A By-law to acquire a right in the
nature of an easement over certain
lands in the Township of Picketing
for the construction, ~peration and
maintenance of a forcemain sewer
and works.
WHEREAS it is required that the Corporation of the Township
of Picketing acquire a right in the nature of an easement in, over,
under, along and through certain lands and lands covered with water in
the Township in connection with and for the construction, operation
and maintenance of a sewer forcemain and related works and undertakings
on the lands more particularly described in Schedule "A" annexed hereto;
AND WHEREAS by Section 333 of the Municipal Act, R.S.O. 1960,
C. 249, the Council of the Corporation of the Township of Picketing may
pass by-laws for acquiring or expropriating any land required for the
purposes of the Corporation;
AND WHEREAS by virtue of Section 1 (h) of the Municipal Act
"land" includes lands, tenements, and hereditaments, and any estate or
interest therein, and any right or easement affecting them and land
covered with water;
AND WHEREAS by the said Section 333 of the Municipal Act the
Council of the Corporation of the Township of Picketing may pass by-laws
more particularly for acquiring or expropriating a right in the nature
of an easement.
AND WH~RF~S the Corporation of the Township of Picketing
deems it expedient to expropriate a right in the nature of an easement
in, over, under, along and through the lands more particularly described
in Schedule "A" annexed hereto for the purpose of constructing operating
and mainmining a forcemain sewer and related works and undertakings;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF PICKERING HEREBY ENACTS AS FOLLOWS:
1. A right in the nature of an easement is hereby expropriated
and taken for municipal purposes in perpetuity or for so long as shall
be required for the purposes hereinafter set out, in, over, under, along
and through the lands described in Schedule "A" annexed hereto for the
following purposes:
(a) To enter on, to lay down, construct, operate, maintain,
repair and replace a sewer forcemain pipeline with chambers and other
related works and undertakings and supports necessary or incidental
thereto.
(b) For the purposes aforesaid to enter on, excavate, drill,
erect, install or pern~it to be excavated, drilled, erected or installed
any chamber, pit, well, foundation, pavement or other structure or
installation necessary for the purposes aforesaid;
A right in the nature of a temporary working easement is hereby
expropriated for a period of one year from the date hereof over ~he lands
described in Schedule "B" annexed hereto for the purposes of entry,
excavating and carrying on the necessary work to construct and install
the forcemain sewer and pipeline and related works and urdertakings in,
Over and under the lands described in Schedule "A" hereto annexed.
3. The Township Engineer and persons authorized by him and/or
claiming through him are hereby authorized to enter on the said lands
described in Schedules "A" and "B" annexed hereto for the purpose of
carryin~ out the purposes referred to in this by-law.
4. The said Schedules "A" and "B" annexed hereto shall form part
of this by-law.

Firstly:
ALL AND SINGULAR that certain parcel or tract of land and
premises situate, lying and being in the Township of Pickering in the
County of Ontario and Province of Ontario, and being composed of
part of Block B, known as Beachpoint Promenade, according to a plan
filed in the Registry Office for the Registry Divisi~ of the County
of Ontario as Number 345, and being a strip of land 11~.00 feet in ~
perpendicular width lying.5.00 feet on either side of a centre line
and centre line produced,'which said centre line is described as
follows:
PREMISING that all bearings herein are astronomic and are
referred to the meridian through the North Eastern angle of Lot 21,
Rznge 3 in the Broken Front Concession, in the said Township of
Picketing;
COMMENCING at a point in the Eastern limit of said Block "B~,
being a point in the Western limit of Lot 326, as shown on said
Registered Plan Nun~ber 345, distant 8.73 feet Northerly thereon
from the South Western angle of said Lot 326;
THENCE North 70o 47~ 10" West, 46.41 feet;
THENCE South $1o 16t 40~ West, 71.63 feet;
THENCE South 80° 39~ 10" West, 862.14 feet to a point distant
21.70 feet measured South 41° 04~ 40" West from an angle in the
Southern limit of Lot 262, as shown on said Registered Plan Number 348;
THENCE South 73° 07~ 40" West, 684.67 feet more or less to
the point of intersection thereof with a straight line connecting
the North Western angle of Lot 284, as shown on said Registered Plan
Number 345 with the most Western angle of Lot 244, as shown on said
Registered Plan Number 348, distant 22.37 feet North ~sterly thereon
from the said North Western angle of Lot 284.
Secondly:
ALL A~ND SINGULAR that certain parcel or tract of land and
land covered with water and premises situate, lying and being in the
Township of Picketing, in the County of Ontario and Province of Ontario,
and being composed of part of Lot 24, Range 3 in the Broken Front
Concession of the said Township of Picketing and part of Lot 326
according to a plan filed in the Registry Office for the Registry Division
of the County of Ontario as No. 345,,~d being a strip of land 14~
feet in perpendicular width, lying f~feet on either side of a centre y.$
line and centre line produced, which said centre line is described as
follows:
PREMISING that all bearings herein are astronomic and are
referred to the meridian through the North Eastern angle of Lot 21,
Range $ in the Broken Front Concession, in the said Township of
Pickerlng;
G(XxffiENOING at a point in the Northern limit of Lot 285,
according to a plan filed in the Registry Office for the Registry
Division of the County of Ontario as Number 299, distant 20.48
feet Westerly thereon from the North Eastern angle thereof;
THENCE North 64° 09~ 20" West~ 226.15 feet;
THENCE North 70° 47' 10" West, 101.92 feet more or less
to a point in the Eastern limit of said Lot 326, distant 11.19
feet Northerly thereon from the South Eastern angle thereof and
continuing North 70° 47' 10" West, 103.23 feet to a point in the
Western limit of said Lot 326, distant 8.73 feet Northerly thereon
from the South Western angle thereof.

premises situate, lying and being in the Township of Picketing, in
the County of Ontario and being composed of:
Firstly: The whole of that part of Block B according to a plan
registered in the Registry Office for the Registry Division of the
County of Ontario as No. 345 lying East of a line drawn on a course
of North 45° 331 00" West from the North West angle of Lot 284
according to said Plan No. 345.
Secondly: A strip of land 50 feet wide being parts of Lots 325,326 and
327 according to Plan 345 aforesaid and part of Lot 24, Range 3,
Broken Front Concession, in the said Township of Pickerlng lying
25 feet in perpendicular width on either of a centre line and
centre line produced which centre is described as follows:
PR~qISING that all bearings herein are astronomic and are
referred to the meridian through the North Eastern angle of Lot 21,
Range 3 in the Broken Front Concession, in the said Township of
Picketing;
OOMMENCING at a point in the Northernlimit of Lot 285,
according to a plan filed in the Registry Office for the Registry
Division of the County of Ontario as Number 299, distant 20.48 feet
Westerly thereon from the North Eastern angle thereof;
THENCE North 64° 09' 20" West, 226.15 feet;
THENCE North 70° 47' lC" West, 101.92 feet more or less to
a point in the Eastern limit of said Lot 326, distant ll.19 feet
Northerly thereon from the South Eastern angle thereof and contin-
uing North 70° 47t lO" West, 103.23 feet to a point in the Western
