W~P~ Section 26 of The Planning act, R.S.O.1960, Chap.296,
provides as follow~:-
26. (1) The Council of a municipality may by by-law
designate any area wlth~ the municipality as an area
of subdivision., control, and thereafter no person shall
convey land ~ tlle area by way of a deed or tr~rmfer on
any sale, or enter into an agreement of sale snd pur-
chase of land in the area, or enter into any agreement
that has the effect of granti~ the use of or right in
land ~ the area directly or by entitlement to renewal
for a period of twenty-one years or more, unless the land
is described in accordance with and is within a registered
pla~ of subdivisions, and the council may, in the by-law
designate a registered plan of subdivision or part thereof
which shall be deemed not to be a registered plan of sub-

(2) The by-law may provide that where land is
(a) withJ~ a registered plan of subdivision; or
(b)within a registered plan of subdivision, or a
part thereof, designated in the by-law,
no person shell convey a part of any lot or block of the ls~d
by way of a deed or transfer on any sale, or enter into an
agreement o£ sale and purchase of a p~rt of any lot or block
of the land, or enter i~to any agreement that bas the effect
of grant~,~ the use of or right in a part of any lot or block
of the land directly or by entitlement to renewal for a period
of twenty-one years or more; and when the by-law contains any
such provision~ no person shall contravene the provision.
(3) Nothi~ in subsection 1 or 2 prohibits any
conveyance or agreement respecting land;
(a) if the land is ten acres or more in area and
the rezmnant, if any, remalni~g iL~ the grantor is
also ten acres or more; or
(b) if the land is the whole part remaini:~ to the
gra:~tor of one lYarcel described in a registered
conveyance to hLm; or
(c) if the consent~
(i) of the planning board of the plam~ing area in
which the land lies~ or
(ii) where the land lies in more than one plazming
area, of the planning board designated by the
Minister f~'om time to t~ne, or
(iii)where there is no pla:mir~ board, of the Minister,
is given to the conveyance or agreement.
(4) Two certified copies of the by-law shall be lodged ~ the
office of the Minister where they shall be available for public
inspection duri:~ office hours, and the by-law shall be registered
i~ the proper registry office ~'~'here it shall be made available to the
public as a preduction.

(5) Where a realist,areal plan of subdivlslou oz a
part '~:,hcreof is deemed rudder the by-law not to be a
registered plan of subdivision, the clerk of the
municipality shall, withJ~ ten days after the by-~w
is ~ssed, send notice of the passing of tLe by-law
by ]~il to the last ~own address of each person
appear~ by the last ~vised assessment roll to
be ti~e o~ner of land within t[~e p~n of subdiv~ion
or part~
(6) Wh~'e the b~-~w contains p~v~ions authorized
by subsection 2, the clerk of the municiM~lity shall,
with~ ten days after the by-law is passed, send
notice of the pass~]~ of the by-~w by ma~ to the
last known address of each ~rson appearing by the
last revised assessment roll to be the ~a~er
with~ a~ ~tistcred plan of sub~io~, or
within an~ l~rt of a registered plan of s~bdi~ision:
to whi~_'~ such pl~visions apply.
(7) Whe~ an area is des~ted as an area of sub-
division co~trol, it shall not be ~tered or dissolved
without the app~oval of the M~ter.
(8) Ever~ person who contravenes this section is
gu~ty of an offence ~nd on su~ry conviction
liable to a f~,e of not mor~ than ~500;

into any agreement that has the effect of granti~ the use of or right in land in
the area directly or by entitlement to renewal for a p~iod of twenty-one (21) years
or more~ unless the land is described in accordance with and is within ~ registered
plan of subdivision.
Nothi~g in this by-law shall be deemed to affect any conveyance or
agreement affe~th~g any of th~ land wire, he area of subdivision control No.1
where Subsection (3) of Section 26 of The Planning Act has been complied with.

t is finally passed.
