A BY-LAW OF THE MUNICIPAL CORPORATION OF THE TOWNSHIP OF PICKERING TO
ADOPT AN AGREEMENT FOR THE TOWNSHIP TO TAKE OVER CERTAIN ROADS IN PLAN
233, ROSEBANK.
BE IT THEREFORE ENACTED by the iiunicipal Council of the Township of
Pickering, that:
?$ 1. The attached Agreement signed by 75% of the owners requesting
that the Township assume the roads that front on Lots 15 to 20 in-
clusive and 23 to 32 inclusive, all on Plan 233, as a Township roads
be accepted by Council and said roads shall become a part of the
Township of Pickering Road System as of this date.
2. That the sum of be levied against the owner shall be 60% of G ff
S which was the actual cost of the work according to the Road Superintendent.
3. That Schedule "A" being a copy of the petition with signatures be a part
of this By-Law.

A G R E E M E N T:
made this 22nd day of May _ ____._ One Thousand, Nine
hundred and Fifty-four.
B E T W E E N:

their names hereto, herein called the
OWNERS
OF THE FIRST PART
- and - The Municipal Corporation of the
Township of Pickering in the County
and Province of Ontario, herein
called the CORPORATION
OF THE SECOND PART.
WHEREAS,by petition, the Owners have requested this Corporation to create
certalF improvements upon the following roads and assume same as Township
of Pickering Public Roads:-
THOSE ROADS IN PLAN NO. 233 WHICH ABUT LOTS 1 to 20 inclusive and

L to 3y inclusive;
AND WHEREAS the said Corporation has agreed to make such improvements
upon therms hereinafter set out:
NOW THIS AGREEMENT WITNESSETH THAT the said Corporation will extend on its
own authority an In s own manner, and so as not to exceed the sum of
$1,684.92 (ONE THOUSAND, SIX HUNDRED AND EIGHTY FOUR DOLLARS AND NINETY-TWO
CENTS) upon rebuilding the road foundation and culverts upon the said
roads, and providing suitable drainage; the said Corporation will levy
upon its general rate FORTY PERCENT (40%) of such expenditure and the
Owners will pay on levy thereof in the years, 1955, 1956 and 1957 inclusive
the other SIXTY PERCENT (60%) of the said total cost, or TWENTY PERCENT (20%)
of the said total cost in each of the said three years; each of the Owners
whose property abuts directly on the work, or is benefitted thereby,
paying three annual levies, based on a foot frontage for each lot; that
each of the said Owners covenant that he, she or they, are owners in fee
simple of their respective lands, and that the said Corporation may, if it
wishes, register this Agreement, or a copy of same, in the Registry Office
for the Registry Division of the County of Ontario at Whitby, as notice to
subsequent purchasers that the lands of the Owners are charged with the
aforesaid three levies. It is also agreed by and between the said parties
hereto that the manner and method of carrying out the aforesaid improvements
on the said roads will be in the absolute discretion of the Corporation,
the officers, servants or agents of the Corporation; and that the said
owners shall have no right of action against the said Corporation resulting
from nonfeasance or malfeasance.
AND THE SAID OWNERS AGREE to the installation by the said Corporation of a
o s-Many e, - oo Fculvert to be placed on the road, in the ditch, at
the driveway of each Owner, and at a place agreed to between the Owner and
the Corporation, irrmediately on completion of the work. The Corporation
agrees to instal said culvert at a price of $25.00 for each culvert, and
to put gravel thereon, and the same will be added to the Owners' tax bills
in the year 1955•
AND THE SAID OWNERS, for themselves, their respective heirs, executors,
administrators, successors or assigns, covenant to carry out and put into
effect the terms of this Agreement.
IN WITNESS WHEREOF the Owners of the First Part have hereunto set their
fiats and seals, and the Corporation of the Second Part has affixed its
Corporate Seal, duly attested by the hands of its proper officers:-
