A By-law to acquire an easement
across certain lands i~ the
Township of Pickering for sanitary
sewage drainage purposes
WHEREAS by Section 333 of The Municipal Act H.S.O. 1960,
Chapter 249 as amended, the Council of The Corporation of the Towm~ship
of Pickering may pass by-laws for entering on land and for expropriating
an easement or other right in the nature of an easement for the purposes
of the said Corporation and more particularly for the purposes of
providing for sanitary sewage drainage in the Municipality.
AND ~HEREAS the said Council deems it desirable that the said
Corporation should expropriate an easement for the purposes hereinafter set
out affecting the lands described in Schedule "A" to this by-law.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF PICKE~tING HEHEBY EEACTS AS FOLLOWS:
1. An easement for the purposes hereinafter set out be and the
same is hereby expropriated affecting the lands described in Schedule "A"
annexed hereto.
2. The purposes for which this easement is expropriated are as
follows:
(a) To construct, instal, la~, maintain and operate or any one
or more of them under the lands described in Schedule "A" annexed
hereto a sanitary sewer or sanitary sewers forming p~rt of the
drainage system of the s~id Corporation including all pipes,
mains, conduits, connections, valves, me, holes, and fixtures
necessary or incidental thereto.
(b) To inspect, repair, replace, remove and close up or any one
or more of them such sanitary sewer or sanitary sewers and for
such purposes to enter on the said lands described in Schedule
"A" with or without equipment at all reasonable times.
(c) To discharge through or permit to he discharged through
such sanitary sewer or sewers at all times such sewage as the
said Corporation deems requisite.
3. No person shall without the written consent of the said
Corporation erect or permit to be erected any construction whatsoever on
the lands described in Schedule "A" annexed hereto.
4. The Engineer of the said Corporation and persons claiming
through him are hereby authorized to enter on the said lands described in
Schedule "A" annexed hereto for the purposes aforesaid.
5. The said Sched~.le "A" annexed hereto shall form part of
this by-law.

Being the lands outlined in red and shown on the annexed
Survey prepared by F.E. Lansby, 0. L.S. of Marshall,Macklin
and Monaghan dated April 4, 1960.
