WHEREAS studies have shown that motorists travel up to 70 kilometers per hour
on residential streets that are relatively long and straight; and
WHEREAS speeding on residential streets is not conducive to safe pedestrian
activities;
NOW THEREFORE the Council of the Corporation of the City of Pickering
hereby directs staff to prepare a by-law that will reduce the speed limit on
Rawlings Drive, Heathside Crescent, Walnut Lane and Longbow Ddve to 40
kilometers per hour; and
FURTHER THAT said by-law be included on the Agenda for the Council Meeting
of May 5, 2003.

(a) That Revision 1 to Modification 1 to the Pickering Official Plan,
initiated by the City of Pickering to:
· replace part of the Urban Residential Area - Low Density and
Urban Residential Area - Medium Density with the Open Space
System - Natural Areas to recognize the tableland forest located
west of Brock Road; and
· replace the remnant Urban Residential Area - Medium Density with
the Urban Residential Area - Low Density for lands located west of
the tableland forest adjacent to the St. Lawrence & Hudson Rail
line; and

RE: NATIONAL DAY OF MOURNING, MONDAY, APRIL 28, 2003
The Durham Region Labour Council will be participating in the National Day of Mourning on Monday, April 28,
2003. Our annual ceremony will take place at Oshawa City Hall, Civic Square, beginning at 12:00 noon. The
Day of Mourning provides us with the opportunity to renew our commitment to the prevention of needless
occupational injuries, illnesses and deaths and promote worker well-being Since 1984, when the Canadian
Labour Congress first endorsed an annual event, the Day of Mourning has grown into a worldwide event
observed by unions, central labour bodies, labour councils, municipalities and national governments in nearly a
hundred countries worldwide.
The ceremony at Civic Square, where the flag will be lowered to half mast by the City of Oshawa in honour of
those killed in the workplace, will include several speakers. At the Day of Mourning Monument area, there will
be a laying of wreaths. The ceremony should be concluded by1:00pm.
We invite you to join us at Oshawa City Hall for the ceremony. We would appreciate your confirmation by April
23, 2003. An agenda of the Day of Mourning Ceremony has been enclosed.
Refreshments will follow at the United Steel Workers Hall, 125 Albert Street, Oshawa.

promote public awareness of the needs of deaf, deafened and hard of hearing Canadians, and to
emphasize the importance of protecting our hearing.
The Canadian Hearing Society of Durham would like to obtain your support by requesting that the
month of May be proclaimed "Hearing Awareness Month" in the City of Picketing.
Feunded in 1940, The Canadian Hearing Society is a non-profit agency. During Hearing Awareness

Subject: Ontario Transit Renewal Program - 2003 Request for Allocation of Funds
Recommendation:
1. That Report CS 21-03 be received for information and that:
2. Council approve the request for allocation of funds as directed in the Ontario
Transit Renewal Program guidelines for 2003;
3. Council approve the application of the Ontario Transit Renewal Program Funding
for the eligible expenditures as approved in 2003 APTA Budget; and,
4. the appropriate officials of the City of Pickering and the Ajax Pickering Transit
Authority be given authority to give effect thereto.
Executive Summary: The Ontario Transit Renewal Program (OTRP), an important
element of the $9 billion, 10-year transit investment plan was announced by the
Government of Ontario in September 2001. The OTRP is designed to assist in and
provide up to one-third of the costs of the replacement or major refurbishment of ageing
municipal transit vehicles. We very recently received the application forms and an
information package from the Province wherein it is indicated that submissions must be
made to the Ministry of Transportation by May 1, 2003 and that Council must pass a
Resolution supporting the application. The Council of the Town of Ajax will be passing
a similar Resolution.
Financial Implications: On January 16th, 2003, the Province announced the release
of over $103 million for this year's portion of the 10-year Ontario Transit Renewal
Program. The 2003 allocation for each municipality is based on spending estimates
provided by municipalities. OTRP will provide up to one-third funding in 2003 for all
eligible renewal expenditures.
Under the Ontario Transit Renewal Program, APTA's eligible renewal expenditures are
based on the following APTA Board and Council approved 2003 capital budget items:

Based upon the above the eligible funding for 2003 under this program is $650,000
($873,126 in 2002).
Approval of the above Recommendations will provide the necessary authority for the
Ministry of Transportation to issue payment of renewal funds based on our request for
allocation of such funds.
Background: On September 27, 2001, the government announced a 10-year, $9
billion transit investment plan to contribute towards an efficient and integrated provincial
transportation system.
The plan is made up of $3 billion from the provincial government, along with matching
contributions from municipalities and potentially the federal government to renew and
expand transit systems across the province. This is in addition to $250 million
announced for transit expansion in the Golden Horseshoe.
The government's plan is based on:
· An investment of $3 billion from the province over 10 years;
· An acceptance of the federal government's proposal to participate in municipal
transit infrastructure funding - with an expected matching contribution of $300
million annually, ($3 billion federal government potential share over 10 years);
· Creating a new partnership in which the municipalities' share of transit capital is
reduced from 100 per cent to one-third -- through their own annual investment of
$300 million, ($3 billion - municipal share over 10 years)
In response to the package recently received concerning the Guidelines and
Requirements of the Ontario Transit Renewal Program for 2003 recently received,
APTA is required to submit required forms to the Ministry of Transportation by May 1,
2003.

As such, under the current legislation the Request for Allocation of Renewal Funds
must be accompanied by a Resolution of the Council of the respective Corporations
(Pickering and Ajax) supporting an allocation of funds for eligible expenditures.
Payment of renewal funds in the amount of $650,00 will only be made upon receipt of
above-stated Resolution. A Reserve Fund has been established by both Pickering and
Ajax for the purpose of administering OTRP funds intended to be used toward progress
or final payments for eligible transit vehicles ordered or eligible major refurbishment
costs of transit vehicles.

If Council adopts Planning Committee's recommendation for approval at their
April 22, 2003 Meeting, Council may consider the attached Zoning By-law later on at the
same meeting.
A Statutory Public Meeting was held for this application on January 16, 2003.
Please note that this by-law may be given all three readings at the April 22, 2002
Council Meeting, provided Council approves the above-noted application earlier
that same Meeting.
The purpose and effect of this by-law is to permit the development of six (6) Detached
dwellings on the subject lands.

PICKERING HEREBY ENACTS AS FOLLOWS:

SCHEDULE I
Schedule I attached hereto with notations and references shown thereon is hereby
declared to be part of this By-law.
AREA RESTRICTED
The provisions of this By-law shall apply to those lands in Part of Lots 20 and 21,
Plan 316, designated "S4-8" on Schedule I attached hereto.
GENERAL PROVISIONS
No building, land or part thereof shall hereafter be used, occupied, erected, moved,
or structurally altered except in conformity with the provisions of this By-law.
DEFINITIONS
In this By-law,
(1)
(a) ."Dwellin.q" shall mean a building or part of a building containing one or
more dwelling units, but does not include a mobile home or trailer;
(b)"Dwellin.q Unit" shall mean one or more habitable rooms occupied or
capable of being occupied as a single, independent, and separate
housekeeping unit containing a separate kitchen and sanitary facilities;
(c) "Dwellin.q, Sin.qle or Sinqle Dwellin.q" shall mean a single dwelling
containing one dwelling unit and uses accessory hereto;
(d) "Dwellin.q, Detached or Detached Dwellinq" shall mean a single dwelling
which is freestanding, separate, and detached from other main buildings
or structures;
(2)
(a)"FIoor Area - Residential" shall mean the area of the floor surface
contained within the outside walls of a storey or part of a storey;

(b) "Gross Floor Area - Residential" shall mean the aggregate of the floor
areas of all storeys of a building or structure, or part thereof as the case
may be, other than a private garage, an attic, or a cellar;
(a) "Lot" shall mean an area of land fronting on a street which is used or
intended to be used as the site of a building, or group of buildings, as the
case may be, together with any accessory buildings or structures, or a
public park or open space area, regardless of whether or not such lot
constitutes the whole of a lot or block on a registered plan of subdivision;
(b)"Lot Coverage" shall mean the percentage of lot area covered by all
buildings on the lot;
(c)
"Lot Frontage" shall mean the width of a lot between the side lot lines
measured along a line parallel to and 7.5 metres distant from the front lot
line;
"Private Garaqe" shall mean an enclosed or partially enclosed structure for
the storage of one or more vehicles, in which structure no business or
service is conducted for profit or otherwise;
(a) "Yard" shall mean an area of land which is appurtenant to and located on
the same lot as a building or structure and is open, uncovered, and
unoccupied above ground except for such accessory buildings,
structures, or other uses as are specifically permitted thereon;
(b)
"Front Yard" shall mean a yard extending across the full width of a lot
between the front lot line of the lot and the nearest wall of the nearest
main building or structure on the lot;
(c)
'.?ront Yard Depth" shall mean the shortest horizontal dimension of a front
yard of a lot between the front lot line and the nearest wall of the nearest
main building or structure on the lot;
(d)
"Rear Yard" shall mean a yard extending across the full width of a lot
between the rear lot line of the lot, or where there is no rear lot line, the
junction point of the side lot lines, and the nearest wall of the nearest
main building or structure on the lot;
(e)
"Rear Yard Depth" shall mean the shortest horizontal dimension of a rear
yard of a lot between the rear lot line of the lot, or where there is no rear
lot line, the junction point of the side lot lines, and the nearest wall of the
nearest main building or structure on the lot;
(f)
"Side Yard" shall mean a yard of a lot extending from the front yard to the
rear yard, and from the side lot line to the nearest wall of the nearest main
building or structure on the lot;
(g)
"Side Yard Width" shall mean the shortest horizontal dimension of a side
yard of a lot between the side lot line and the nearest wall of the nearest
main building or structure on the lot;
(h)"Flankage Side Yard" shall mean a side yard immediately adjoining a
street or abutting on a reserve on the opposite side of which is a street;
(i) ,
"Flanka.qe Side Yard Width" shall mean the shortest horizontal dimension
of a flankage side yard of a lot between the lot line adjoining a street or
abutting on a reserve on the opposite side of which is a street, and the
nearest wall of the nearest main building or structure on the lot;
(j) "Interior Side Yard" shall mean a side yard other than a flankage side
yard.

PROVISIONS
(1) (a) Uses Permitted ("S4-8" Zone)
No person shall within the lands designated "S4-8" on Schedule I
attached hereto, use any lot or erect, alter, or use any building or
structure for any purpose except the following:
(i) detached dwelling residential use;
(b) Zone Requirements ("S4-8" Zone)
No person shall within the lands designated "S4-8" on Schedule I
attached hereto, use any lot or erect, alter, or use any building except in
accordance with the following provisions:
(i) LOT AREA (minimum):
(ii) LOT FRONTAGE (minimum):
250 square metres;
10.0 metres;
(iii) FRONT YARD DEPTH (minimum): 4.5 metres;
(iv) SIDE YARD WIDTH (minimum):
1.2 metres one side
and 0.6 metres on the
other side;
(v) FLANKAGE SIDE YARD WIDTH (minimum): 2.7 metres;
(vi) REAR YARD DEPTH (minimum):
7.5 metres;
(vii) LOT COVERAGE (maximum):
(viii) BUILDING HEIGHT (maximum):
(ix) GROSS FLOOR AREA (minimum):
(x) PARKING REQUIREMENTS:
48 percent;

minimum one private garage per lot attached to the main
building, any vehicular entrance of which shall be located
not less than 6 metres from the front lot line, and not less
than 6 metres from any side lot line immediately adjoining a
street or abutting on a reserve on the opposite side of which
is a street;

no part of any attached private garage shall extend more
than 2.5metres beyond the wall containing the main
entrance to the dwelling unit, except
where a covered and unenclosed porch or verandah
extends a minimum of 1.8 metres from the wall
containing the main entrance to the dwelling unit, no part
of any attached private garage shall extend more than
3.0 metres beyond the wall containing the main entrance
to the dwelling unit; or

where a covered and unenclosed porch or verandah
extends a minimum of 2.0 metres from the wall
containing the main entrance to the dwelling unit and
where second storey habitable floor space located
above the garage is set back no more than 2.5 metres
beyond the vehicular entrance of an attached private
garage, no part of any attached private garage shall
extend more than 6.0 metres beyond the wall containing
the main entrance to the dwelling unit;
(xi) SPECIAL REGULATIONS:

despite section 5.7 of By-law 3036, uncovered steps and
platforms not exceeding 2.0 metres in height shall be
permitted to project a maximum of 1.5 metres into a required
rear yard; and

By-law 3036, as amended, is hereby further amended only to the extent necessary
to give effect to the provisions of this By-law as it applies to the area set out in
Schedule I attached hereto. Definitions and subject matters not specifically dealt
with in this By-law shall be governed by relevant provisions of By-law 3036, as
amended.
7. EFFECTIVE DATE
This By-law shall come into force in accordance with the provisions of the Planning
Act.

Further to Council's and the Ontario Municipal Board's approval of Zoning By-law
5500/99 on May 28, 2002, that designated the subject lands as "C4" with an
"(H)"- Holding Symbol, this Department has prepared a draft amending by-law
to remove the "(H)" - Holding Symbol from the subject lands (see attached
Location Map). The draft amending by-law is attached for the consideration of
City Council at its meeting scheduled for April 22, 2003.
Prior to an amendment to remove the "(H)" holding symbol preceding the
"C4" Zone designation on the subject lands, the owner was required to enter into
a site plan agreement, to the City's satisfaction, concerning the use of the subject
property for the purposes of a bakery, a private non-residential school, a day
nursery, and/or a restaurant-type "A" use. The site plan agreement was required
to contain a provision with respect to the installation of mechanical exhaust
equipment, which incorporates odour control measures, prior to the
establishment of either a bakery or a restaurant-type "A".
The owner has entered into a site plan agreement, and a provision regarding the
installation of mechanical exhaust equipment has been included, to the City's
satisfaction.
Therefore, the property owner has satisfied the requirements for the lifting of the
(H) Holding Symbol.
The purpose and effect of this by-law is to lift the (H) Holding Symbol designation
to permit additional commercial uses on the subject lands.

Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended
by By-laws 1158/80, 3878/91 and 5500/99, to implement the Official Plan of
the City of Pickering, Region of Durham, Block 1, Plan 40M-1236, in the City
of Pickering. (A 09/03)
WHEREAS the Council of the Corporation of the City of Pickering and the Ontado Municipal
Board passed By-law 5500/99, being a by-law to amend By-law 1158/80, to permit the
development of additional commercial uses on the subject property, Block 1, Plan 40M-
1236, in the City of Pickering;
AND WHEREAS By-law 1158/80 includes an "(H)" Holding Symbol preceding the
commercial zoning on the lands, which has the effect of preventing any commercial
use such as a day nursery, a bakery, a private non-residential school, or a
restaurant-type "A" from occurring until such time as the owner enters into a site plan
agreement to the City's satisfaction, such agreement is to contain a provision with
respect to the installation of mechanical exhaust equipment, which incorporates
odour control measures, prior to the establishment of either a bakery or a restaurant-
type "A";
AND WHEREAS the owner has now entered into a site plan agreement, and a
provision regarding the installation of mechanical exhaust equipment has been
included, to the City's satisfaction;
AND WHEREAS an amendment to amending By-law 1158/80, to remove the "(H)"
Holding Symbol preceding the commercial zoning on the subject lands is therefore
deemed appropriate;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:

Section 5.(3) Holdin.q Provision of By-law 1158/80, as amended by By-law
5500/99, is hereby repealed.
2. SCHEDULE I
Schedule I to By-law 1158/80, is hereby amended by removing the "(H)"
Holding Symbol preceding the "C4" Zone designation on the subject lands
as set out on Schedule I attached hereto.
3. AREA RESTRICTED
By-law 3036, as amended, is hereby further amended only to the extent
necessary to give effect to the provisions of this By-law as set out in Section
I above, and as set out in Schedule I attached hereto. Definitions and subject
matter not specifically dealt with in this by-law shall be governed by the
relevant provisions of By-law 3036, as amended.
4. EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof.

On April 14, 2003, Planning Committee considered Planning & Development Report
PD 14-03. The Report recommended that: (1) Council approve Revision 1 to
Modification 1 as it pertains to the Duffin Heights Neighbourhood; (2)Council
enact a by-law to adopt Revision 1 to Modification 1 to the Pickering Official Plan;
(3) Durham Region resolve Part of Deferrals 16, 31, and 39, and Deferral 21 to
the Pickering Official Plan as it relates to the Duffin Heights Neighbourhood; (4)
Council adopt the Duffin Heights Neighbourhood Development Guidelines, as the
City's strategy for detailed land use, urban design, transportation and stormwater
in Duffin Heights; and (5) Council adopt Informational Revision 9 to
Map25-Neighbourhood 15: DuffinHeights updating road, school and park
locations, and the Detailed Review Area.
A draft by-law for the enactment of Revision 1 to Modification 1 to the Pickering
Official Plan has been prepared and is attached for the consideration of City
Council at its meeting scheduled for April 22, 2003. A Statutory Public Meeting
was held for this application on February 11, 2003.
Please note that this by-law may be given all three readings at the April 22, 2003
Council Meeting provided Council adopts the recommendation of Planninq
Committee.

The purpose and effect of Revision 1 to Modification 1 to the Pickering
Official Plan is to:
· replace part of the Urban Residential Area - Low Density and Urban
Residential Area - Medium Density with the Open Space System -Natural
Areas to recognize the tableland forest located west of Brock Road;
· replace the remnant Urban Residential Area - Medium Density with the
Urban Residential Area - Low Density for lands located west of the tableland
forest adjacent to the St. Lawrence & Hudson Rail line;
· replace part of the Urban Residential Area - Low Density with the
Urban Residential Area - Medium Density for lands located east of Brock Road
but west of Urfe Creek to offset the loss of population resulting from the
recognition of the tableland forest;
· replace the Urban Residential Area - Low Density with the Urban ResidentialArea
- Medium Density for lands located north of old Taunton Road; and
· revise policy 11.17- Duffin Heights Neighbourhood policies with new policies
addressing land use, urban design, population, and open space matters.

Being a By-law to adopt Revision 1 to Modification 1 to the Official Plan
for the City of Pickering
WHEREAS pursuant to the Planning Act, R.S.O. 1990, c.p. 13, subsections 17(22) and
21(1), the Council of the Corporation of the City of Pickering may by by-law adopt
amendments to the Official Plan for the City of Pickering, and submit them to the Region
of Durham for approval;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. That Revision 1 to Modification 1 to the Official Plan for the City of Pickering is
hereby adopted;
That the City Clerk is hereby authorized and directed to forward for approval a
consolidated version of Modification 1 to the Pickering Official Plan as it pertains
to the Duffin Heights Neighbourhood to the Regional Municipality of Durham as
required by Procedure: Area Municipal Official Plans and Amendments;
3. This By-law shall come into force and take effect on the day of the final passing
hereof.

Being a by-law to appoint By-law Enforcement Officers for certain
purposes (Parking Regulation-1203 to 1257 Bayly St., 575 Steeple

WHEREAS pursuant to section 15(I)of the Police Services Act, R.S.O. 1990, c.P.15, as
amended, a municipal council may appoint persons to enforce the by-laws of the
municipality; and
WHEREAS pursuant to section 15(2) of the said Act, municipal by-law enforcement
officers are peace officers for the purpose of enforcing municipal by-laws;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF

WHEREAS studies have shown that motorists travel up to 70 kilometers per hour on
residential streets that are relatively long and straight; and
WHEREAS speeding on residential streets is not conducive to safe pedestrian activities;
NOW THEREFORE the Council of the Corporation of the City of Pickering hereby
directs staff to prepare a by-law that will reduce the speed limit on Rawlings Drive,
Heathside Crescent, Walnut Lane and Longbow Drive to 40 kilometers per hour; and
FURTHER THAT said by-law be included on the Agenda for the Council Meeting of May
5, 2003.
