HomeMy WebLinkAboutBy-law 2161B Y- L A W N U M B E R Z i A BY-LAW OF THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF PICKERING TO ADOPT AN AGREEMENT FOR THE TOWNSHIP TO CREATE CERTAIN IMPROVEMENTS ON ROAD IN PLAN 360 AND PLAN 275. BE IT ENACTED by the Municipal Council of the Township of Pickering that: 1. The attached Agreement signed by over two-thirds of the owners whose lands are in Lots 146 to 167 (inclusive) in Plan 275, and in Lots 13 to 21 inclusive in Plan 360, requesting the Township create certain improvements on road in Plan 275 and 360, be approved subject to the requirements of the Agreement, appearing as Schedule "A" to this By-Law BY-LAW read a First and Second time this- `3?-1 day of!___i;;. _ 1956 BY-LAW read a Third time and PASSED this„ 3-? day of_ 1956 ....'s .....:... 1. .... . .. .... Clerk S C H E D U L E " A" Attached to and Forming Part of By-Law Number_.-y!.2._ A G R E_E M E N T made this hundred and fifty f!ve.y " B E T W E E N day of o+-11 one thousand, nine All Parties' named Wko Imme, subs d tke?kr nams ha, - ho, herein called the OWNERS OF THE FIRST PART - and - The Municipal Corporation of the Township of Pickering in the County and Province of Ontario, herein called the CORPORATION OF THE SECOND PART WHEREAS by Petition the Owners have requested this Corporation to create certain improvements upon the following road: Block F, Plan 275 being a 25-foot right-of-way given owners of Lots 146 to 167 (inclusive together with all of Block B and the Easterly 250 feet of Block A in Plan 360, which form a 25-foot right-of-way for owners of Lots 13 to 21 inclusive in Plan 360. NOW THIS, AGREEMENT WITNESSETH THAT the said Corporation agrees that it will grade, gravel and maintain the said road on payment of One Dollar per year by the said owners to the Corporation, for which service the owners agree that their said lands shall be rated against in the years 1956, 1957 and 1958 for the sum of 20¢ per foot frontage, and said rates shall be a liability against said lots until such rates are paid. The said owners covenant that he, she or they are owners in fee simple of their respective lands, and that the said Corporation may, if they wish, register this Agreement, or a copy of same, in the Registry Office for the Registry Division of the County of Ontario at Whitby, as notice to subsequent purchasers that the lands of the Owners are charged with the aforesaid three levies. It is also agreed by and between the said parties hereto that the manner and method of carrying out the aforesaid improvements on the said roads will be in the absolute discretion of the Corporation, the officers, servants or agents of the Corporation; and that the said owners shall have no right of action against the said Corporation resulting from nonfeasance or malfeasance. AND TH4 SAID OWNERS, for themselves, their respective heirs, executors, administrators, successors or assigns, covenant to carry out and put into effect the terms of this Agreement.
