A BY-LAW TO LICENSE, REGULA'I~ Aka) GOV~'.RN THE RACING OF GO-KARTS
AN~ THE IIOLDING OF GO-KA~T RACES IN THE TOWNSHIP OF PICKETING.
W}IEREAS Paragraph 7la of Section 388 (1) of the Municipal Act
provides that by-laws may be passed by the Councils of local
municipalities for prohibiting, or for licensing, regulating and
governing, tha racing of motor vehicles or motorcycles, or one
or more defined classes thereof in the Municipality or one or
more defined areas thereof, and for prohibiting, or for
licensing, regulating and governing~ the holding of motor vehicle
or motorcycle races, or one or more defined classes thereof~ in
the Municipality or one or more defined areas thereof;
AND WJiEIFl,JAS the Municipal Council of the Corporation of the
Township of Pickering deems it advisable to license, regulate and
govern the holding of go-kart races in a defined area of the Town-
ship and to prohibit the racing of motor vehicles (including go-karts)
and motorcycles in the Township except as permitted by this by-law;
BE IT THEREF.O..RE ENACTED by the Municipal Council of the Corporation
of the Township of Pickering as follows:
1. In this by-law, "motor vehicle" and "motorcycle" shall have
the same meanin.g as defined in Section 1 (1) (m) of The
Hi~bway Traffic Act, Revised Statutes of Ontario, 1950,
Chapter 267 as amended.
2. [n this by-law, "go-kart" shall mean a four-wheeled vehicle
powered by a power lawn-mower motor or other similar motor
and having the following specifications:
(a) ]~eel base - as measured from centre to centre,
a maximum of 50 inches and a minimum
of 40 inches.
(b) Maximum Overall Length 80 inches
(c) Minimum Tread Width 2/3 of the measurement of the
wheel base.
(d) lIei~ht - a maximum of 24 inches meas~lred
at the centre of the seat back
(e~) Diameter of Each Tire - a maximum of 14 inches and a
minimum of 9 inches
(~) Engine or motor - of the 2-cycle type with a
maximum cylinder displacement
of 16.5 cubic inches.
3. in this by-law, "go-kart" shall include vehicles kno~] as
"go karts"~ "go-carts"~ "go carts", "hobby karts" and "Cml
cars", provided that no vehicle shall be deemed to be a
"go-kart" within the meaning of this by-law unless it m~ets
the specifications contained in Section 2 of this by-law.
4. No person shall race a motor vehicle, motorcycle or a go-kart
and no person shall hold a motor vehicle, motorcycle or a
go-kart race in the To%a~ship of Picketing, except that a go-kart
may be raced and a go-kart race may be held at a race track
in the area defined in Schedule "A" annexed to this by-law and
forming part hereof and provided such go-kart racing or such
go-kart race is held in accordance with this by-law and the
regulations hereinafter set forth.

5, No person shall operate or hold a go-kart race until a license
has first been obtained From the Council of the Corporation of
the Township of Picketing and except in accordance with the
regulations hereinafter set forth.
6. Each applicant for a license required by Section 5 hereof
must satisfy the Council that:
(1) the holding of go-kart racing ~s to be confined to
property within the area defined in Schedule "A" hereto;
(2) each go-kart race is to be held upon a hard sar. face or
dirt race track constructed for the minimization of dust
and skids and in a manner satisfactory to the Township
Engineer;
(3) The property upon which the race-track is to be situated
provides for adequate standing room or seating accommo-
dation behind satisfactory barricades and fences, and :lo
barricade or fence shall be closer to any part of the race
track than 35 feet;
(4) the race track has adequate fire fighting equipment
approved by the Fire Chief of the Township of P±ckering to
be available for all races and to be present in the infield
at all times during a race; and operated by a qualified
person approved by the Fire Chief of the Township of
Picketing;
(5) he possesses a valid policy or policies of insurance
covering him for public liability and property damage,
such insurance to be of an amount not less than the
following:
(a) for injury or accidental death of one spectator
resulting from a single mishap, ~25~000o00;
(b) for injury or accidental death to two or more
spectators resulting from a single mishap~
~50,000.00;
(c) for property damage (annually)~ ~5~000~00
(6) the race track has san]tary facilities satisfactory to
the Ontario County Health Unit.
he will have adequate first-aid equipment available when
the track is open:and being used; and someone in attendance
qualified to administer first aid;
(8) he has made arrangements for the suspension and control
of traffic before and after a race which are satisfactory
to the Chief Constable of the Township of Picketing;
(9) he is a fit and proper person to be licensed.
7. if the application for the license is satisfactory to the
Council~ they shall direct the Clerk of the Townshipto issue a
license to the applicant upon the payment of ~500.00 and upon
the Filing of the insurance policy or policies required by
Section 6 (5) hereof~ and tile works required hy Section 6 (2)
hereof, being constructed in a manner satisfactory to the
Township Engineer.
8. Such license shall be issued and signed manually by the Clerk
and shall be terminated at the end of the calendar year in
which it is issued.
9. No person shall operate or hold a go-kart race until all the
facilities and services required by Section 6 hereof have
been constructed or provided in accordance with such section.

10, Each applicant for a license under this by-law must be the owner
or tenant of land situated ]n the area annexed hereto as Schedule "A"
and go-kart races shall only be held upon such land provided that no
go-kart races shall be held upon any land which is located within
one-halF mile of a duelling-place or hotel.~ No intoxicating /iquor~
~er~ ~.ne or other alcoholic beverage shall ~ sold or cons~ed
upon the ~and o~ed or leased by the holder of the license under this
11. Gambling, disorderly conduct and the use oF profane or obscene
langua~e shall not lm permitted upon the property owned or leased
by the holder of the license under this by-law.
12. A holder oC a license under this by-law shall not erect or permit
the erection or scaffolds to acco~odate spectators, but only
stands subject to the approval of Builaing Inspector.
13. A holder of a license ~der rials by-law shall not permit ~rivers
of go-karts to operate the same upon the property o~od or leased
by him, unless such drivers are ~aring adequate crash or safety
helmets or plastic or other non-n~tallic material and unbreakable
,gog:~1es or visors.
14. A holder of a license under this by-law shall not permit the racing
or other operation of a go-kart upon property o~ed or leased by hJm~
unless such go-kart is equipped w:ith brakes on at /east one of the
two reap wheels.
15. The operation or A'o-karts on an~ portion of the land o~ed or leased
by the holder oC a license, other than upon a paved or dirt track
as referred to in Section G (2) hereoC~ is prohibited and all
go-karts shall be transported to ana from the property so owned or
leased by means off a motor vehicle or ~ truck licensed under
The IIi.%hway Traffic Act.
16. Go-Karts shall only be raced bet~en the hours of ten o'clock in
the morning and ten o'clock in the evening on ~ek days, and on
S~u~days between the ho~s of one o'clock i~) the afternoon and
six o'clock in the evenJn.~. No person un,er the age oC fifteen
years sba]/ ~ permitted to race a {~o-kart provided that parsons
of the ages of ten to twelve years can operate, bt}t not race a
go-Cart upon a licensed track at ~governed speeds up to ]2 miles
per ho~ and persons oC the ages of thirteen and Cot~teen years can
operate, but not Pace go-karts upon a licensed track at governed
speeds up to 20 miles per ho~, but such operation by persons
unaer the age of C~.fteen years shall not take place dl~.Jng the
holding of a go-kart race upon the same track.
17. Nothing in this by-law shall be deemed to permit the racing of any
vehicle other than a go-kart as defined in Section 2 herein.
1S. The racing of ~go-karts in any part of the To,ship other than upon a
race track situate~ in the area ~ef:ined :in Schedule "A" annexe~ to
this by-law by a holder oC a license nnder this by-haw J s prohibited.
19. Any person convicte~ of a breach of any oC the provisions or
requirements of this by-law shall be liable upon conviction therefor
to forfeit an~ pay at the discretion oC the convicting magistrate,
a penalty not exceeding ~300.00 exclusive of costs for each offen6e.
Every snch penalty shall be recoverable under the provisions of the
S~ary Convictions Act.
20. 1C the ho]der of a license unaer this by-law fails to comply with
any of the requirements of this by-law or allows any person upon the

20. land owned or leased by him for go-kart racing to fail to comply with
any of the requirements o£ this by-law then the Colmcil may forfeit
and revoke his license and notice of forfeiture or revocation shall ~
e~fectively given by ordinary prepaia mail addressed to the holaer
oF the license or by posting up the same upon the land upon which
the licensed race track is situate. No racing dC go-karts shall be
permittea by the holder of a license a~ter the revocation of his

21. In this by-law "person" or any word or expression descriptive o~ a
pepson~ includes a club an~ anybody corporate and politic, and the
heirs~ executors, administrators or other legal representatives of
such person according to law.
22. By-~w N~P ~ is hereby repealed.
