A BY-LAW TO LICENSE, REGULATE AND GOVERN THE OWNERS AND DRIVERS OF
CARTAGE VEHICLES,
WHEREAS the Conporation of the Township of Pickering has pursuant To
The Municipal Act, R.S.O. 1960, Chapter 2q9, Section 395, authority
to enact this By-law.
NOW THEREFORE The Corporation of the Township of Picketing HEREBY
~-NACTS ~s follows:
1. For the purpose of this By-law:
(1) "Cartage Vehicle" means and includes a motor or other
vehicle used for hire for carriage within the Township
but does not include:
(a)any vehicle used for hire for the carriage of
persons~
(b) a vehicle hired by the owner thereof to a person
who takes exclusive possession thereof and drives
the same by himself or his employee and who does
not hire such vehicle to any other person.
No person shall drive or operate any cartaEe vehicle w ithin~e
Township of Picketing or to any point not mo~e than three miles
beyond its limits without first obtaining a license to do so
from the Township of Picketing.
Owners of cartage vehicles shall take out separate licenses for
each such vehicle and in the application therefor each vehicle
in respect of which a license is sought shall be identified in
such manner as is required by the Township of Picketing.
Every person licensed as a cartage vehicle owner shall receive
with each license a metal plate issued by the Township of
Pickerlng bearing an identifying number and shall at all times
keep such plate securely and prominently affixed to the front
portion and on the outside of the vehicle in respect of which
the same was issued.
The owner of a cartage vehicle shall at all times while the
vehicle is being used as such keep in the vehicle the license
issued therefor by the Township of Picketing.
No person licensed under this By-law shall carry in any vehicle
used for hire a load in excess of %hat for which the commercial
motor vehicle permit was issued, as stated upon such permit.
7. The owner of a cartage vehicle in respect of which a license
has been issued under this By-Law shall, when required, submit
his vehicle for examination by the Township of Picketing or any
person designated thereby, and no owner or driver shall, at any
time, prevent or hinder the said Township of Picketing or
person designated thereby, from examining the same.
Owners and drivers licensed under this By-law shall keep every
vehicle clean and in good repair, and whenever the owner of
any such vehicle receives notice~ either given to him and
signed by the Township of Picketing or any person authorized
thereby, that such vehicle is not in a fit ~r proper condition
for use, stating briefly the items complained of, such owner
shall~ within the time mentioned in such notice, put the same
in a fit and proper condition.
9. Every such owner or driver licensed unde~ this By-law
shall, upon changing his addmess, notify the Issuer of
Licenses of such change within two dams and g~Ve his new
address.
10. The fee for such licenses shall be according to the following
schedule:-
T~uck om t~atler under 1 ton load capacity - $ 5.00
1 ton to unde~ 5 tons - 5.00
5 tons to under 10 tons - 5.00
10 tons and over - 5.00
11. Licenses shall be issued on behalf of the Township of
Picketing by its By-Law Enfomcement Officer and every such
license shall expire on the S1st day of DecemheP in the year
of its issue.
12. Any person convicted of a bmeach of any of the provisions
of this BM-law shall forfeit and pay, at the discretion of
the convicting Magistrate, a penalty not exceeding Three
Hundred Dollars ($300.00) exclusive of costs, fo~ each
