THE REGIONAL MUNICIPALITY OF DURHAM
BY-LAW NO. 5-96
A by-law to consolidate the by-laws that regulate traffic and parking on roads
under the jurisdiction of The Regional Municipality of Durham
WHEREAS By-law Number 222-86 of The Regional Municipality of Durham (the "Region") is
the most recent by-law consolidating the by-laws that regulate traffic and parking on roads under
the jmisdiction of the Region;
AND WHEREAS amending by-laws have been enacted from time to time by the Council of the
Region changing the traffic and parking regulations on the roads under its jurisdiction;
AND WHEREAS in order to obtain greater efficiency in the administration of the traffic
regulations on the Region's roads it is deemed expedient to consolidate all traffic and parking by-
laws;
NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law of The
Regional Municipality of Durham through the Council thereof as follows:
INTERPRETATION
1.1 In this by-law:
(a) "area municipaUty" means the municipality or corporation of the City of
Oshaw~ the Town of Ajax, the Town of Pickering, the Town of Whitby, the
Township of Brock, the Township ofScugog, the Township ofUxbridge and
the Municipality of Clarington;
(b) "authorized sign" means any sign placed upon a highway by the Commissioner
of Works or Chief of Police under the authority of this by-law;
(c) "boulevard" meaDS the part of a highway that is unimproved and not
designated or ordinarily used for vehicular traffic but does not iDclude the
shoulder or sidewalk;
(d) "bus stop" means the part of a highway designated by an authorized sign where
buses will stop to take on or let off passengers;
(e) "Chief of Pollee" means the Chief of Police of the Durham Regional Police
Service or a designate;
(t) "Commissioner of Works" means the Commissioner of Works of the Region
or a designate;
(g) "disabled person" has the meaning as ascribed thereto in section 1 of Reg.
581, R.R.O, 1990;
(h) "disabled penon parking permit" means a disabled person parking pennit
issued under the Highway Traffic Act or a similar permit, number plate or other
marker or device bearing the international symbol of access for the disabled and
issued by another jurisdiction;
(i) "driveway" means the part of a highway that is improved with the authorization
of the Commissioner of Works to provide ve~icu1ar access from the roadway to
a private roadway or to adjacent land;
(j) "emergency vehicle" bas the meaning ascribed thereto in section 144 of the
Highway Traffic Act;

(k) "heavy vehicle" means a commercial motorvebicle having a weight, when
unloaded of 3 tonnes or more, or when loaded of 5 tonnes or more, a school
bus longer than 7 metres, and a road-building machine but does Dot include a
passenger vehicle, an emergency vehicle, or any vehicle of a municipality
engaged in official business;
(I) "highway" has the meaning ascribed thereto in subsection 1 (I) of the Highway
Traffic Act and includes unopened and unassumed road allowances;
(m) "holiday" has the meaning ascn'bed thereto in subsectioD 29( 1) of the
Interpretation Act, R.So.O. 1990, c.I.l1, as amended;
(n) "HiglrwlIY T'II/fic Act" means the Highway Traffic Act, R.S.O. 1990, c.H.8, as
amended;
(0) "loading zone" means the part of a highway designated by an official sign
where commercial motor vehicles may load or unlœd materials;
(P) "muniåpal property" means property owned or occupied by the Region;
(q) ·'parking meter" means a device, together with its means of support, erected
for the purpose of controlling and regulating the parking of any vehicle in a
parking space, and measuring the parking time for which payment has been
made and the duration of such parking;
(r) "parking meter cover" means a hood, bag or other covering for a parking
meter that is authorized by the Commissioner of Works or Chief of Police for
placement over a parking meter to indicate that a parking space is reserved or
Dot to be used;
(8) "parking space" means an area designated by signs, painted lines or other
markings, and which may be controlled by a parking meter, for the purpose of
parking a vehicle; .
(t) "pedestrian" means a person on foot or in a wheelchair or baby carriage;
(u) "private roadway" means any road, laneway, ramp or other means of
unobstructed vehicular access to or egress from any land, building or structure
that is not a highway but does not include driveways;
(v) "Region" means The Regional Municipality ofDurbam acting as a body
corporate;
(w) "regional road" means a highway undertbejurisdiction of the Region;
(x) "school bus loading zone" means the part of a highway designated as such by
official signs in accordance with regulations made under the Highway Traffic
Act;
(y) "school bus" has the meaning ascribed thereto in subsection 17S( 1) of the
Highway Traffic Act;
(z) "school purpose vehicle" means (i) a school bus and (ii) a station wagon, van
or bus operated by or under contract with a school board or other authority in
charge of a school;

(aa) "shoulder" means the part of a highway immediately adjacent to a roadway and
having a surface that has been improved with asphalt, concrete or gravel;

(bb) "sidewalk" means the part of a highway set apart for the use of pedestrians;

(cc) "taxicab stand" means the part of a highway designated by an authorized sign
where taxicabs will stop to take on or discharge passengers;
(dd) "traffic" includes pedestrians, ridden or herded animals, vehicles and other
cODveyances, either singly or together, while using any highway for the
purposes of travel;
(ee) "traffic control signal" means any device that is manually, electrically or
mechanically operated for the regulation or control of traffic; and
(ft) "u-turn" means the turning of a vehicle within a highway so as to proceed in
the opposite directi.on.
1.2 In this by-law, the following words shall have the meanings ascribed to them in
subsection 1 (I) of the Highway Traffic Act
(a) "bus";
(b) "commercial motor vehicle";
(c) "conviction";
(d) "crosswalk";
( e) "intersection ";
(f) "King's Highway";
(g) "median strip";
(b) "motor vehicle";
(i) "official sign";
ü) "park" or "parking";
(k) "pedestrian crossover";
(I) "road-building machine";
(m) Ilroadway";
(n) "stand" or Ilstandingl';
(0) "stop" or "stopping";
(P) "through highway";
(q) "vehicle"; and
(r) "wheelchair".
1.3 In this by-law, where any expression of time occurs, the time refeJTed to shall be
standard time except in periods when daylight saving time is in effect, in which case the
time referred to shall be daylight saving time.
1.4 The schedules refelTed to in this by-law shall form part of this by-law and each entry in
a column of a scbedule shall be read in conjunction with the entry or entries across
therefrom and Dot otherwise.
1.5 If any section, subsection or part of this by-law is declared by any court of competent
jurisdiction to be illegal or ultra vires, such section, subsection or part shall be declared
to be separate and independent and enacted as such.
GENERAL
2.1 The Commissioner of Works is authorized to erect, place, maintain or display such
authorized signs and official signs as are required to give effect to the provisions of this
by-law.
2.2 The Commissioner of Works is authorized to issue permits for the movement on any
regional road of heavy vehicles, loads, objects or structures that are in excess of the
dimensional limits set out in section 109 of the Highway Traffic .Act or the weight limits
set out in Part vm of the Highway Traffic Act.

2.3
No person shall erect, place, maintain or display on any highway any sign, marking or
device that pwports to be or is an imitation of or resembles an authorized sign or
official sign.
2.4 No person shall drive a motor vehicle on a sidewalk or footpath except for the pwpose
of directly crossing the sidewalk or footpath at a driveway.
2.5 No person shall drive a motor vehicle on any highway over any raised curb except at a
place where there is a driveway opening or private roadway.
2.6 (I) No person shall sell or offer for sale by retail any goods within the limits of any
highway.
(2) Despite subsection 2.6(1), a licence may be issued to the owners or occupants
of property adjacent to a highway for the use of the untravelled portion of such
highway abutting their property for the purpose of selling owner/occupant
grown fann produce where "off road" vehicle parking facilities are provided
(3) The Commissioner of Works is authorized to issue licences for purposes of
subsection 2.6(2) for a fee set by and subject to conditions approved by the
Council of the Region.
DISABLED PERSON PARKING PERMITS
3.1 . A disabled person parking pennit issued to an individual is not valid when displayed on
a vehicle and the vehicle is Dot being used to pick up or transport the holder of the
disabled person parking pennit
3.2 A disabled person parking pennit issued to a corporation or organization is
not valid when displayed on a vehicle and the vehicle is not being used to
pick: up or transport a disabled person.
3.3 A disabled person parking permit shall be displayed on the sun visor or on
the dashboard of a vehicle so that the international symbol of access for the
disabled, the permit number and the expiry date of the permit are clearly
visible ftom the outside of the vehicle.
3.4 No person shall park a vehicle in a parking space designated for use by vehicles
displaying a valid disabled person parking permit unless a valid disabled person parking
permit has been issued to such person or to a passenger being picked-up or transported
in the vehicle and such permit is displayed in accordance with section 3.3 oftbis by-
law.
3.5 The driver and owner of a vehicle with a disabled person parking pennit issued under
and displayed in accordance with this by-law and the Highway Traffic Act and the
regulations made thereunder are exempt trom the following provisions of this by-law:
(a) subsection 4.6(h) (parking in excess of3 hours) provided that
the vehicle shall not be parked for a period longer than 24
hours;
(b) section 6.1 (parking restrictions on certain highways)
provided that the vehicle shall not be parked:
(i)
for a period longer than 24 hours;
(ii) within 15 meters of an intersection; or
(a)

(iü) between the hours 0£7:00 a.m. to 9:30 am. and 3:30 p.m. to 6:30
p.m. Monday to Friday inclusive; and
(c) section 9.2 (parking metres) during the hours the parking
meter is legally in operation.
GENERAL STOPPING AND PARKING REGULATIONS
4.1 No person shall park or stop any vehicle on any highway or portion thereof except as
follows:
(a) where there is a curb, on the right side of the travelled portion of the highway,
having regard to the direction such vehicle was proceeding, with its right front
and rear wheels parallel to and not more than 0.15 metres out from such curb;
and
(b) where there is no curb, with the right tront and rear wheels parallel to and as
near to the right limit of the highway as is practicable without stopping or
parking on or over a sidewalk, footpath or boulevard.
4.2 Where parking is permitted on the left side of the travelled portion of a highway
designated for one-way traffic, no person shall park or stop any vehicle on the left side
of the highway or portion thereof except as follows:
(a) where there is a curb, on the left side of the travelled portion of the highway,
having regard to the direction such vehicle was proceeding, with its left ftont
and rear wheels parallel to and not more than 0.15 metres out from such curb;
and
(b) where there is no curb, with the left front and rear wheels parallel to and as near
to the left limit of the highway as is practicable without stopping or parking on
or over a sidewalk, footpath or boulevard.
4.3 Sections 4,1 and 4.2 shall not apply where angle parking is permitted.
4.4 No person shall park a heavy vehicle on any highway, except in an industrial area,
unless such vehicle is actually engaged in the loading or unloading of goods, wares,
merchandise or passengers to adjacent premises.
4.5 No person shall stop any vehicle on any highway:
on or over a sidewalk or footpath;
within an intersection or crosswalk;
within 10 metres of a crosswalk;
in such a manner as to interfere with the movement of traffic or the clearing of
snow from a highway;
in such a manner as to interfere with a highway cleaning operation;
on the roadway alongside of any stopped or parked vehicle;
upon åny bridge or elevated stnlcture or within any tunnel or underpass;
on any median strip or adjacent to either side or ends of a median strip; or

(i) alongside or across from any excavation or obstruction in the roadway where
".-- the free flow of traffic would thereby be impeded.
4.6 No person shall park any vehicle on any highway:
(8) in front of or within 6 metres of a driveway or private roadway along a roadway
where the speed limit is greater than 50 kmlhr;
(b) in front of or within 2 metres of a driveway or private roadway along a roadway
where the speed limit is 50 kmIhr or less or so as to obstruct an entrance on the
highway to, or from, a driveway or private roadway;
(c) within 3 metres of a point on the curb or edge of the roadway and nearest a fire
hydrant;
(d) within 10 metres of an intersecting roadway;
(e) for the purpose of displaying the vehicle for sale;
(t) for the purpose of washing, greasing or repairing the vehicle, except for such
repairs as have been necessitated by an emergency;
(g) within 30 metres in advance of: and 15 metres beyond, the nearest rail of any
level crossing of a railway on both sides of the highway or portion thereof;
(h) in such a position or place that prevents or is likely to prevent the removal of
any vehicle already parked;
(i) for a period longer than three (3) hours unless otherwise indicated by official
signs;
G) between the hours of3:00 a.m. and 6:00 a,m. from December 1st to Aprillst;
(k) on or over any boulevard, unless the boulevard has been improved by the
Region for the purpose of parking;
(I) on any two-way Regional roadway having an overall width of less than 6
~. metres; or
(m) on any Regional roadway directly opposite a vehicle stopped or parked on the
other side of the roadway, where the width of the roadway is less than 9 metres.
4.7 (1) No person shall park any vehicle on Regional property without the consent of
the Region.
(2) Where one or more authorized signs have been posted on Regional property
stating conditions upon which a vehicle may be parked or left or prohibiting the
parking or leaving of a vehicle on Regional property, a vehicle parked or left on
Regional property contrary to such conditions or prohibition shall be deemed to
have been parked or left without consent.
4.8 The Chief of Police and the Commissipner of Works are hereby authorized
to erect, place and maintain temporary signs regulating parking and stopping
on any highway.
~. 4.9 Where official signs to that effect are displayed, no person shall stop any vehicle on a
highway:
(a) within 30 metres in advance ot: and 15 metres beyond, a pedestrian cro"ssover,

on both sides of the highway, measured in the direction of travel of vehicles on
the highway or portion thereof; or
(b)
any time or between the hours and on the days set out on the official signs on
one or both sides of the highway or portion thereof that is immediately adjacent
to a school.
4.10 Where official signs to that effect are displayed~ no person shall park any vehicle:
(a) within 30 metres of a regional road on an intersecting highway under the
jurisdiction of an area municipality;
(b) within 60 metres of an intersecting highway on the regional road;
( c) within 6 metres of a point at the edge of the roadway and nearest to a public
entrance to or exit ITom any building or enclosed space in which persons may be
expected to congregate in large numbers including:
(i) a hotel as defined in the Hotel Fire Safety Act, R.S.O. 1990, c.H.16~
(ii) a theatre as defined in the Theatres Act, R.S.D. 1990, c.T.6; and
(iii) a public hall as defined in the Public Halls Act, R.S.D. 1990, c.P.39;
(d) on either side of a highway or portion thereof that is immediately adjacent to
property on which a fire hall is located and within 30 metres of such property
on either side of the highway;
( e) on either side of the highway or portion thereof that is immediately adjacent to
a park or playground;
(f) within the turning basin of a cul-de-sac; or
(g) within 15 metres of the end of the roadway on a dead end highway.
4. 11 Nothing in sections 4. 1 to 4. 10 shall be deemed to permit the stopping or parking of a
vehicle where stopping or parking is prohibited.
STOPPING RESTRICTIONS ON CERTAIN HIGHWAYS
5. 1 Where official signs to that effect are displayed, no person shall stop a vehicle on any
highway at the side and between the limits set out respectively in Columns 1, 2 and 3 of
Schedule I during the prohibited times or days set out in Column 4 of Schedule I.
PARKING RESTRICTIONS ON CERTAIN HIGHWAYS
6. 1 Where official signs to that effect are displayed, no person shall park a vehicle on a
highway at the side and between the limits set out respectively in Columns 1, 2 and 3 of
Schedule II during the prohibited times or days set out in Column 4 of Schedule II.
6.2 Where official signs to that effect are displayed, no person shall park a vehicle on a
highway at the side and between the limits set out respectively in Columns 1, 2 and 3 of
Schedule III during the prohibited times or on the prohibited days set out in Column 4
of Schedule III for a longer period than that set out in Column 5 of Schedule III.

STANDING RESTRICl'IONS
7.1 Where official signs to that effect are displayed, no person shall stand a vehicle on any
highway at the side and between the limits set out respectively io Columns 1, 2 and 3 of
Schedule IV during the prohibited times or days set out in Column 4 of Schedule IV.
ANGLE PARKING
8.1 Subject to sections 8.2 and 8.3, where official signs to that effect are displayed, angle
parking is permitted 00 highways at the sides and between the limits set out
respectively io Columns 1, 2 and 3 of Schedule V.
8.2 Where angle parking spaces are designated by lines painted on the roadway, no person
shall stop or park any vehicle except entirely within an area designated as a parking
space.
8.3
Where angle parking is pennitted on a highway and parking spaces are not designated
by lines on the roadway, no person shall stop or park any vehicle except at an angle of
not less than 40 degrees and not more than 50 degrees from the curb or edge of the
roadway with the front end of the vehicle at such curb or edge.

METER PARKING
9.1 The erection, maintenance and operation of a parking meter on a highway, at the sides
and between the limits set out respectively in Columns 1, 2 and 3 of Schedule VI, for
the purpose of controlling and regulating parking during the days and hours set out in
Column 4 of Schedule VI and the designation of a parking space in connection with
such parking meter, is hereby authorized.
9.2 Where in this by-law a fee is stipulated for a given parking period in a parking space,
the fee shall be paid for that period or any portion thereof, and the period shall be as
measured by the parking meter controlling such parking space.
9.3 No person shall deposit or cause to be deposited in any parking meter any slug, device
or other substitute for a coin of Canada.
9.4 Notwithstanding any other provision of this by-law, where parking meters have been
erected under the authority of section 9.1, no person shall park any vehicle in a parking
space, unless the parkiog meter controlling such parking space is used and a fee is
deposited therein in accordance with the rate set out in Column 5 of Schedule VI or for
a longer period than that set out in Column 6 of Schedule VI.
9.5 (1) Where parking meters have been installed and where parallel parking is
pennitted, no person shall park a vehicle in a parking space unless the front of
such a vehicle is opposite to the parking meter provided for such space except
that, in any case where two meters are mounted on the same standard, the rear
of the forward vehicle shall be opposite to or as close as is practicable to the
forward parking meter and the front of the rear vehicle shall be opposite to or
as close as is practicable to the rear meter.
(2) Despite subsection 9 .S( 1), if a single parking meter has been erected at the rear
of a parking space, with respect to the direction of travel, no person shall park
in such parking space unless tbe rear of such vehicle is opposite to the parking
meter provided for such space.

(3)
Where parking meters have been installed and where angle parking is pennitted,
no person shall park a vehicle in a parking space unless the front of such vehicle
is as close as is practicable to the parking meter for such space.

(4) Where parking meters have been installed and where a parking space has been
designated by lines painted on the roadway, no person shall park any vehicle in
such a manner that it is not wholly within the area designated as a parking space
unless the vehicle is of such length or width so as to render it impossible to park
it in one parking space ir;t which case the adjoining parking space shall, in
addition, be used and the neceswy deposit of coins shall be made in the
parking meters provided for both parking spaces.
9.6 (1) No person shall park a vehicle orpennit a vehicle to remain parked in a metered
parking space where a parking meter cover is in place.
(2) Despite subsection 9 .6( 1), an authorized person shall be permitted to park a
vehicle or permit a vehicle to remain parked in a parking space if the parking
meter has been covered with a parking meter cover to indicate reserved
parking.
9.7 For the purpose of detennining violations of the use of a parking meter, the fact that
the parking meter indicates that the vehicle is unlawfully parked is prima facie evidence
that such vehicle is unlawfully parked.
9.8 Nothing in sections 9..5 or 9.6 shall be deemed to pennit any person to stop or park a
vehicle at any location where, or at any time when, stopping or parking is otherwise
prohibited..
WADING ZONES
10.1 Where an authorized sign to that effect is displayed, no person shall stop, stand, or park
any vehicle, other than a commercial motor vehicle, in a loading zone on any highway
between the hours of 8:30 a.m. and 9:00 p.m., Monday to Saturday inclusive, except
holidays, at the side and between the limits set out respectively in columns 1, 2 and 3 of
Schedule VII.
10.2 Despite section 10.1, the driver of a vehicle shall be pennitted to stop in a loading zone
while actually engaged in loading or unloading passengers so long as such stopping
does not interfere with any commercial motor vehicle about to enter such loading zone.
TAXICAB STANDS
11.1 Where an authorized sign to that effect is displayed, taxicab stands are hereby
established OD the highways at the sides and at the locations set out respectively in
Columns 1, 2 and 3 of Schedule VIll for the pennitted number of taxicabs set out in
Column 4 of Schedule VIll for use between the hours set out in Column 5 of Schedule
VIll,
11..2 No person shall stop or park a vehicle or permit a vehicle to remain stopped or parked
in a taxicab stand other than a taxicab waiting for hire or engagement
11.3 Any taxicab driver, when arriving at any taxicab stand Dot already fully occupied by the
designated number of vehicles to be accommodated at such stand, shall stand such
vehicle in the rear of the othervebicle or vehicles already occupying such stand.
11.4
When a vehicle is called or driven off any taxicab stand, the drivers of each of the other
vehicles stationed at such stand in the rear of the vehicle so called or driven· off, shall
cause their respective vehicles to be moved forward so that every vehicle shall in
succession fill the place which shall have been previously occupied immediately in
advance of such vehicle by the vehicle moved fOlWard in accordance with this
section 11.4.

ONE-WAY TRAFFIC
12.1 The highways set out in Column I of Schedule IX between the limits set out in Colwnn
2 of Schedule IX, during the times or days set out in Column 3 of Scbedule IX, are
hereby designated for one-way vehicular traffic only in the direction set out in Column
4 of Schedule IX.
12.2 The highways set out in Column 1 of Schedule X baving been divided into clearly
marked lanes for vehicular traffic between the limits set out in Column 2 of Schedule
X, in the lanes set out in Column 3 during the times or days set out in Colwnn 4 of
Schedule X are hereby designated for vehicular traffic moving in the particular
direction set out in Column 5 of Schedule X and such designation shall be indicated by
an official sign or by a traffic control signal.
PROHIBITED TURNING MOVEMENTS
13.1 Where official signs to that effect are displayed, DO vehicle in any intersection or
portion of a highway set out in Column I of Schedule XI proceeding in the direction or
emerging from a property set out in Column 2 of Schedule XI, shall be turned in the
direction set out in Column 3 of Schedule XI, during the times or days set out in
Column 4 of Schedule XI.
13.2 Where official signs to that effect are displayed, no person operating a vehicle shall at
any time make a u-turn at the locations set out in Column 1 of Schedule XI-I while
travelling in the direction set out in Column 2 of Schedule XI-I.
THROUGH mGRW A YS
14.1 The highways set out in Column 1 of Schedule XII between the limits set out in
Cohunn 2 of Schedule XII, are, except as provided in s. 14.2, hereby designated as
through highways for the pwposes oftbe Highway Traffic Act.
14.2 The designation in section 14.1 of a highway or portion thereof as a through highway
shall not include any intersection thereon where the highway intersects a King's
Higbway or where traffic control signals are installed.
STOP SIGNS
15.1 The erection of stop signs is hereby authorized at each of the intersections set out in
Column 1 of Schedule xm facing traffic as set out in Column 2 of Schedule xm.
YIELD SIGNS
16.1 The erection of yield right-of-way signs is hereby authorized at each of the intersections
set out in Column 1 of Schedule XIV facing traffic as set out in Column 2 of Schedule
XIV.
SPEED UJNES
17.1
Where any highway or portion thereat set out in Schedule XV, XVI, XVll, XVllI or
XIX is signed in compliance with the regulations under the Highway Traffic Act, the
maximum rate of speed thereon shall be the rate of speed prescribed in the said
Schedules.

PEDESTRIAN CROSSOVERS
18.1 lbe highways set out in Column 1 of Schedule XX, at the locations set out in Column
2 of Schedule XX, are designated as pedestrian crossovers and shall be indicated as
such 88 prescribed by the regulations made under the Highway Traffic Act.
IlEA VY TRAFFIC
19.1 Where official signs to that effect are displayed, heavy traffic is prohibited on the
highway or part thereof set out in Column 1 of Schedule XXI between the limits set
out in Column 2 of Schedule XXI during the times or days set out in Colwnn 3 of
Schedule XXI.
19.2 The provisions of section 19.1 shall not extend to the use of the highway or part
thereof for deliveries to or removals from any premises abutting such highway.
SCHOOL BUS LOADING ZONES
20.1 Where official signs to that effect are displayed in accordance with the regulations
made under the Highway Traffic Act, the highways or portions thereof set out in
Column 1 of Schedule xxn on the side of the highway set out in column 2 of Schedule
xxn between the limits set out respectively in Colwnns 3 and 4 of Schedule xxn are
hereby designated as school bus loading zones.
20.2 No person shall stop any vehicle on any highway, other than a school pwpose vehicle,
in a school bus loading zone.
BUS STOP ZONES
21.1 Bus stop zones are hereby established where authorized signs to that effect are
displayed.
21.2
Where an official sign to that effect is displayed, no person shall stand any vehicle other
than a bus on any highway within a distance of up to 18 metres in advance of or 30
metres beyond any point designated by an authorized sign as a bus stop.

21.3 No person shall stop any vehicle on any highway, other than a bus, in a designated bus
stop, except that the driver of a passenger vehicle may temporarily stop therein for the
purpose of and while actually engaged in loading or unloading passengers when such
stopping does Dot interfere with any bus.
PENALTIES
22.1 Every person who contravenes a provision of this by-law is guilty of an offence and
upon conviction is liable to a fine as provided for in the Provincial Offences Act,
R.S.O. 1990, c. P.33, as amended. For purposes of this section, a separate violation
shall be deemed to have been committed for each and every day during which any such
violation continues, and conviction in. respect of a violation shall Dot operate as a bar to
further prosecution if sucb violation cOntinues.
22.2
The provisions of this by-law are subject to the provisions of the Highway Traffic Act.
22.3 Part IT of the Provincial Offences .Act applies in respect of all parking infractions under
this by-law.

22.4 Any person who has the authority to enforce the provisions of this by-law, upon
discovery of any vehicle stopped, standing or parked in contravention of this by-law,
may cause said vehicle to be moved or taken away and stored in a suitable place, and
all costs and charges for such removing, taking away and storage, shall be a lien upon
the vehicle, which lien may be enforced in the manner provided by the Repair and
Storage Liens Act, R.S.O. 1990, c. R.25, as amended.
22.5 Where a vehicle has been left parked, stopped or standing in contravention of this by-
law, the owner of the vehicle, notwithstanding that h~ or she was not the driver of the
vehicle at the time of the contravention of this by-law, is guilty of an offence and is
liable to the fine prescribed for the offence unless" at the time of the offence, the vehicle
was in the possession of some person other than the owner without the owner's
consent.
ENFORCEMENT
23.1 The provisions of this by-law may be enforced by:
(a)
a police officer pursuant to subsection 42( 1 )(h) of the Po/ice Services Act,
R.S.O. 1990, c. P.15;
(b) any person appointed for the purpose by a by-law of the Region; and/or
(c) all employees of the Region whose duties include the enforcement of this by-
law.
APPLICA TION
24. 1 This by-law applies to all regional roads and, where applicable, to Regional property
and private property.
24.2 If compliance therewith would be impracticable, sections 4, 5, 6, 7., 8, 9, 10 and 11 of
this by-law shall not apply to:
(a) emergency vehicles or public utility emergency vehicles;
(b) vehicles engaged in works undertaken for or on behalf of any municipal
corporation; or
( c) vehicles forming part of a funeral procession for a long as may reasonably be
required for the purpose of such funeral.
24.3 This by-law shall come into force and take effect on the date that the Chief Judge of the
Ontario Court (Provincial Division) approves set fines for parking infractions under this
by-law, provided that any particular provision hereof shall not become effective until
the sign, if any, applicable to such particular provision has been erected.
