HomeMy WebLinkAboutBy-law 1741 BY-LAW NO. 1741 Of the Township of Plokering to repeal By-law No. 1730 so that licenses may be issued by the Plekerlng Township Game Commission, which includes hares, rabbits, ground hogs and pheasants, that aal~ Game Commission be authortze~ to set and collect fees for said licenses, and that said Commission be authorized to set and collect a fee for the repossession of firearms seized for illegal possession. w~EAS Section 72 subsection (D} of the Game and Fisheries Act 19~7 provides that "the Lieutenant-Governor in Council may make regula- tions authorizing townships or township organizations approved by the Minister to issue and charge fees for licenses to hunt, during the open season, pheasants and rabbits within the township or within the lands controlled by the township organlzatlons',~ ~H~REAS by an Order in council dated Oct. 18, 1947, municipalities within a Game Preserve Area may set, issue licenses end collect fees for their own uss, for the huntinM of pheasants, ground hogs and certain fur-bearing enimals. AND w~um~EAS the Township of Picketing is a Game Preserve Area operating under a Game Commission approved by the Department of Lands and Forests: AIID WHEREAS the said Game Commission has requested Council to pass a By-law requirin~ all persons within the Township of Picketing to first secure a Township of Pickering license from the Game Commission before carrying a gun for the purpose of hunting any game as defined by the Game and Fisheries Act 1947. BE IT THEREFORE RE.~OLVED by the ~unicipal Council of the Township of Pickering: 1. It is unlawful to carry or use a firearm or sirgun for the purpose of hunting shy game, as defined in Section I subsection i of the Game and Fisheries Act, 1947, including ground ~ogs, in the Township of Pickering, in the County of Ontario, without the authority of a Picketing Township license, providing that this does not apply to s fermsr or his sons residing and hunting on his lands. 2. It is unlawful to hunt, kill or destroy pheasants in Picketing Township except under authority of a Picketing Township license. 5. It is unlawful to contravene the terms of this Township license. - 2 - 4. That the fee for such license, ia the ease of non-residents, shall be not more than 53°00, and in the case of residents, more than 50¢, and said license shall expire on the last ~sy of February following date of issue. 5. That where firearms or airguns are seize~ by a Game Warden un~er this By-law, said firearms or airguns may, after conviction, be repossessed upon payment of a fee not to excee~ $3.00, and all firearms or airguns selza~ shall be in possession of the G~me Commission until such time as said fees have been paid for reposeessisn, or subject to the Order of th~ Court. 6. That all Picketing Township Gems Wardens appointed by the Ontario Department of Lands and Forests recommended by the Piekering Township Game commission be and they are hereby aopointed Special Constables, shall be sworn in and empowere~ to make arrests amd seize firearms and air.guns under this By-law. 7. The penalty of infractions of this By-law be not less than $10.00 or more than $100o00. 8. That By-law No. 1730 be and is hereby repealed. By-law read a first time April 5, 1948. By-law rea~ a second time April 5, 1948. By-law finally read a third time and passe~ April 5, 1948.
