INVOCATION
Mayor Ryan called the meeting to order and led Council in the saying of the
Invocation.

ADOPTION OF MINUTES
Regular Meeting of September 20, 2004
PRESENTATION
Councillor Johnson presented a plaque to Councillor Pickles on behalf of
Valleyview Public School in recognition of Councillor Pickles' work in raising
funds for playground equipment.

DELEGATIONS
Bill Boyes, representing the Accessibility Advisory Committee, introduced various
members of the Committee and provided an overview on some of the issues that
the Committee has dealt with. He also provided an overview of the 2004 Annual
Accessibility Plan that was prepared by the Committee.
(V) RESOLUTIONS
Resolution #120/04

Seconded by Councillor Brenner
1. That Councillors' Office Report CO 01-04 regarding the City of Pickering
Accessibility Advisory Committee, be received; and
That Council concur with the City of Pickering Accessibility Advisory Committee's
support for Ontarians with Disabilities Act Special Funding as set out by the
Council of The Corporation of the City of Cornwall; and
That Council petition the Government of Ontario to obtain funding for staff to
coordinate the requirements of the legislation and set consistent standards and
guidelines across Ontario; and
4. That staff at the City of Pickering be given authority to give effect thereto; and
That a copy of Councillors' Office Report CO 01-04 be forwarded to the Council
of the Regional Municipality of Durham and to Roger Anderson as the President
of the Association of Municipalities of Ontario.

presented and reviewed by the City of Pickering Accessibility Advisory
Committee.

Resolution #123104

Seconded by Councillor McLean
WHEREAS the Province of Ontario is proceeding with its development of Seaton under
the Ontario Planning and Development Act which denies the City of Pickering and its
citizens any right of appeal to the Ontario Municipal Board; and
WHEREAS the Province's development plan for Seaton does not take proper account
of the financial impact on the residents of Pickering; and
WHEREAS the plan fails to adequately address archaeological, environmental,
servicing, transportation and land use planning issues in Seaton; and
WHEREAS the effect of the foregoing is to strip the City of Pickering of its legitimate
land use planning powers and decision-making over Seaton; and
WHEREAS the Province of Ontario, through the Ontario Realty Corporation, is
conducting a "scoped" Class Environmental Assessment rather than a full
environmental assessment, as requested by the City of Pickering;
NOW BE IT RESOLVED THAT COUNCIL:

a)
Hereby instructs the City Solicitor to advise the Council on the legal
options available to return to the City of Pickering its proper control over
the land use planning process and actions to commence any litigation
against the Province of Ontario or its ministries, agencies or crown
corporations and to report back to Council on anticipated costs if it is
determined necessary to retain outside legal counsel.
b)
Hereby instructs staff to take any and all action required to have the
Seaton Class Environmental Assessment bumped up to a full individual
environmental assessment and to report back to Council on anticipated
costs if it is determined necessary to retain outside expert environmental
legal counsel.
c)
Hereby instructs staff to undertake a fiscal impact assessment of the
Province's Seaton development plan, and to, if necessary, report back to
Council on anticipated costs if it is determined necessary to retain outside
experts to assist with this study, and to report back to Council no later than
the first meeting in November, 2004 on the fiscal impact assessment.

Being a by-law to regulate the keeping of cats and dogs.
By-law Number 6374/04
Being a by-law to appoint By-law Enforcement Officers for certain purposes (Parking
Regulation - 1345 Altona Road, 905 & 925 Bayly St., 1915 & 1945 Denmar Rd., 1310
Fieldlight Blvd., 1210 & 1235 Radom St., 1530, 1540, 1625, 1655 & 1665 Pickering
Pkwy., 1958 & 1975 Rosefield Rd., 1525 & 1535 Diefenbaker Court, 1000 & 1400 The
Esplanade, 1650 Kingston Road and 1885 Glenanna Road.
By-law Number 6375/04
Being a by-law to amend Restricted Area (Zoning) By-law 2511, as amended, to
implement the Official Plan of the City of Pickering District Planning Area, Region of
Durham in Lot 8 and Part of Lots 7 & 9, Plan 432, City of Pickering. (A 26/92)

THIRD READING:
Councillor Brenner, seconded by Councillor Johnson, moved that By-law Numbers
6373/04, 6374/04 and 6375/04, be adopted and the said by-laws be now read a third
time and PASSED and that the Mayor and Clerk sign the same and the seal of the
Corporation be affixed thereto.

OTHER BUSINESS
Councillor Brenner asked staff to commence negations with the Brock West
Windpark Project and/or the City of Toronto with respect to royalties.
Councillor McLean stated that he attended the Museum's Fall Family Festival on
October 3rd and noted that attendance at this event was up 35% over 2003.
Councillor Ashe stated that his son sustained an injury last Saturday evening and
congratulated the staff at the Ajax/Pickering Hospital for handling this injury.

Councillor Ashe stated that although Council has not been unanimous in its
consideration of the Seaton lands and the Agricultural Preserve, it has been
unanimous in stating how the City has been dealt with negatively by the Province
on these issues.
Councillor Johnson noted that a fundraising event would be held at the West
Salon of the Recreation Complex on October 22, 2004 in support of Doug
O'Donnell who is suffering from mesothelioma.
Mayor Ryan reported that he received a plaque from the Oshawa Durham Rape
Crisis Centre for the City's assistance to that agency.

That the request of Ms. Norma Telfer and Mr. Roy Wilshire to waive the
rental fee of the West Shore Community Centre on Sunday, November 14,
2004 in support of a fundraising event to raise funds for the victims of
Hurricane Ivan in Jamaica be received; and
That a grant in the amount of $543.08 be made to Ms. Teller and Mr.
Wilshire to offset the said rental fee of the West Shore Community Centre on
November 14, 2004; and
That this amount be charged to Account 2195 (Grants to Organizations &
Individuals).

That the request of Christine Cook, on behalf of Judy Russell, to waive the
rental fee of the West Salon of the Recreation Complex on Friday, October
22, 2004 in support of a fundraising event to assist Doug O'Donnell be
approved; and
That a grant in the amount of $703.58 be made to Judy Russell to offset the
said rental fee of the West Salon of the Recreation Complex on October 22,
2004; and
That this amount be charged to Account 2195 (Grants to Organizations &
Individuals).
