HomeMy WebLinkAboutBy-law 3030A BY-LAW TO DESIGNATE AREAS TO BE USED AS TOURIST CAMPS OR TRAILER CAMPS, AND TO LICENSE, REGULATE AND GOVERN SUCH CAMPS. 1. For the purpose of this By-law: (a) "Tourist Camp" shall include and mean auto camp or any parcel of land or premises equipped with cabins or structures, used or maintained forthe accommodation of the public, and any parcel of land ~ premises used or maintained as an overnight tenting, camping or parking ground for the public, whether or not a fee or charge is paid or made for the rental thereof; and (b) "Trailer Camp" shall include and mean land in or upon which any vehicle so constructed that it is suitable .~,~ for being attached to a motor vehicle for the purpose of being drawn or propelled by the motor vehicle, is placed, located, kept or maintained, notwithstanding that such vehicle is jacked up or that its running gear is removed, but not including any vehicle unless it is used for the living, sleeping or eating accommod- ation of persons therein. 2. The area described in section 2 of Schedule "A" of this By-law shall not be used as tourist camps ~ ~ailer camps during the period from October 31st in any year to May let in the year following. 3, (a) There shall not be more than twenty (20) cabins or structures located upon each of the areas ~t out in Section 1 of Schedule "A" to this by-law used for the living~ sleeping or eating accommodation of persons therein and if a trailer is used for sleeping purposes such trailer shall be considered as a structure. (b) There shall not be more than twenty (20) vehicles or motor vehicles placed, located, kept ~maintained for the living sleeping or eating accommodation of persons therein in each of the areas described in section 2 of Schedule "A" to this by-law. (c) There .shall be not more than forty (40) tents placed, located, kept or maintained for the living, sleeping or eating accommodation of persons therein in each of the areas described in section 2 of Schedule "A" to this By-law. (d) Tent sites that comply with the regulations of the Department of Tourism and with the other provisions of this By-taw may be permitted by Council, with the maximum number of such tents permitted to be endorsed upon the licence~ and no tents in excess of this number shall be erected or placed upon any site so licensed. (e) The use of any otherland in the Township of ~ckering for euch purpose as described in paragraphs 1, 2 or $, or any other purposes connected therewith, is prohibited. (f) And this By-law shall apply to all trailers whether they were used for eating, sleeping or living prior to the date of the passing of this By-law or not. No person shall carry on, conduct, keep or maintain a Tourist Camp without first obtaining a licence from the Township of Picketing so to do, nor shall the owner of any land permit the use of his land for such purposes unless and until such a licence has been obtained. - 2 - 5. Any person desi~inE to obtain a licence shall mke an appli- cation to the Council of the Township of PickePing in the ~equiPed form. 6. (a) A licence shall be issued fo~ the calenda~ yea~ and shall not be issued to any person under the age of twenty-one (21) years. ,//~ (b) Upon the approval of Council and the necessary fee having been paid to the T~easu~er of the Township, a licence may be issued by (c) The schedule of fees shall be as follows~ Five dollars per area licensed. 7. (a) A Tourist or Traile~ Camp shall comply with ~e ations of the Depamtment of Tourism, f~om whom a permit must be obtained, and with the ~eEulations of the Medical Officer of Health. (h) A licence under this By-law does not relieve the licensee from complying with any othem PiekePing Township By-law and a Police Officer, Fire Chief or his representative, Medical Officer of Health, Sanitary Inspector, Buildin~ Inspector, Plumbing Inspector or By-lawEnfo~cemmnt Officer may at any time inspect such camp. 8. (a) Any person, firm or corporation who operates a tourist or trailer camp shall keep a register, wmitten in English, of all persons ha~boured, received or lodged in any cabin, building, or structure, with their name, address and licence number of their motor car or trailer, with a description of the accommodation provided, including the date of arrival and the date of departure. (b) Such record shall be made available upon request of a Police or By-Law Enforcement official. 9. (a) No person licensed under this By-law shall permit his place or premises to be used for any unlawful purpose, nor shall he permit or suffer p~ofane or abusive language to he used by any person, nor permit disorderly conduct (as defined in the Cmiminal Code of Canada) therein or thereon. (b) No person licensed unde~ this By-law shall permit the ~enting of accommodation to anyone under the aec of eighteen years. (c) No cabin, buildin&, structure or location shall be ~ented for a lesser period than twelve hours and any cabin, building, structure or location so rented shall not be rented or leased to any other person or persons or permitted to be occupied duming the balance of such period except by the original lesso~ thereof. (d) The owne~ of a licence for a Tourist Camp oP Trailer Camp shall not ~ent any building, cabin, structure, tent site or location fo~ the purposes of ~leeping, eatinE oP living therein for a lon&er period than thirty (30) days in any period of ten calendar months, save that during the period from July 1st to AuEust 31st a person may ~ent for the whole of this pemiod if the occupants have not p~eviously resided in a Tourist or Trailer Camp in the Township of PickerinE du~ing the previous six months, and fumther that such occupants a~e prohibited from oceupyinE a T~rist o~ T~aile~ Camp before May 1st of the following year. 9. (e) For the purpose of this By-law, a trailer shall be deemed to be used every day it is located in ~e municipality, ~t shall not he deemed to he used when parked in an area for the purpose of storage or sale, provided such area is (~.~ outside the defined area of a trailer camp or camp site and is in fact not in use. (f) A copy of this By-law shall be shown to any person renting or occupying a trailer site and it shall be an offence for any person to occupy a trailer when such occupation is contrary to paragraph 2, paragraph 3 subsection (d), or paragraph 9 subsection (d). 10. No person licensed under this By-law shall cause or permit ~ ~ allow any nuisance to arise in connection with his place or premises therein. 11. Every place or premises licensed under this By-law shall he kept clean, safe and in good repair and condition hy the licensee ~ and the same shall be subject to inspection at all times hy the officers named in paragraph 7 (h). 12. Any person or corporation convicted of a breach of this By-law shall forfeit and pay at the discretion of the Magistrate upon ~ conviction a penalty not exceeding Three Hundred Dollars ($300.00) for such offence~ not inclusive of costs, Every such penalty shall be recoverable under the Summary Convictions Act and all of the provisions which apply thereto, 13, Continuation of a breach of this By-law shall be deemed a j~_ × separate offence for each day such breach continues, 1~, By-laws contrary or inconsistent with this By-law are hereby ~ repealed, 15, This ~y-~aw shall become effective upon the c~ day of ~ _ ~1/.~,4 1965, BY-LAW read a First and Second time this .. day of ~ _ BY-LAW ~ead a Third time and PASSED this ~D-~ day of~1965, 1. (2) Para of the North half of Lot lC in ~he Fifth Concession containing one and one-half acres in the Village of Brougham, owned by Charles Burrows. (3) Part of Lot 22 in the First Concession North of No. 2 Highway containing ha'.f an acre owned by Walter Nicholson. (4) Part of the North half of Lot 6 in the First Concession containing three acres known as the "Starboard Light". (5) Part of the North half of Lot 32 in Broken Front Range 3~ north of No. 2 Highway. conuaining one End one-quartcr acres, ovmed by John Miller. (6) Part of Lot 22 in the First Concession at Liverpool con- taining one acre assessed ~o William Long. 2.
