BACKGROUND:
The completion of these projects, being Plans 40M-1379 and 40M-1380, Pickering, in
accordance with the Subdivision Agreement dated May 21, 1985 and other applicable City
policies, must be acknowledged by the enactment of by-laws assuming the roads and services
within these Plans.
In addition, other by-laws must be enacted to allow the various City departments to close their
files and to amend existing municipal legislation to reflect new circumstances created by these
project's developments.
It is therefore recommended that the 3 draft by-laws attached hereto be enacted.

THE CORPORATION OF THE CITY OF PICKERING
BY-LAW NO.
Being a by-law to assume Major Oaks Road Beaton
Way, Shay Drive, Rayleen Crescent, Plan 40M-1379 and
Dellbrook Avenue, Gandalf Court, Denby Drive, Duberry
Drive, McBrady Crescent, Plan 40M-1380, Pickering, for
public use as public highways under the jurisdiction of
the City.
WHEREAS, Major Oaks Road, Beaton Way, Shay Drive, Rayleen Crescent, Plan 40M-1379 and
Dellbrook Avenue, Gandalf Court, Denby Drive, Duberry Drive, McBrady Cresce:at, Plan 40M-1380 are
highways shown on a plan of subdivision and are therefore deemed, pursuant to the Surveys Act, R.S.O.
1990, chapter S.30, section 57, to be public highways; and
WHEREAS, pursuant to the Municipal Act, R.S.O. 1990, chapter M.45, section 263, the Council of The
Corporation of the City of Picketing has jurisdiction over those highways (the Council of The Regional
Municipality of Durham not having enacted a. by-law pursuant to the Regional Municipalities Act,
R.S.O. 1990, chapter R.8, section 23, to add those highways to the regional road system); and
WHEREAS, pursuant to the Municipal Act, section 262, the soil and freehold of those highways is
therefore vested in The Corporation of the City of Picketing;
NOW THEREFORE, the Council of The Corporation of the City of Picketing HEREBY ENACTS AS
FOLLOWS:
The following highways are hereby assumed for public use as public highways under the
jurisdiction of the Council of The Corporation of the City of Picketing:
Major Oaks Road, Beaton Way, Shay Drive, Rayleen Crescent, Plan 40M-1379 and Dellbrook
Avenue, Gandalf Court, Denby Drive, Duberry Drive, McBrady Crescent, Plan 40M-1380, City
of Picketing, Regional Municipality of Durham.
The City Solicitor is hereby authorized to apply to the Land Registrar pursuant to the Land Titles
Act, R.S.O. 1990, chapter L.5, section 152, to have the Corporation entered as the owner of the
highways referred to in section 1.
BY-LAW read a first, second and third time and finally passed this 15th day of Jmmary 2001.

BY-LAW NO.
Being a by-law to assume services under the jurisdiction
of the City in Plans 40M-13 79 and 40M-1380, Pickering.
WHEREAS, pursuant to, where applicable, the Municipal Act, R.S.O. 1990, chapter M.45, sections 263,
284 286, 297, and 314.7, the Planning Act, R.S.O. 1990, chapter P.13, section 51, the Regional
Municipalities Act, R.S.O. 1990, chapter R. 8, sections 28 and 72 and the Agreement dated May 21, 1985
(Notice of which was registered on April 22, 1986 as Instrument No. LT267584 between Rougecrest
Construction Inc. and The Corporation of the City of Pickering), above ground and underground services
under the jurisdiction of the City in Plans 40M-1379 and 40M-1380, Pickering, have been completed to
its satisfaction;
NOW THEREFORE, the Council of The Corporation of the City of Pickering HEREBY ENACTS AS
FOLLOWS:
The above ground services under the jurisdiction of the City, that are required to be constructed
or installed in the development of Plans 40M-1379 and 40M-1380, Pickering, including the
roads, curbs and gutters, sidewalks, driveway aprons, boulevards, street signs, fencing and
grading, located on lands that are both,
(a)
dedicated to or owned by the City, the Regional Municipality of Durham or the Province
of Ontario; and
(b) in Plans 40M-1379 and 40M-1380, Pickering, or immediately adjacent thereto,
are hereby accepted by the City and assumed by it for maintenance, as of April 12, 1990.
The underground services under the jurisdiction of the City that are required to be constructed or
installed in the development of Plans 40M-1379 and 40M-1380, Pickering, including the storm
drainage system and related appurtenances, located on lands that are both,
(a)
dedicated to or owned by the City, the Regional Municipality of Durham or the Province
of Ontario, and
(b) in Plans 40M-1379 and 40M-1380, Pickering, or immediately adjacent thereto,
are hereby accepted by the City and assumed by it for maintenance as of March 29, 1990 and
February 27, 1990 respectively.

In sections 1 and 2, the phrase "lands that are...owned by the City" includes lands that are subject
to an easement transferred to the City, but only with respect to the specific service or services
referred to in the easement transfer document.

Being a by-law to amend By-law 1416/82 providing for
the regulation and licensing of places of amusement.
WHEREAS, pursuant to the Municipal Act, R.S.O. 1990, chapter M.45, section 236.6, the Council of
The Corporation of the City of Pickering enacted By-law 1416/82 providing for the regulation and
licensing of places of amusement;
NOW THEREFORE, the Council of The Corporation of the City of Pickering HEREBY ENACTS AS
FOLLOWS:
Schedule A to By-law 1416/82, as amended, is hereby further amended by adding thereto the
following items:
Major Oaks Road, Beaton Way, Shay Drive, Rayleen Crescent, Plan 40M-1379 and Dellbrook
Avenue, Gandalf Court, Denby Drive, Duberry Drive, McBrady Crescent, Plan 40M-1380, City
of Pickering, Regional Municipality of Durham.

RECOMMENDATION:
That the draft by-law to appoint Rodney ,Coulter, Animal Control and Pound Attendant, as a
Municipal Law Enforcement Officer for the City of Picketing be enacted.

EXECUTIVE SUMMARY:
Mr. Rodney Coulter has been hired by the Town of Whitby as an Animal Control and Pound
Attendant and in that position, he will be enforcing the City's Dog and Cat By-law. Since Mr.
Coulter will be issuing Province Offence Notices, he will be required to be appointed as a
Municipal Law Enforcement Officer for the City of Pickering.

Rodney Coulter has been hired by the Town as an Animal Control and Pound Attendant
replacing Michael Woodward.
As a housekeeping matter, your Council should pass a by-law appointing Mr. Coulter as
a law enforcement officer for the purpose of administering and enforcing your municipality's
animal control by-laws.

BY-LAW NUMBER
Being a by-law to appoint the animal control personnel
employed by the Town of Whitby as Municipal Law
Enforcement Officer.
WHEREAS pursuant to section 15(I) of the Police Services Act., R.S.O. 1990, c.P. 15, as
amended, a municipal council may appoint persons to enforce the by-laws of the municipality; and
WHEREAS pursuant to section 15(2) of the said Act, municipal by-law enforcement officers are
peace officers for the purpose of enforcing municipal by-laws;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
Rodney Coulter is hereby appointed as a municipal law enforcement officer in and for the
City of Picketing in order to ascertain whether the provisions of By-laws 5728/00 and
1769/83 or their successors are obeyed and to enforce or carry into effect the said By-
The authority granted in section 1 hereto is specifically limited to that set out in section 1,
and shall not be deemed, at any time, to exceed the authority set out in section 1.
The appointment of any or all the persons listed in section 1 shall expire upon the persons
ceasing to be employees of the Town of Whitby or ceasing to be an employee responsible
for carrying out animal control services or upon the Town of Whitby ceasing to be an
agent of the City of Picketing for the purposes of carrying out animal control services,
whichever shall occur first.

Dear Sir or Madam:
On behalf of the pharmacists in Pickering, the Ontario Pharmacists' Association would like to
apply for a proclamation that the week of lqarch 5 - 11, 2001 be proclaimed Pharmacy
Awareness Week.
This year's theme for Pharmacy Awareness Week (PAW) is "Pharmacists Care - No
Matter Where'. During PAW, pharmacists throughout the province (including in your city)
will highlight for patients the many ways pharmacists can help them enjoy better health
every day by taking advantage of initiatives such as the Smoking Cessation Program, and
the Seniors' Safe Medication Use presentations.
Pharmacists have a wealth of information to share, and make a positive contribution to the
health and well being of your constituents every day. As the most accessible health care
provider, pharmacists consistently provide valuable services, saving the health care system
valuable resources. We know you will want to support them in their continuing endeavours.
We hope you will support PAW 2001 by proclaiming the week of March 5 - 11, 2000
Pharmacy Awareness Week in your city.
