Ashe (Chairperson) Ms. M. Billinger Mr. T. Mohr Mr. E. Newton ALSO PRESENT: Mr. R. Pym, Assistant Secretary-Treasurer Mrs. F. Niro, Secretary-Treasurer ABSENT: Mr. C. Young The meeting convened at 7:10 p.m. in the Main Committee Room of the Civic Complex. 1. MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 2. ADOPTION OF MINUTES MOTION: Moved by Ms. Billinger, seconded by Mr. Mohr, and CARRIED unanimously that the minutes of the 6th meeting of the Committee of Adjustment held Wednesday, May 21, 2003, be adopted. MOTION CARRIED 3. ADOPTION OF AGENDA MOTION: Moved by Mr. Newton, seconded by Mr. Mohr, and CARRIED unanimously that the agenda for the June 11, 2003 meeting be adopted. MOTION CARRIED 38 4. PICA 18/03 - H. & J. Comlekci 893 Baylawn Drive lot 6, Plan 40M-1554 City of Pickering The applicants request relief from Section 5(1)(b)(vi) of Zoning By-law 3036, as amended by By-law 2781/88, to permit the continuance of a minimum 8.1 metre rear yard depth provided by the enclosed deck attached to the rear of the existing dwelling, whereas the by-law requires a minimum 10 metre rear yard depth. The applicants request approval of this variance in order to recognize the existing situation. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and Fire Prevention Officer, both expressing no concerns. Additional written comments were received from Charles Gerditschke of 894 Baylawn Drive, indicating support of the application. Mr. Comlekci, owner, was present to represent the application. No further representation was present in favour of or in objection to the application. Mr. Comlekci stated that he concurred with Staff's recommendation. He had received verbal comments from neighbours residing at 892, 891, 889 and 895 Baylawn Drive, all in support of the application. DECISION: Moved by Ms. Billinger, seconded by Mr. Mohr and CARRIED unanimously that - Application PICA 18/03 by H. & J. Comlekci, be APPROVED on the grounds that the proposed continuance of a minimum 8.1 metre rear yard depth provided by the enclosed deck is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law; subject to the following conditions: 1. That this variance apply only to the existing dwelling with enclosed deck, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain a building permit for the enclosed deck within two years of the date of this decision, or this decision shall become null and void. 39 5. PICA 19/03 - J. Mackenzie & L. Lessard 3169 Golf Club Road North Part of lot 30, Concession 4 Part 2, Plan 40R-2223 (Hamlet of Whitevale) The applicants request relief from Section 5.18(c) of Zoning By-law 3037, to permit the establishment of a maximum 4.9 metre garage height to be provided by the proposed detached garage on the subject property, whereas the by-law states that no accessory building shall exceed a height of 3.5 metres in any residential zone. The applicants request approval of this variance in order to obtain a building permit for the construction of an accessory building, being a detached garage on the subject property. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor expressing no concerns, and from the City's Fire Prevention Officer, indicating no concerns provided that the garage is not used as additional living space either on the grade level or the garage space. Additional written comments were received from Rick Johnson, Regional Councillor - Ward 3, in support of the application, and from the Durham Region Health Unit, expressing no objections. Mr. MacKenzie, owner, was present to represent the application. No further representation was present in favour of or in objection to the application. Mr. Mackenzie stated that he had received verbal comments from 2 neighbours in support of the application. He advised the Committee that he requires a greater garage height to allow for the storage of a motor home and race car. DECISION: Moved by Mr. Mohr, seconded by Mr. Newton and CARRIED unanimously that - Application PICA 19/03 by J. Mackenzie & L. lessard be APPROVED on the grounds that the proposed establishment of a maximum 4.9 metre garage height to be provided by the proposed detached garage on the subject property is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That this variance apply only to the proposed detached garage, approximately 6.0 metres by 14.6 metres in size, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain a building permit and construct the detached garage within two years of the date of this decision, or this decision shall become null and void. 40 6. PICA 21/03 - S. Kosteski 724 Hillcrest Road lot 135, Plan 331 City of Pickering The applicant requests relief from Section 10.2.3 of Zoning By-law 2511, as amended, to permit the continuance of a minimum 7.3 metre front yard depth provided by the existing dwelling, whereas the by-law requires a minimum 7.5 metre front yard depth. The applicant requests approval of this variance in order to recognize the existing situation. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the Durham District School Board, the City's Development Control Supervisor and the City's Fire Prevention Officer, all expressing no objections. Mr. Kosteski, owner, was present to represent the application. No further representation was present in favour of or in objection to the application. Mr. Kosteski stated that Planning & Development Staff advised him of the non-compliance. DECISION: Moved by Mr. Newton, seconded by Ms. Billinger and CARRIED unanimously that - Application PICA 21/03 by S. Kosteski be APPROVED on the grounds that the proposed continuance of a minimum 7.3 metre front yard depth provided by the existing dwelling is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law. 7. PICA 22/03 - S. & L. Stuart 1668 Amberlea Road lot 16, Plan 40M-1651 City of Pickering The applicant requests relief from Section 5.(1)(b)(vi) of Zoning By-law 3036, as amended by By-law 2913/88, to permit the establishment of a minimum 6.4 metre rear yard depth to be provided by the proposed sunroom addition, whereas the by-law requires a minimum 7.5 metre rear yard depth. 41 The applicant requests approval of this variance in order to obtain a building permit for a proposed sunroom addition attached to the rear of the existing dwelling. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were also received from the City's Development Control Supervisor and the City's Fire Prevention Officer, both expressing no concerns. Written comments were received from Deborah & Patrick Meade of 1586 Saugeen Drive, in support of the application. Mr. Nick Swerdfeger of Lifestyle Homes was present to represent the application. No further representation was present in favour of or in objection to the application. Mr. Swerdfeger provided elevation drawings of the proposed sunroom addition. DECISION: Moved by Ms. Billinger, seconded by Mr. Newton and CARRIED unanimously that - Application PICA 22/03 by S. & L. Stuart be APPROVED on the grounds that the proposed establishment of a minimum 6.4 metre rear yard depth to be provided by the proposed sunroom addition is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That this variance apply only to the proposed sunroom addition, approximately 3.9 metres by 4.3 metres in size, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain a building permit and construct the proposed sunroom addition within two years of the date of this decision, or this decision shall become null and void. 8.
