were submitted to the Committee by John Honsberger on behalf of Caroline Honsberger of 588 Maitland Drive, Peter & Shirley Thompson of 590 Maitland Drive, Peter & Valerie Neumayer of 592 Maitland Drive, Brian Gyde & Susan Oley of 594 Mailtland Drive and Jim & Lori Bradley of 596 Maitland Drive. Jim Brancato, owner, was present to represent the application. Nino Picciolo was present in favour of the application. John Honsberger of 588 Maitland Drive was present in objection to the application. Jim Brancato indicated that he received several enquires about the types of homes (i.e. bungalows, two-storey dwellings with increased square footage) to consider for the proposed dwellings. John Honsberger read from a letter from residents on Maitland Drive expressing several concerns. The letter states concerns with the dwelling sizes and suggests three larger lots instead of four. Most objectionable of all is the request to shorten the front yard depth, which will lead to parking on the road. In response to a question from Bill Utton, Ross Pym indicated that the extension of Maitland Drive is proposed to extend south as outlined in the Official Plan. MOTION: Moved by Bill Utton, seconded by Chris Braney That application P/CA 13/05 to P/CA 16/05 by 1647834 Ontario Inc, be APPROVED on the grounds that the variances for P/CA 13/05 to P/CA 16/05 for minimum front yard depth, maximum coverage, and minimum flankage side yard width, are minor variances that are desirable for the appropriate development of the land and in keeping with the general intent and purpose of the Official Plan and Zoning By-law, subject to the following conditions: 1. That these variances apply only to the subject lands, as generally sited and outlined on the applicant's submitted plan with this application. 2. That the applicant receives approval and finalize the associated Land Severance Applications or this decision shall become null and void. 26 That the applicant obtain building permits and construct the proposed detached dwellings within three years of the date of this decision, or this decision shall become null and void. That minimum one private garage per lot attached to the main building is required and any vehicular entrance of which shall be located not less than 6 metres from the front lot line. CARRIED UNANIMOUSLY ADJOURNMENT MOTION: Moved by Marie Billinger, seconded by Bill Utton That the 5th meeting of the Committee of Adjustment be adjourned at 8:27 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, May 4, 2005.
