A BY-LAW OF THE CORPORATION OF THE TOWNSHIP OF PICKERING TO REGULATE
OBSTRUCTION OF WATER COURSES, CREEKS, STREAMS AND OPEN DRAINS.
The Municipal Council of the Corporation of the Township of Pickering
ENACTS AS FOLLOWS:
1. Any person who owns land on which a fence crosses an open drain or
water course shall erect or cause to be erected, and shall maintain
or cause to be maintained, a water-gate, and any person who fails
to erect or maintain such a water-gate may be directed or required
to do so by the Council of this Corporation.
2. No person shall obstruct or place any obstruction in any drain or
water course; any person obstructing or placing an obstruction in
any drain or water-course may be directed or required by the Council
of this Corporation to remove the obstruction forthwith.
3. No person shall obstruct or allow to be obstructed any stream, creek
or water course by trees, brushwood, timber or other materials and
should any stream, creek or water course become obstructed, the
person causing the obstruction shall remove the obstruction and may
be directed or required so to do by the Council of this Corporation.
4. Should any person directed or required by this By-law or by the Council
of this Corporation fail to do what is directed or required to be done,
such matter or thing shall be done at his expense, and the Corporation
shall recover the expense incurred in doing it by action, or the expense
incurred in doing it may be recovered in like manner as municipal taxes.
5. Any person convicted of a breach of any provision of this By-law shall
forfeit and pay, at the discretion of the convicting magistrate, a
penalty not exceeding (exclusive of costs) the sum of Three Hundred
Dollars ($300.00) for each offence.
6.. By-Law No. 2445 be and the same is hereby repealed.
