MINUTES of the 6th meeting of the Committee of Adjustment held in the Main
Committee Room of the Pickering Civic Complex on Wednesday, May 21, 2003.

The meeting convened at 7:05 pm in the Main Committee Room of the Civic
Complex.

MATTERS ARISING FROM THE MINUTES
There were no matters arising from the minutes.

ADOPTION OF MINUTES
MOTION: Moved by Mr. Newton, seconded by Ms. Billinger and CARRIED
unanimously, that the minutes of the 5th meeting of the Committee of Adjustment
held April 9, 2003, be adopted.

ADOPTION OF AGENDA
MOTION: Moved by Mr. Newton, seconded by Mr. Mohr and CARRIED
unanimously, that the agenda for the May 21, 2003 meeting be adopted.

PICA 14/03 - Bopa Developments Inc.
201 Shadow Place
Part lot 28l, Plan 40M-2086
The applicant requests relief from Section 5(1 )(b)(v) of Zoning By-law 3036, as
amended by By-law 5830/01, to permit the continuance of a minimum 2.6 metre
flankage side yard width provided by the existing semi-detached dwelling on the
subject property, whereas the by-law requires a minimum flankage side yard
width of 2.7 metres.
The applicant requests approval of this variance in order to recognize the
existing situation.
The Assistant Secretary-Treasurer outlined comments received from the City of
Pickering Planning & Development Department.
Mr. Vijay Gupta, agent, was present to represent the application. No further
representation was present in favour of or in objection to the application.
Mr. Gupta stated that the variance is required due to a construction error when
pouring the foundation.
DECISION: Moved by Ms. Billinger, seconded by Mr. Newton and CARRIED
unanimously that -
Application PICA 14/03 by Bopa Developments Inc. be APPROVED on the
grounds that the proposed continuance of a minimum 2.6 metre flankage side
yard width provided by the existing semi-detached dwelling is a minor variance
that is desirable for the appropriate development of the land, and in keeping with
the general intent and purpose of the Official Plan and the Zoning By-law.

PICA 16/03 - Peggy White
1512 Huntsmill Drive
Lot 129, Plan 40M-1325
The applicant requests relief from the following provisions of Zoning
By-law 3036, as amended by By-law 1826/84:
Section 5(1 )(b)(vi) to permit the establishment of a minimum 3.2 metre rear yard
depth to be provided by the proposed sunroom addition, whereas the by-law
permits a minimum 7.5 metre rear yard depth.

Section 5(1 )(b)(vii) to permit the establishment of a maximum lot coverage of 43%
to be provided by the existing dwelling and proposed sunroom addition on the
subject property, whereas the by-law permits a maximum lot coverage of 38%.
The applicant requests approval of these variances in order to obtain a building
permit for a sunroom addition to the existing dwelling.
The Assistant Secretary-Treasurer outlined comments received from the City of
Pickering Planning & Development Department.
Mr. John Kewell, of Lifestyle Sunrooms, was present to represent the application.
Also present were Mr. & Mrs. Warcop of 1511 Silver Spruce Drive in objection to
the application.
Mr. Warcop provided a photograph from their rear property line. He expressed
concerns over the size of the proposed sunroom, close proximity to the rear
property line, and the height of the addition. He feels that the structure is
obtrusive.
In response to a question, Mr. Pym stated that he did visit the site. He feels that
the intent of the zoning by-law would be maintained due to the sun room addition
being located on the existing rear yard deck. Usable amenity and buffer space
are still provided, and it does not appear to adversely affect the character of the
surrounding area.
Mr. Kewell provided elevation drawings of the sunroom. He stated that the height
of the sunroom would be 102 inches to the peak, and advised the members that
exit to the rear yard of the subject property would be accessed through sliding
doors situated on the side of the sunroom and not the rear.
Mr. Mohr outlined reasons as to why he would be supporting the variance
application adding that he understands the concerns expressed by abutting
neighbours.
DECISION: Moved by Mr. Mohr, seconded by Mr. Newton and CARRIED
unanimously that -
Application PICA 16/03, by Peggy White be APPROVED on the grounds that the
proposed establishment of a minimum 3.2 metre rear yard depth provided by the
proposed sunroom addition and establishment of a maximum lot coverage of
43% provided by the existing dwelling and proposed sunroom addition are minor
variances that are desirable for the appropriate development of the land, and in
keeping with the general intent and purpose of the Official Plan and the Zoning
By-law, subject to the following conditions:
1. That these variances apply only to the proposed sun room addition,
approximately 22 square metres in size, as generally sited and outlined
on the applicant's submitted plans with this application.

2. That the applicant obtain a building permit and construct the proposed
sunroom addition within two years of the date of this decision, or this
decision shall become null and void.

PICA 17/03 - Rose Benson

lot 120, Plan M-1017
The applicant requests relief from Section 5 to Schedule B of Zoning By-law 2511,
as amended by By-law 4354/73 to permit the establishment of a minimum
6.0 metre rear yard depth to be provided by the proposed sunroom addition,
whereas the by-law permits a minimum 7.5 metre rear yard depth.
The applicant requests approval of this variance in order to obtain a building
permit for a proposed sunroom addition to the existing dwelling on the subject
property.

by the proposed sunroom addition is a minor variance that is desirable for the
appropriate development of the land, and in keeping with the general intent and
purpose of the Official Plan and the Zoning By-law, subject to the following
conditions:
1. That this variance apply only to the proposed sunroom addition,
approximately 2.4 metres by 3.1 metres in size, as generally sited and
outlined on the applicant's submitted plans with this application.
2. That the applicant obtain a building permit and construct the proposed
sunroom addition within two years of the date of this decision, or this
decision shall become null and void.

unanimously that-
The 6th meeting of the Committee of Adjustment be adjourned at 7:30 pm and the
next meeting of the Committee of Adjustment be held on
Wednesday, June 11, 2003.
