THE CORPORATION OF THE TOWNSHIP OF PIGKERING
A BY-LAW OF THE CORPORATION OF THE
TOWNSHIP OF PICKERING TO FACILITATE
RE-FINANCING OF PARTS OF PLANS M36
AND ~37
WHEREAS Plans M36 and M37 in the Township have
been subdivided pursuant to an agreement between the Town-
ship and McIntosh Investments Limited dated the 2Oth
June, 1960, and re-financing is required by the
subdivider to assist in its completion of its obligations
thereunder, and the Township is willing to ~rmit such
re-financing.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF PICKERING ENACTS AS FOLI~WS:
1. THAT the Reeve and Clerk be and they are hereby
authorized to execute on behalf of the Township Corpora-
tion an acknowledgment substantially in the form of the
document hereafter annexed as Schedule "A"o

SCHEDULE "A"
TO: M¢Intosh Investments Limited
AND
TO: Leasebuy Limited
AND TO WHOM IT MAY CONCERN:
The Corporation of the Township of Pickerir~ hereby
acknowledges:
1. McIntosh Investments Limited is re-financing parts
of Registered Plans M36 and M37 in %he Township of Picketing,
otherwise known as Rougedale Acres Subdivision (such
transaction affecting:
ALL A~VD SINGULAR that certain parcel or tract of land
and premises situate, lying and being in the Township of
Pickering in the County of Ontario, in the Province of Ontario,
and being composed of all of Lots i - 4, 6- 8, 15 - 19, 22,
23, 34 - 39, 41, 45, 46 and Blocks E, F and G according to a
Plan registered as Number M-36; and al/ of Lots 2, 6 - 18,
20 - 37, ~3+- 65, 71 - 73, and 93 - 1]1, according to a plan
registered as Number M37)
by transferring the freehold title of subject lands to
Leasebuy Limited under an agreement dated 29th April, 1964,
and taking back a lease of the same property for a term of
99 years.
2. This method of re-financing will not be deemed by
the Township aforesaid to be an actual sale of Lots under
the terms of the relevant subdivision agreement with McIntosh
Investments Limited, notice whereof was registered 12 December,
1961 as Instrument 4198 in the Office of Land Titles at Whitby,
and accordingly it will not require that the Five Hundred
Dollars ($500.00) per lot contribution specified pursuant
to Paragraph B (1}(f) thereof be paid upon %he closing of
the aforesaid transaction, although said Township will require
payment of the said contribution per Lot as each Lot is leased
or the fee simple of all or any lots is transferred to a
subsequent lessee or purchaser or is further encumbered or
otherwise dealt with°

and other good and valuable consideration now paid
to each of them, receipt whereof is hereby acknowledged,
Leasebuy Limited and Traders Realty Limited hereby
jointly and severally acknowledge that they are subject
to and bound by, ail of the terms of the subdivision agree-
ment hereinbefore recited, subject only to the variation
recited in paragraph 2 above.

ACKNOWLEDGMENT AND AGREEMENT
IN CONSIDERATION of the sum of Two Dollars
($2.00) and other good and valuable consideration
paid by The Corporation of the Township of Picketing,
receipt whereof is hereby acknowledged, McIntosh
Investments Limited acknowledges and confirms the
continuation of all of the obligations upon it arising
pursuant to a subdivision agreement dated 20th June,
1960 between itself and the Township aforesaid
(notice whereof being registered 12th December, 1961
as Number ~198 in the Office of Land Titles at Whitby,
Ontario). Without restricting the generality of the
foregoing McIntosh Investments Limited formally
confirms that the Township aforesaid may forfeit, cash
and employ for municipal purposes relating to the
subject subdivision being Plans M36 and M37, all and
any bonds lodged with the Township to date as well as
all or any cash contribution~ deposited~with the
Township to date or hereafter pursuant to said
subdivision agreement.
IN WITNEMS ~EREOF the said corporation has
hereunto affixed its corporate seal over the hand of
its proper officers in that behalf this day of
