A BY-LAW OF THE CORPORATION OF TIE TO'NUSHIP OF PIC URINC, TO ACCEPT AN
AGREEMENT WITH CIPTAIN OWNVRS Ord BAYVISW ROAD IN PLAN 221 FROM CONCESSION
1 TO THE EAST-WEST LANE SOUTw OF TIE. PROPERTY OF WILLIAM RUDIK, TO TAKE
OVER 110 P ; ROADS AS TOWNSHIP ROADS.
A,ri WHEREAS over 664 of owners of properties on Sayview Road have signed the
attached Agreement called "Schedule A", and have petitioned Council to
sa1o
take over oa s roads;
AND WHEREAS the Council view with favour the granting of such Petition;
BE IT THEREFORE ENACTED by the Municipal Council of the Township of
Pickering:
1. That the following private road shall he taken over as a Township
Road;
Bayview Road in Plan 22l from Concession 1 to the East-West Lane
south of the property of William Rudik.
2. That the said road will betaken over in accordance with Agreement
in Schedule "A" of this Ky-Law.
?. 3. That the Corporation will assume said road on completion of work
as specified in Schedule "A".

made this Twenty-Seventh day of February, one thousand nine hundred and
fifty-two

All Parties named who have subscribed
their names hereto, herein called the
"ONNFRS"
OF THE FIRST PART
- and - The Municipal Corporation of the
TOWNSHIP OF PICKFRING, in the County
and rovinee of Ontario, herein called
the "CORPORATION"
OF THE, SECOND PART
WHEREAS by petition the Owners have requested this Corporation to take over
Bayview Road in Plan 221from Concession 1 to the ?East-'.vest Lane South of the
property of William Rudik;
AND WHEREAS the said Corporation has agreed to take over such road upon the
arms hereinafter set out:-
NOW TuIS AGRREMENT WITNVSSETF that the said Corporation will extend on its
own gut or v, an in its own manner, and so as not to exceed One Thousand,
Six Hundred and Fifty Dollars (11,650.00) upon rebuilding the road foun-
dation and culverts unon the said road; the said Corporation will levy upon
its general rate FORT' P7RCT;NT (501) of such expenditure and the Owners will
pay on levy thereof in the year 1953, 1954, and 1955, the other STXTy PER-
C7NT (6011 of the said total cost, or TWUlTv P7RCFNT (201) of the said total
cost in each of the said three vears,each of the Owners, whose property abuts
directly on the work or upon land immediately benefitted by the, work, paving
an equal_ share, the one with any other one of them, in the said levy; that,
each of the maid Owners covenant that he, she or them are owners in fee
simple of their respective lands in the said subdivision, and that the said
Corporation may, if the- wish, register this Agreement, or a copy of sam-, in
the Registrv Office for the Re7istrv Division of the County of Ontario at
Whitbv, as notice to subsequent purchasers that the lands of the Owners are
charged with the aforesaid levy.
IT IS ALSO AGR770 by and between the said parties h^reto that the manner and
method o carrying? out the aforesaid improvements on the said road will be in
the absolute discretion of the Corporation, the officers, servants or agents
of the Corporation; and that, the said Owners shall have no right of action
against the said Corporation resulting from nonfeasance or malfeasance.
AND THE SAID OW17103 A .R77 to the installation by the said Corporation of a
STEEL CULVERT to be placed on the road, in the ditch, at the driveway of
each Owner, and at a place agreed to between the Owner and the Corporation
immediately on completion of the work. The Corporation agrees to instal said
culvert at cost to themselves, and the same will be added to the Ownerst tax
bills in the year lQ53.
AND THE SAID OWNERS, for themselves, their respective heirs, executors, ad-
ministrators, successors or assigns covenant to carry out and put into effect
the terms of this agreement.
IN WITNESS WN;RFOF the Owners of the First Part have hereunto set their
ands and seals and the Corporation of the Second Part has affixed its Cor-
porate Seal, duly attested by the, hands of its proper Officers:
