Kearns - Chief Administrative Officer - Director, Operations & Emergency Services - Director, Planning & Development - Division Head, Municipal Property & Engineering - City Clerk - Committee Coordinator INVOCATION Mayor Ryan called the meeting to order and led Council in the saying of the Invocation. {11) ADOPTION OF MINUTES Regular Meeting of April 19, 2004 Special Meeting of April 26, 2004 Councillor Johnson requested that the Minutes of April 19, 2004, be amended to note that Emil Kolb, is Chair of the Region of Peel not the Region of York. -1- Council Meeting Minutes Monday, May 3, 2004 8:30 PM (111) RESOLUTIONS Resolution #66104 - Appendix I Moved by Councillor Brenner Seconded by Councillor McLean That the Report of the Executive Committee EC 2004-7 dated May 3, 2004, be adopted. CARRIED (IV) BY-LAWS That Councillor Pickles, seconded by Councillor Holland, took leave to introduce by- laws of the City of Pickering: By-law Number 6323/04 Being a by-law to amend By-law 2359/87 providing for the regulating of parking, standing and stopping on highways or parts of highways under the jurisdiction of the City of Pickering and on private and municipal property. By-law Number 6324/04 Being a by-law to amend By-law Number 6302/04 to appoint By-law Enforcement Officers for certain purposes (Parking Regulation - 1467 Whites Road, 650 and 705 Kingston Road.) By-law Number 6326/04 Being a by-law to appoint Brad Suckling as a municipal law enforcement officer for the purpose of enforcing the by-laws of the Corporation of the City of Pickering. By-law Number 6327/04 Being a by-law to appoint Karen Wiersma as a municipal law enforcement officer for the purposes of enforcing By-law Number 2359/87, as amended (Parking By-law). CARRIED -2- Council Meeting Minutes Monday, May 3, 2004 8:30 PM THIRD READING: Councillor Brenner, seconded by Councillor McLean, moved that By-law Numbers 6323/04, 6324/04, 6326/04 and 6327/04, be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED (v) 1. OTHER BUSINESS Resolution #67104 Moved by Councillor Brenner Seconded by Councillor Holland For Leave to Introduce a motion concerning the Oak Seaton. Ridges Moraine and CARRIED Resolution #68104 Moved by Councillor Brenner Seconded by Councillor Holland That the Council of the Corporation of the City of Pickering hereby requests the Province and the Ontario Realty Corporation as proponent, to elevate the Category C Class Environmental Assessment related to the acquisition of lands on the Oak Ridges Moraine and the severance and the sale or disposition of provincially owned lands in Seaton, to a Category D Individual Environmental Assessment, because of serious concerns the City has with the undertaking and the potential that exists for significant and undetermined environmental effects on the City; and That consultation with the appropriate First Nations be an integral part of the Category D Individual Environmental Assessment, and that any concerns raised by First Nations representatives be appropriately addressed; and That the undertaking also be subjected to a federal environmental assessment under the Canadian Environmental Assessment Act; and -3- Council Meeting Minutes Monday, May 3, 2004 8:30 PM That a copy of this resolution be forwarded to the Premier of Ontario, the Provincial Minister of the Environment, the Provincial Minister of Municipal Affairs, the Provincial Minister of Natural Resources, the Toronto and Region Conservation Authority, the Federal Minister of Fisheries, M.P., Dan McTeague, Pickering-Ajax-Uxbridge, and M.P.P. Wayne Arthurs, Pickering-Ajax-Uxbridge. CARRIED Recorded Vote: Yes: Councillors Ashe, Brenner, Holland, Johnson, McLean, Pickles and Mayor Ryan Resolution #69/04 Moved by Councillor Ashe Seconded by Councillor Pickles For Leave to Introduce a motion concerning the election of the Regional Chair. CARRIED Recorded Vote: Yes: Councillors Ashe, Brenner, Holland, McLean and Pickles No: Councillor Johnson and Mayor Ryan Resolution #70/04 Moved by Councillor Ashe Seconded by Councillor Pickles That the Council of the Corporation of the City of Picketing hereby declares it's support for the direct election of the Regional Chair and grants it's approval for the Region of Durham to proceed with the necessary changes to bring the election of the Regional Chair into effect in time for the 2006 municipal election. Mayor Ryan congratulated the Picketing Cadb Canadian Cultural Association on their successful 21st Annual Seniors Tea. (VI) CONFIRMATION BY-LAW By-law Number 6328/04 Councillor Brenner, seconded by Councillor Holland, moved for leave to introduce a By- law of the City of Pickering to confirm those proceedings of the Council of The Corporation of the City of Pickering at its Regular Meeting of May 3, 2004. CARRIED (w~) ADJOURNMENT The Meeting adjourned at 9:00 pm DATED CITY CLERK -5- Appendix I Executive Committee Report EC 2004-7 That the Executive Committee of the City of Pickering having met on May 3, 2004, presents its seventh report to Council and recommends: PLANNING & DEVELOPMENT REPORT PD 21-04 REQUEST FOR COUNCIL'S PERMISSION TO CREATE LOTS BY LAND SEVERANCE R. & C. LENNOX SOUTH PART OF LOT 3, CONCESSION 6 PART 1, 40R-4773 (3880 KINSALE ROAD) 1. That the request made by the applicant Valerie Cranmer, on behalf of the owners R. & C. Lennox, be APPROVED, to permit the division of lands (being South Part of Lot 3, Concession 6, Part 1, 40R-4773 [municipally known as 3880 Kinsale Road] by land severance rather than by draft plan of subdivision for future hamlet residential development. OPERATIONS & EMERGENCY SERVICES REPORT OES 14-04 PESTICIDE USE That Report OES 14-04 regarding a City pesticide use update, be received; and That $6,000.00 be allocated for the development of Community Based Social Marketing materials, be approved; and That staff report back to Council on an annual basis on the activities and successes on pesticide awareness in the community. PROCLAMATION "ONTARIO FAMILY FISHING WEEKEND" "EMERGENCY PREPAREDNESS WEEK" That Mayor Ryan be authorized to make the following proclamation: "Ontario Family Fishing Weekend" - July 9 - 11, 2004 "Emergency Preparedness Week" - May 2 - 8, 2004 -6- Appendix I Executive Committee Report EC 2004-7 CLERK'S REPORT CL 21-04 APPOINTMENT OF MUNICIPAL LAW ENFORCEMENT OFFICERS 1. That Clerk's Report CL 21-04 regarding the appointment of Karen Wiersma, Parking Control Officer, as a Municipal Law Enforcement Officer for the purpose of enforcing the Parking By-law and the appointment of Brad Suckling as a Municipal Law Enforcement Officer for the purpose of enforcing various City of Pickering By-laws, be received; and 2. That the draft by-law to appoint Karen Wiersma as a Municipal Law Enforcement Officer for the purpose of enforcing the Parking By-law be forwarded to Council for enactment; and 3. That the draft by-law to appoint Brad Suckling as a Municipal Law Enforcement Officer for the purpose of enforcing the by-laws of the Corporation of the City of Pickering be forwarded to Council for enactment. -7-
