WHEREAS pursuant to Section 150(1) of the Municipal Act, 2001, a local
municipality may license, regulate and govern any business carried on within
the municipality; and
WHEREAS pursuant to Section 150(2) of the said Act, a municipality may
only exercise its licensing powers for one or more of the following purposes:
1. Health and safety
2. Nuisance control
3. Consumer protection; and
WHEREAS the Durham Regional Police Service has requested the area
municipalities to enact by-laws to license and regulate pawnbrokers,
salvage yards and second hand dealers; and

WHEREAS it is the goal of the Durham Regional Police Service, through
the area municipalities, to provide better protection to consumers who
purchase goods from pawnbrokers, second hand dealers and salvage
yards by ensuring that the goods have been legally acquired; and
NOW THEREFORE the Council of the Corporation of the City of Pickering
hereby directs staff to prepare a by-law, in cooperation with the Durham
Regional Police Service, to license and regulate pawnbrokers, second
hand dealers and salvage yards.

DELEGATIONS
John Byberg, 2450 Conc. 6, Greenwood, requested Council to reconsider the
approval of his request to place a sign on the property of Mr. Lee, which is
located at Hwy. 7, north of Concession 6 to advertise his fine dining Pepperberry
Bistro in Brooklin. He advised that the Ministry of Transportation have no
concerns and that the sign would be maintained.
Mayor Ryan rose on a point of personal privilege to respond to comments made at the
Special Council Meeting of March 11, 2005.

WHEREAS the residents and businesses of the City of Pickering rely on the
professionalism and dedication of the City's Firefighters to prevent and suppress fires in
houses, businesses and property, to take whatever action is necessary to save the lives
of persons caught in a fire or other disaster and to become involved with the community
in educating residents in fire prevention techniques; and
WHEREAS the Council of the Corporation of the City of Pickering is proud of its
Firefighters and recognizes the danger they face every time they respond to an alarm;
and
WHEREAS it is expedient to establish a policy to recognize those Firefighters who have
been killed on the job or as a result of a job-related injury; and
WHEREAS the naming of a street to recognize those Firefighters who have been killed
on the job or as a result of a job-related injury would be an appropriate and permanent
memorial to those Firefighters;
NOW THEREFORE the Council of the Corporation of the City of Pickering hereby
establishes a policy of naming streets to recognize those Pickering Firefighters who
have been killed on the job or as s result of a job-related injury; and
FURTHER TH/~,T al~ streets named in honour of those Pickering Firefighters who have
been killed on the job or as a result of a job-related injury be identified by displaying an
appropriate marker; and

with the formalization of this policy and the naming of streets.

WHEREAS when the Council of The Corporation of the City of Pickering in approving
the transfer of the Ajax Pickering Transit Authority (APTA) to the Region of Durham
under the terms and conditions put forth by the Region also understood that the transfer
of funds in 2005 would be without conditions as in past years; and
WHEREAS the Council of the City of Pickering continues in its support of the transfer of
the APTA to the Region of Durham and the formation of a regional transit system; and
WHEREAS the City of Pickering has in the past, traditionally funded its proportionate
share of the net annual operating costs of APTA; in part through the application of the
"Go Funds" transferred annually from the Region of Durham; and
WHEREAS the Regional Transit Implementation Committee deferred, at its meeting of
March 1, 2005; a Motion to restrict the use of these funds to capital purposes only for
2005 to a meeting of the Committee and to a meeting of Regional Council on
Wednesday, March 23, 2005; and
WHEREAS the Council of the City of Pickering requires unrestricted use of these funds
in formulating its own 2005 Current Budget;
NOW THEREFORE, be it resolved that the Council of the City of Pickering strongly
urges the Council of the Region of Durham to not impose restrictions on the use of
transferred funds so as to enable Picketing to continue operating, maintaining and
fundin.q APTA as in the past.

Being a by-law to amend By-law 2359/87 providing for the regulating of parking,

Councillor Johnson, seconded by Councillor McLean, moved that By-law Numbers
6491/05, 6492/05, 6493/05, 6494/05, 6495/05, 6496/05, 6497/05, and 6498/05, be
adopted and the said by-laws be now read a third time and PASSED and that the Mayor
and Clerk sign the same and the seal of the Corporation be affixed thereto.

OTHER BUSINESS
Councillor Brenner questioned the position of the City with respect to the transfer
of fill from the Museum by Transport Canada for the properties of demolished
homes.
Councillor Brenner also inquired into the grading of Conc. 7, west of Brock Road
and Sideline 24. He asked if Transport Canada had paid to improve these roads
for the moving of the fill.
Councillor Brenner requested that Council be informed when Fire Orders are
issued.
Councillor Brenner reported that the alignment proposed for Whites Road by the
Region of Durham and the Seaton Planning Group is contrary to the City's
position in ti~e Growth Management Study.
Councillor Johnson inquired into the Whites Road alignment.

Councillor Johnson reported that Brampton, the fastest growing municipality, has
stopped new development due to affordability. He questioned if a cap should be
implemented by the City on the number of homes to be built yearly. He
requested a report from staff on sustainability.
Councillor Dickerson advised that the 2nd Annual Easter Parade would be held on
Saturday, March 26th, hosted by the Ladies Auxiliary of the Royal Canadian
Legion Branch 606.
Councillor Pickles requested that an invitation be made to the Hon. Liza Frulla,
Minister of Canadian Heritage to meet with the Pickering Historical Society and
Heritage Pickering for a tour of the Federal lands and the proposed homes listed
for demolition. He further requested that a letter be forwarded to Transport
Canada suggesting that Transport Canada invite a representative of Heritage
Canada to sit on Transport Canada's local heritage committee, if they have not
already done so.
Councillor Pickles stated that a letter was forwarded to Transport Canada and
the Greater Toronto Airport Authority requesting funding for a peer review and
asked that this letter also be forwarded to the Greater Toronto Airport Authority
Board of Directors.
Councillor Pickles gave notice of a motion concerning Pawn Brokers.
Councillor Pickles asked that we recognized today, March 21st, as International
Day for the Elimination of Racial Discrimination.

WHEREAS the two-year licence granted by the Canadian Nuclear Safety Commission
(CNSC) to Ontario Power Generation (OPG) for the operation of Pickering A expires on June
30, 2005; and
WHEREAS the staff of the CNSC have submitted a Commission Member Document
recommending their approval of a five-year licence for Pickering A beyond June 30, 2005;
and
WHEREAS the staff of the CNSC have made their recommendation based on their
confidence that OPG has sufficient staff, programs, safe-guards and procedures in place to
meet the criteria of sustaining the safe operation of Pickering A over a five-year period; and
WHEREAS the operations of OPG at Picketing A are monitored on a daily basis by on-site
CNSC staff to ensure that the provisions of the licence are being met at all times; and
WHEREAS OPG continues to be a good corporate citizen in the City of Pickering through its
environmental stewardship over its operations and site, its significant positive economic
impact on the community and its ability to safely and reliably meet all the conditions of its
licence;
NOW THEREFORE the Council of the Corporation of the City of Pickering hereby supports
the application of Ontario Power Generation to the Canadian Nuclear Safety Commission to
licence Pickering A for a five year period after June 30, 2005.

Being a by-law to appoint By-taw Enforcement Officers for certain
Purposes (Parking Regulation - 1310 Fieldlight Blvd., 1345 Altona Road,
1655 & 1665 Pickering Parkway, 1235 Radom Street, 905 Bayly Street
and 1915 Denmar Road.)
WHEREAS pursuant to section 15(I) of the Police Services Act, R.S.O. 1990, c.P.15, as
amended, a municipal council may appoint persons to enforce the by-laws of the
municipality; and
WHEREAS pursuant to section 15(2) of the said Act, municipal by-law enforcement
officers are peace officers for the purpose of enforcing municipal by-laws;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
That the following persons be hereby appointed as municipal law enforcement
officers in and for the City of Pickering in order to ascertain whether the
provisions of By-law 2359/87 are obeyed and to enfome or carry into effect the
said By-law and are hereby authorized to enter at all reasonable times upon
lands municipally known as 1310 Fieldlight Blvd., 1345 Altona Road, 1655 &
1665 Pickering Parkway, 1235 Radom Street, 905 Bayly Street and 1915
Denmar Road:

The authority granted in section 1 hereto is specifically limited to that set out in
section 1, and shall not be deemed, at any time, to exceed the authority set out in

Ltd. ceasing to be agents for 1310 Fieldlight Blvd., 1345 Altona Road, 1655 &
