A BY-LAW OF THE TOWNSHIP OF PICKERING TO PROVIDE FOR THE COLLECTION
OF GARBAGE AND OTHER REFUSE.
as a by-law of The Corporation
neil thereof as follows:
1. Every owner, lessee or occupant of premises within The Township
of Pickering shall provide a proper receptacle or proper receptacles
for the deposit of garbage. Such receptacles shall be constructed
of galvanized iron or other material approved by the Works Supervisor
or by such other official as may be appointed by Council for that
purpose and shall be furnished with a tight cover. Such receptacles
shall be of such a size that no receptacle, when filled, shall,
together with its contents, weigh more than fifty (50) pounds.
All table and kitchen waste shall be thoroughly drained before
being placed in such receptacles and any such receptacle, when
containing garbage, shall be kept tightly covered. No garbage
or table or kitchen waste or refuse shall be placed in the same
receptacle as ashes or rubbish.
2. Every owner, lessee or occupant as aforesaid shall on such days as
may be designated by Council or by the Works 3uporvtsor for the
collection of garbage, place all receptacles containing garbage
on the street line of his premises or, where there is space
between the street line and the travelled road not occupied by
a sidewalk, on the street as close as may be practicable to the
travelled road PROVIDED THAT owners, lessees and occupants of
business premises shall place such receptacles in such places
on their premises or on the streets as may be designated by the
Council of the Township of Pickering from time to time.
3. No owner, lessee or occupant of any premises shall place for
collection on any one collection day more than forty (40) cubic
feet of garbage, waste, refuse, ashes and rubbish from such
premises.
4. In the preceding sections numbers 1, 2 and 3 of this by-law the
word "premises" shall be deemed to mean and include one tenement
only and, where any property or building is divided between or
in the possession of two or more owners, lessees or occupants,
each of them shall be deemed to be the owner, lessee or occupant,
as the case may be, of premises within the meaning of this by-law.
5. No person other than persons authorized by the Council to collect
garbage shall pick over, interfere with, remove or scatter the
contents of any receptacle placed for garbage collection in
accordance with the provisions of the foregoing sections or any
other article so placed whether contained in a receptacle or not.
6. No person or persons shall enter upon such lands as may be
designated from time to time by the Council as a garbage dump or
pick up, remove or carry away any article, material or thing
deposited there except such person or persons as may be
authorized from time to time by the Council so to do.
7. Any person committing any breach of any provision of this by-law
shall be guilty of an offence and shall, upon conviction thereof,
be liable to a penalty for each such breach of not less than
FIVE DOLLARS ($5.00) and not more than FIFTY DOLLARS (650.00),
exclusive of costs, and any such penalty shall be recoverable
under the Summary Convictions Act all the provisions of which shall
apply except that the imprisonment may be for any term not exceeding
twenty-one (21) days.
