BY-LAW NO. 6483/05
Being a By-law to authorize the release and removal
from title of the Subdivision Agreement and related
amending agreements respecting Plan 40M-1700
(save and except from Block 69), Pickering.
WHEREAS pursuant to the Planning Act, R.S.O. 1990, c. 13, s. 50, or a predecessor thereof,
The Corporation of the City of Pickering and Garthwood Homes Ltd. entered into a Subdivision
Agreement dated December 16, 1991, Notice of which was registered as Instrument No.
LT605756; and
WHEREAS that Agreement was amended to provide for the:
Development/conveyance to the City of
Development Agreement dated August 8,
Instrument No. LT746037;
Blocks 68 and 70, Plan 40M-1700 by
1995, Notice of which was registered as
Development of Blocks 43, 44 and 45 with adjacent lands from Plan 40M-1861 by
Amended Subdivision Agreement dated August 1, 1997, Notice of which was registered
as Instrument No. LT822492;
Development of Blocks 46, 47 and 48, with adjacent lands from Plan 40M-1892 and
Part 1, Plan 40R-19699 and Parts 1 and 2, 40R-19669, by Development Agreement
dated July 13, 2000, Notice of which was registered as Instrument No. LT974060; and
WHEREAS the terms and conditions of the Subdivision Agreement and the amendments
thereto have been complied with to the satisfaction of the City;
NOW THEREFORE, the Council of The Corporation of the City of Pickering HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk hereby authorize the release and removal from title of:
(a)
the Subdivision Agreement, Notice of which was registered as Instrument No.
LT605756 (save and except from Block 69);
(b)
the Development Agreement, Notice of which was registered as Instrument No.
LT746037;
(c) the amending Subdivision Agreement, Notice of which was registered as
Instrument No. LT822492; and
(d)
the Development Agreement, Notice of which was registered as Instrument No.
LT974060,
respecting the development of Plan 40M-1700, Pickering.
BY-LAW read a first, second and third time and finally passed this 21st day of February, 2005.
