A BY-LAW TO LICENSE, REGULATE AND GOVERN VEHICLES FROM ~{IC}! REFI~ESN~NTS
ARE SOLD FOR CONSIFMPTION BY THE PUBLIC AND FOR THE iiEVOKING 0F ANY SI]CH
LICENSE.
~-IEREAS by Section 413 (aa) of the Municipal Act, B.S.0. 1950 Chapter
243 as amended by-laws may be passed to license, regulate and govern
'vehicles from which refreshments alt sold for consumption by the public
and for the revoking of any such license;
..A.ND WHEPd~A.S the Co%mcil of the Corporation of The Township of Picketing
deems it desirable to license, re~gulate and govern vehicles from which
refreshments are sold for consumption by the public;
.NOW THEREFORE the Co~ulcJ 1 of the Corporation of The Township of Pickerin~
ENACTS AS FOLLOWS:
1. In this By-L~w:
No person shall go from place to place or to a particular place
within the boundaries of the Township of Picker~n~ for the purpose
~5 of sellinf refreshments from a vehicle, without first, obtaining a
license ~mder the provisions of this By-I~w.
2. The fees for a license tn]der this by-law shall be:
(a) .~50.00 for a person with a motor vehicle.
(b) $20.00 for a person with a horse drawn vehicle.
(c) $10.00 for a person with a pushcart or any other vehicle on
wheels, rnuners, or skids, drawn or propelled by human
musc~l ar powe r.
(d) Provided, however, '%hat a person who was a resident of the
Township of Picl~ ring for the full year precedin;f the date
of application for a license hereunder, shall only be
required to pay 20 per cent of the applicable fee as req~uired
above.
(a) A license issued nnder this by-law is valid only f~om the
date of its issue to December 31st of the year of its
issue and is not transferable.
~ - (b) A license is subject to revocation by the Council of the
Township of Picketing at any time for non compliance with
the provisions of this by-law or non compliance with such
regulations as may be passed by the Council from time to
time or by the Medical Officer of Health.
4. A license shall only be issued afl,recommendation by the 5~dical
Officer of Health. ~.~.~.~.~ .
No vehicle shall park within ~Oro feet of a business, within the
Township of Picketing, operating a lunch counter, snack bar or
refreshment booth licensed by the Township of Picketing.
~ An application for a license shall be made to the licensing
· off~cer on the appropriate form and the necessary fee shall be
paid to the Treasurer of the said Corporation.
7. The licensee shall a% all times while carrying on his bnsiness
have his license with him and shall upon demand exhibJ~t i% to any
)~ municipal or officer, and if he fails to do shall, unless
peace
· the same is acco]~m%ed for satisfactorily, incur a penalty of not
less than $1.00 or more than ~5.00 exclusive of costs.
9. If a peace officer demands the production of a license by any person
to whom th~s by-law applies and the demand is not complied with,
)/] shall be %he duty of the peace officer, and he shall have power to
~rrest such person without a warrant and %o take him before the
nearest 3ustice of %he peae~, there to be dealt with according to
law.

9. Any person who contravenes any provision of this by-law except as
[~-~ provided in Section ? shall upon conviction be liable to a penalty
~ '~.~not exceeding $50.00, exclusive of costs, recoverable under The
%-/ S~m~mary Convictions Act.
10. It shall not be necessary fer a vehicle licensed under this by-law,
;~, for the purpose of selling refreshments from a vehicle for consumption
by the public, to obtain a license for peddling under By-Law 2133.
