WHEREAS the Council of the Corporation of the Township of Pickering deems it desireable to ^.mend the provisions of By-law ?lumber 2520, as amended.. NOW THEREFORE, the Council of the Corporation of the Township of Pickering ENACTS AS FOLLOWS: A. i. 2. 3. TEXT AMENDMENTS That Section 4.1 be and the same is hereby amended by deleting the classification 'Marina Zone 03' and inserting therefore 'Waterfront Zones 03A and 03B' That Section 4.2.1 be and the same is hereby amended by deleting the symbol '03' and inserting therefore the symbols '03A' and '03B'. That new Section 5.25 be added which shall read as follows: 5.25 HOLDING ZONE 5.25.1 Establishment In order to regulate the cost and type of construction, the height, bulk, location, size, floor area, spacing, external design, character and use of buildings or structures to be erected within the area covered by this by-la:v; Holding '(H)' Zon:_s ire hereby established and identified on Schedule t' attached hereto, by the symbol '(H)' preceeding classification symbols established by Section 4.1 5.25.2 Uses Where a classification symbol as established by Section 4.1 is preceeded by the symbol '(H)', the provisions of this by-lau* with respect to the zone di.fined by such classification symbol shall be considered to be the prime use category and such provisions shall apply to such zone, but only after an amendment to this by-law, to remove the symbol '(H)' preceeding the classification symbol, has been approved. 5.25.3 7estricticn Prior t<, an amendment to remove the symbol '(H)' preceeding the classification symbol, nc new building or structure shall be erected ,r used in a Hc.lding Z^ne. 4. 5. 6 That Secticn 8.4 "Professional Office Exception" as incorporated by By-1-9 2734 be renumbered as Section 8.5 That Section 1.5.1.1 be and the same is hereby amended by deleting in the 6th line thereof the words 'vacht Clubs'. That Section 151' of By-law Numbar 2520 be and the same is hereby deleted and the fllowing inserted therefore: SECTION 15A - WATERFRONT ZONES '03A' and '03B' 2 - 6. continued ..... The following provisions shall apple in all WATERFRONT ZONES '03A' and '03B1. No person shall hereafter use 1ny building, structure cr land nor erect any building or structure excopt in accordance with the following provisions: 15A.1 DEFINITIONS 15A.1.1 BOATEL "Boatel" shall mean one building or two or more connected or detached buildings used for the purpose of catering to the needs of the travelling public by furnishing sleeping accommodation. 15A.1.2 BOAT MOORING "Boat Mooring" shall include decking facilities, mooring slips and dry sail storage areas. 15A.1.3 CLUB HOUSE "Club House" shall mean a building or structure used for the purposes of dining and recreational facilities anal may include a dining lounge. 15A.1.4 DRY SAIL STORAGE "Dry Sail Storage" shall mean the temporary open storage of watercraft on land during the normal boating season, but shall not include winter storage. 15A.1.5 MARINA "Marina" shall mean a commercial operation, publically or privately owned, catering to the recreational boating public. 15A.1.6 MARINE SERVICE STATION "Marine Service Station" shall mean a place of business constructed and operated at a location bordering on a waterway to supplu gasoline, oil, batteries, lubricants and accessories to boats and ships only, and where only minor emergency repairs are made. 15A.1.7. WATERFRONT PARKING SPACE "Waterfront Parking Space" (vehicluar), shall mean an area of not less than three hundred (300) square feet, exclusive of driveways or aisles, for the temporary parking or storage of motor vehicles with boat trailers. 15A.1.8. YACHT CLUB "Yacht Club" shall mean a non-profit assoc- iation of persons, who are bona fide members paying annual dues; which owns, hires or leases a building and/or property; the use of such premises being restricted to members, affiliated members, and guests. - 3 - 6. continued..... 15A.2. USES PERMITTED 1.5A.2.1. All uses permitted in an 102' or 'G' zone. 15A.2.2. Yacht Clubs in areas designated '03A' which may include: Parking areas, a club houseboat moorings launching ramps, tennis courts, picnic areas, parks, playgrounds, locker and locker room facilities, -enclosed storage areas, winter storage areas, restaurant facilities, refreshment stands, swimming pools and beaches. 15A.2.3. Marinas in areas designated '03B' which may include: Parking areas, boat moorings, launching ramps, tennis aeurt* , picnic areas, parks, playgrounds, swimming pools, beaches, locker and locker room facilities, enclosed storage areas, winter storage areas, a marine service station, marine railway equipment, restaurant facilities, refreshment. stands, repair facilities, a b?tel, sales and display offices, a boat livery, and retail outlets. 1.5A.3. AREA REQUIREMENTS Minimum site area Minimum site frontage Minimum grater frontage 15A.4. PARKING REQUIREMENTS - 1 acre - 100 feet on a public road - 150 feet For every building or structure erected, altered or enlarged, there shall be provided and maintained, off-street narking in conformity with the following schedule and each parking space shall be made accessable for ingress and egress by means of a hard surface lane or right-of-way or street, at least eight (8) feet in width. Where more than one use occurs, the minimum required parking facilities shall be comput&d for each different use area. 15 A.4.1. YARD REQUIREMENTS 1 parking space for each 2 boats kept for rent 1 parking space for each 300 square feet of floor area. For every building or structure erected, altered or enlarged, there shall be provided, unobstructed yards in accordance with the following schedule. Where more than one use occurs, the maximum required yard shall be provided. 15A.5.1. SCHEDULE "All AMEFDMaNITS 1. Schoduie "A" of By-Law 2520 be and the same is hereby amended by altering the '03' designations in Lots 23 to 25 Range 3 to read '(H) 03B' C. That By-Law Number 2520 be 1rd the same is hereby repealed and amended only to the extent necessary to give effect to the provisions of this By-Law D. With the passing of this By-Law, By-Law Plumber 3045 of the Township of Pickering; is hereby repealed. E. No part of this By-Law shall come into force without the approval of the Ontario Municipal Board, but subject to such approval, the By-Law shall take effect from the day of passim thereof.
